City Council Memorandum
TO: HONORABLE MAYOR AND CITY COUNCIL DATE: JUNE 23, 2026 FROM: CITY CLERK WARDS: ALL

CITY ATTORNEY
SUBJECT: ADOPT A RESOLUTION REVISING CITY COUNCIL RULES OF PROCEDURE AND ORDER OF BUSINESS TO COMPLY WITH SB707’S REQUIREMENTS FOR DISRUPTION OF TELEPHONIC OR INTERNET SERVICE DURING A MEETING ISSUE:

The issue for the City Council consideration is to adopt a resolution revising City Council Rules of Procedure and Order of Business to comply with SB707’s requirements for disruption of telephonic or internet service during a meeting.

RECOMMENDATIONS:

That the City Council adopt a resolution to revise the City Council Rules of Procedure and Order of Business to comply with SB707’s requirements for disruption of telephonic or internet service during a meeting.

DISCUSSION:

SB707, entitled “Open meetings: meeting and teleconference requirements,” was adopted on October 3, 2025, and added Section 54953.4 to the Government Code. This section requires the City, by July 1, 2026, to approve at a noticed public meeting in open session, and not on the consent calendar, a policy regarding disruption of telephonic or internet services occurring during meetings and require the City to comply with certain requirements related to such disruptions, including recessing the open session for at least one hour and making a good faith attempt to restore the service, as specified.

To comply with this law, the following section is proposed to be added to Article VIII, “Meetings”, of the City Council Rules of Procedure and Order of Business:

J. DISRUPTIONS TO MEETINGS
If there is a disruption of telephonic and/or internet service that prevents members of the public from attending or observing the meeting via the two-way telephonic service and/or two-way audiovisual platform occurs during the meeting, the City Council shall recess the open session of the meeting for at least one hour and make a good faith attempt to restore the service. The City Council may meet in closed session during this period. The City Council shall not reconvene the open session of the meeting until at least one hour following the disruption, or until telephonic and/or internet service is restored, whichever is earlier. Upon reconvening the open session, if telephonic and/or internet service has not been restored, the City Council shall adopt a finding by rollcall vote that good faith efforts to restore the telephonic or internet service have been made in accordance with this section and that the public interest in continuing the meeting outweighs the public interest in remote public access.

FISCAL IMPACT:

There is no immediate fiscal impact from this report.
