RIVERSIDE
OF REAL PROPERTY BY EMINENT DOMAIN
City of Arts & Innovation THIRD STREET GRADE SEPARATION PROJECT NOTICE IS HEREBY GIVEN that an interest in the real property owned by you, or in which you have an interest, located in the city and county of Riverside, state of California, is proposed to be acquired by the City of Riverside through its powers of eminent domain to construct a railroad underpass at the Third Street and the BNSF railroad tracks and related purposes. The real property proposed to be acquired is generally described in the attached Exhibit 1.
The Public Hearing will be held by the City Council of the City of Riverside on the following date:
DATE AND TIME: March 25, 2025, at 3:00 p.m.
LOCATION: Art Pick Council Chamber, 3900 Main Street, Riverside, CA View live Webcast at www.RiversideCa.gov/Meeting
It is the intention of the City Council to consider the adoption of a Resolution of Necessity pursuant to the Eminent Domain Law of the State of California (Title 7 of Part 3 of the Code of Civil Procedure commencing with section 1230.010).
You may appear at said hearing and be heard on the following matters:
(1) Whether the public interest and necessity require the project; (2) Whether the project is planned or located in the manner that will be most compatible with the greatest public good and the least private injury; (3) Whether the property sought to be acquired is necessary for the project; (4) Whether the offer required by Section 7267.2 of the Government Code has been made to the owner or owners of record; and
Whether there exists an overriding need for prejudgment possession.
If you wish to appear and be heard at said hearing, you must file a written request with the City Clerk of the City of Riverside, City Hall, 3900 Main Street, Riverside, California 92522, within fifteen (15) days after the date on which this Notice was mailed to you.

DAYS AFTER THIS NOTICE WAS MAILED, SUCH FAILURE WILL RESULT IN WAIVER OF YOUR
RIGHT TO APPEAR AND BE HEARD, AND THE CITY COUNCIL NEED NOT GIVE YOU AN OPPORTUNITY TO SO APPEAR AND BE HEARD.
YOU MAY SEEK THE ADVICE OF AN ATTORNEY OF YOUR CHOICE AT YOUR EXPENSE IN CONNECTION WITH THIS MATTER. IF YOU DESIRE TO CONSULT AN ATTORNEY, YOU SHOULD DO SO IMMEDIATELY.
Information on the proposed Third Street Grade Separation Project is on file in the Public Works department of the City of Riverside and is open to public inspection. Also, a copy of the proposed Resolution of Necessity will be available upon request for inspection at he Office of the City Clerk of the City of Riverside The Public Works department and the City ark's office rect at City Hall, 3900 Main street.
