TO: HONORABLE MAYOR AND CITY COUNCIL DATE: JUNE 18, 2024 FROM: PUBLIC WORKS DEPARTMENT WARD: 4 SUBJECT: APPROVAL OF THE MASTER COOPERATIVE AGREEMENT WITH RIVERSIDE COUNTY FLOOD CONTROL AND WATER CONSERVATION DISTRICT FOR THE DESIGN, CONSTRUCTION, INSPECTION, AND MAINTENANCE OF MINOR DRAINAGE FACILITIES; AND APPROVAL OF THE WOODCREST-RINEHART ACRES DRAINAGE PLAN IMPROVEMENTS PROJECT DESCRIPTION EXHIBIT NO. 1 ISSUE:
Approve the Master Cooperative Agreement with Riverside County Flood Control and Water Conservation District for the Design, Construction, Inspection and Maintenance of Minor Drainage Facilities and Woodcrest-Rinehart Acres Drainage Plan Improvements Project Description Exhibit No. 1.
RECOMMENDATIONS:
That the City Council:
Approve the Master Cooperative Agreement with the Riverside County Flood Control and Water Conservation District for the Design, Construction, Inspection and Maintenance of Minor Drainage Facilities; Approve the Woodcrest-Rinehart Acres Drainage Plan Improvements Project Description Exhibit No. 1; and Authorize the City Manager, or designee, to execute the Master Cooperative Agreement with the Riverside County Flood Control and Water Conservation District and Project Description Exhibit No. 1, including making minor and non-substantive changes.
BACKGROUND:
In Western Riverside County, the Riverside County Flood Control and Water Conservation District (District) takes the lead on the funding, designing, constructing, operating and maintaining certain Regional Drainage Infrastructure projects (“Projects”) as approved by the District’s Board of Supervisors when the Project is incorporated into District’s budget, advertised for public bidding, and awarded to the lowest responsible bidder. These projects commonly also include Local Drainage Features such as smaller pipes and inlets, as well as other City Betterments as requested by the City. Typically, the District enters into a standalone cooperative agreement to define the roles and responsibilities of the agencies for each Project. These cooperative agreements cover topics such as: funding, utility relocations, encroachment and haul permits, inspection, operations, and maintenance.
DISCUSSION:
The Master Cooperative Agreement (MCA) identifies the roles and the responsibilities of the District and the City with regards to the inspection, construction, operation, repair, and maintenance of portions of certain flood control and drainage facilities, known as Regional Drainage Infrastructure and Local Drainage Features, located within the City’s Jurisdiction. This MCA will serve in lieu of standalone cooperative agreements for most scenarios that meet the requirements identified in this MCA.
The MCA will be applicable to all subsequent Projects funded and constructed by the District and located within the City public right of way. The MCA incorporates general definitions, terms and conditions that apply to all such projects, however each Project constructed by the District will still require the development and execution of a Project Description Exhibit ("PDE").
The MCA is intended to reduce administrative burden and associated costs of processing standalone cooperative agreements for Projects in which (1) only minor drainage features are proposed within the City Jurisdiction, (2) the Project does not require additional entities to be part of the cooperative agreement, and (3) the Project is not dependent on additional funding mechanisms or other terms requiring Agencies’ respective governing Board’s approval. The MCA covers only those PDEs which are fully executed within five (5) years from the effective date of the MCA.
The Woodcrest-Rinehart Acres Drainage Plan Improvements No. 1 is a District-led project to reduce street and community flooding in the Woodcrest Rinehart-Acres Subdivision. The project consists of approximately 10,000 feet of street improvements and 8,000 feet of a reinforced concrete pipe storm drain system ranging in diameter from 18 to 66-inches to convey runoff from the streets of Mariposa Avenue, Granite Avenue, Boulder Avenue, Dallas Avenue, Obsidian Drive, and Wood Road to the natural outlet southeast of the Wood Road and Dallas Avenue intersection. The street improvements identified for this project are necessary to collect and convey runoff to the proposed storm drain inlets. City betterments include the full excavation and reconstruction of street pavement, aggregate base, and asphalt concrete dike along the northern portion of Mariposa Avenue beginning 200-feet west of Obsidian Drive and terminating at the Mariposa Avenue and Wood Road intersection.
STRATEGIC PLAN ALIGNMENT:
This item supports Strategic Priority 6 - Infrastructure, Mobility and Connectivity and Goal 6.2 – Maintain, protect, and improve assets and infrastructure within the City’s built environment to ensure and enhance reliability, resiliency, sustainability, and facilitate connectivity.
This project aligns with each of the five Cross-Cutting Threads as follows:
Community Trust – This Project reduces street and community flooding in the Woodcrest Rinehart-Acres Subdivision. The street improvements identified for this project are necessary to collect and convey runoff to the proposed storm drain inlets.
Equity – This project will improve flood protection within the Woodcrest community.
Fiscal Responsibility – The Public Works Department is a prudent steward of public funds and construction projects are always awarded to the lowest responsive bidders.
Innovation – This project exemplifies established methods of storm drain improvements. Riverside is inventive and timely in meeting the community’s changing needs and prepares for the future through collaborative partnerships and adaptive processes.
Sustainability & Resiliency – The construction materials specified for this project are considered best practices in the industry and are expected to last well into the future.
FISCAL IMPACT:
The estimated fiscal impact is $289,150 for the City improvements which include: street repaving, and AC dike, exclusive of applicable fees and authorized change orders. The final cost will be determined by actual bids and upon intent to award to lowest bidder. The district shall invoice the City per the terms of the agreement. Sufficient funds are budgeted and available in Capital Outlay Fund, Minor Streets Rehab Project account number 9888440-440301 to complete the project.
