City Council Memorandum
TO: HONORABLE MAYOR AND CITY COUNCIL DATE: SEPTEMBER 15, 2026 FROM: HUMAN RESOURCES DEPARTMENT WARDS: ALL
SUBJECT: ADMINISTRATIVE LANGUAGE REVISIONS TO THE MEMORANDUM OF UNDERSTANDING WITH THE RIVERSIDE POLICE OFFICER’S ASSOCIATION UNIT TO COMPLY WITH CALPERS’ REPORTING REQUIREMENTS OF SPECIAL COMPENSATION.
ISSUE:
Approve administrative language revisions to the Memorandum of Understanding with the Riverside Police Officer’s Association (RPOA) Unit to comply with CalPERS’ reporting requirements of special compensation.
RECOMMENDATION:
That the City Council approve the administrative language revisions to the Memorandum of Understanding (MOU) with the Riverside Police Officer’s Association (RPOA) Unit to comply with CalPERS’ reporting requirement of special compensation.
BACKGROUND:
In July 2025, the City worked closely with CalPERS to incorporate necessary language revisions to the RPOA MOU to ensure compliance with the California Code of Regulations (CCR), Section 571, which outlines all eligible special compensation for Classic and Public Employees’ Pension Reform Act (PEPRA) members that is allowable as pensionable compensation. Currently, the special compensation is outlined in the City’s Fringe Benefit and Salary Plan going back to at least 2006 and is payable to eligible Police Officers or Police Detectives who are assigned to routinely and consistently perform traffic collision reconstructionist tasks or duties. CalPERS requires that the MOU revisions be adopted and approved by City Council in order to report and include this special compensation for members of the RPOA group.
DISCUSSION:
The City and the Union have confirmed with CalPERS that the proposed language revisions to the RPOA MOU are acceptable and comply with CCR, Section 571. The revisions to the RPOA MOU include addition of a new Section 2.12, Police Investigative Premium Pay, for a five (5%) additional pay effective retro-actively to January 1, 2006 to be paid to eligible Police Officers/Detectives assigned to perform traffic collision reconstructionist duties. This special compensation provision has been in place going back to at least 2006 in the City’s Fringe Benefits and Salary Plan, under Section 5 (e) 11. There is no financial impact to revising the MOU language to be in compliance; the retro-active date is necessary to ensure that retirees who received the special compensation get the special pay included as pensionable compensation.
FISCAL IMPACT:
There is no fiscal impact associated with this report.
