Re: Marriott Transit Occupancy Tax Audit
Dear Monyvann:
This letter serves to finalize the outstanding Transi t Occupancy Tax (TOT) audit conducted by our consultant HdL. In consideration for finalizing the audit, the Conventi on Center Marriott agrees to remit the total amount of $10,000 due and payable upon receipt of this letter.
To address any potential future audits relative to the assessment of TOT to comped rooms the City agrees to the following. Prospectively, the City agrees that the calcul ation of comped rooms will be based on the prior year average ADR value to be fully supported by underlying business documents and other supporting information provided by the Convention Center Marriott. The docu ments should be of such support that the amounts utilized to compute the average ADR shall be auditable and traced back to supporting company financial records. Additionally, the City agrees that any future audits conducted by the City and its representatives will use the prior year average ADR beginning the period of November 1, 2023. No additional retroactive tax will be due or payable prior to this start date other than what’s been noted in this letter.
