Parks and Recreation Department
Tree and Bench Donation Policy
The City Council recognizes the need to promote community involvement and active participation in quality of life components throughout the community, and the need to establish a fair, equitable, and uniform procedure by which trees and benches may be donated to the City for installation in City parks. This policy establishes criteria for donations to assure area compatibility, attractiveness, usefulness, and sustainability of maintenance. Each donation considered for inclusion in the City's parks system wi ll be subject to the limitations and guidelines for each particular area as established by the City’s Parks and Recreation Department.
I) Acceptance of Donations
1) All donation applications for the donation of trees and park benches to the City must be made on the form maintained by the Department of Parks and Recreation. 2) Based on the value of the donation and availability of appropriate property to install the donation, City staff will review the acceptability of any donation and determine if the benefits to be derived warrant acceptance of the donation. At a minimum, any monetary donation for a tree or bench shall cover the entire cost of purchasing and installing the item, at current market value based on the time of approval of the donation, as well as any other maintenance costs required below. 3) Criteria for evaluation includes consideration of any initial expenditure required in order to accept the donation, the community benefit to be derived from the donation, and, with respect to benches, the potential and extent of the City's obligation to maintain a donated bench for a minimum of 10 years. Unless otherwise specified in this policy, after 10 years, or at the end of the donated item's useful life, as determined by the City, the donated item may be removed or replaced by the City. 4) The cost of a park or bench donation shall also include a maintenance fee equal to 50% of the estimated 10-year maintenance cost of the donated tree or bench (including the plaque), paid for in full by the donor at the tim e of the donation. This maintenance fee is in addition the cost and installation of the donated item.
5) If, during the application phase, the Director of Parks and Recreation determines that there are no suitable or available locations for the donation, or if the donor only wants to make a donation for installation at an unavailable location, the Director of Parks and Recreation shall reject the donation application.
6) If a suitable general location for the donation exists, the donor is amenable for the ite m to be installed at that general location, and donor is willing to fund the donation amount required to install and maintain the donation, as required by this policy, the Director of Parks and Recreation shall submit the donation application to the Parks and Recreation Commission (“PRC”) for review and approval of the requested location. The PRC is responsible for reviewing and approving the location of all tree and bench donations to the City within the standards outlined in this policy. 7) The Director of Parks and Recreation is hereby authorized to execute the donation agreement and to accept the donation on behalf of the City.
8) All donations accepted by the City shall become City property and shall be open and available for general public use in a manner consistent with the City of Rocklin Parks and Recreation rules, policies, and practices. At no point should the acceptance of a donation to the City be construed as the creation of a public forum.

Introduce, Waive the Full Reading and Read by Title Only, an Ordinance of the City Council of the City of Rocklin Repealing and Replacing Section 3.32.050 of the Rocklin Municipal Code Related to the Establishment of Service Fees.
Background:
Pursuant to Rocklin Municipal Code (RMC) Chapter 3.32, the City maintains a service fee cost comparison system for the purpose of recovering some or all of the costs reasonably borne of providing services of a limited nature through fees for those services, so that general taxes are not diverted from general services of a broad nature and utilized instead to subsidize such services of limited benefit.
Annually, the City conducts a Fee Study of these service fees. The Fee Study consists of staff reviewing and updating each service fee, identifying new fees, and removing fees that are no longer needed. It is important to annually conduct the Fee Study to ensure that those parties that personally benefit from City services pay the full cost of the service. Paying less than the full cost effectively transfers the cost of service to the City’s General Fund.
California Government Code Section 66016 requires that fees charged by a local agency may not exceed the estimated cost of providing the service or regulatory act for which the fee is being charged. Indirect costs may be included. The fundamental purpose of the City's service fees is to reduce subsidies from the City's General Fund for the cost of services that do not benefit the whole community.
In order to meet the legal requirements for service fees, the fee amounts are developed by a detailed analysis to determine the cost to provide each service based on the time spent by all City staff involved in providing the service. Staff determines the “Fully Burdened Hourly Rate” of every City position. This rate includes salary, benefits and direct and indirect overhead expenses based on the City’s Fiscal Year 2023/24 Operating Budget. Staff from the Item Number 4A.
154
appropriate department provide the time spent by each staff member to complete their part of a fee task. The fee analysis for each service fee as well as the fully burdened hourly rates is included as Attachment 3.
The Ordinance establishes the services that the City provides for a fee. Staff recommends updating the Ordinance in order to update the list of fees. The updated Ordinance, included as Attachment 1, lists twenty-two (22) new fees and removes twenty-two (22) existing fees.
Eleven (11) of the fees to be removed are being combined into 4 new fees, mostly driven by the consolidation of all paper document reproduction fees. The changes will lead to a fee schedule that more closely matches the delivery of services.
The amount charged for services are established by a Resolution that will be presented for the City Council’s consideration on October 10, 2023. A draft of the Resolution (Attachment 2) is being provided at this time to allow sufficient time for review and feedback.
Fiscal Impact:
Although the exact number of each fee service provided is unknown, the Fee Study is a mechanism to ensure the continued recovery of costs for specific programs and services.

(1) - Fully Burdened Hourly Rate includes median salary for the position, department average benefits, direct and indirect department overhead.
Example: Police Officer
1) Midpoint of Salary range is $106,820.
2) Cost of benefits is added as a % of salary $ (60% for Police) $106,820 * 1.60 = $170,912/year
3) This is divided by available work hours (1703) for base hourly rate $170,912/1703 = $100.36
4) Two types of overhead are added to this number
- Department overhead are non-compensation expenses as a % of compensation expense (19.9% for Police Department)
- Indirect overhead is a share of support department expense (12.0% for all departments)
$100.36 * 1.199 * 1.12 = $134.78 Fully Burdened Hourly Rate 26 of 26 193

Introduce, Waive Full Reading, and Read by Title Only, an Ordinance of the City Council of the City of Rocklin To Amend Section 17.75.070 D. Temporary Signs of the Rocklin Municipal Code to Establish a Compliance Deposit and Sign Removal Process (Temporary Signs/ZOA2023-0004).
C
.
Adopt a Resolution of the City Council of the City of Rocklin Adopting a Fee for the Abatement of Temporary Noncommercial Signs.
Background:
On August 13, 2019, the City Council considered possible revisions to the standards applicable to temporary noncommercial signs. Following the discussion, the City Council directed staff to move forward with an ordinance to modify the Rocklin Municipal Code (RMC) to establish size limitations, as well as update and clarify the temporary noncommercial sign regulations to make them clearer and easier to understand.
Based upon the City Council’s direction, staff drafted modifications to the standards for temporary noncommercial signs, RMC Sections 17.75.070 (C), Table 1, Row labeled “Noncommercial temporary signs” and 17.75.070 (D) to:
Establish the maximum size of a temporary noncommercial sign as 16 square feet.
Revise the time such signs may be displayed to beginning 45 days prior to an event and ending 5 days after and event.
Clarify where temporary noncommercial signs may be located on a property.
Update language and formatting to clarify intent and make the regulations more user friendly.
The changes were adopted at the October 12, 2021 City Council meeting.
Since the adoption of the revised regulations in 2021, these types of signs have posed a challenge for staff when they are not placed in compliance with the RMC and have required abatement. Therefore, an update to the ordinance (Attachment 1) is recommended to institute Item Number 4B.
194
a sign deposit of $500 that must be submitted to the City Clerk prior to the placement of any temporary noncommercial signs in the City and establish procedures for removal of non- compliant signs. No changes to the previously adopted standards applicable to this type of sign are proposed.
Staff presented the proposed changes at the September 5, 2023 Regular Meeting of the Planning Commission. The Planning Commission voted 4-0 with one Commissioner absent to recommend the changes to the City Council.
Attachment 2 is a Resolution of the City Council establishing the fee that would be charged for the abatement of signs. City staff performed a cost study and found that the abatement of a sign placed in violation of the existing code costs approximately $47.00. This is the fully burdened cost of a Code Enforcement Officer to abate a sign and complete the necessary notification process. Understanding that most temporary noncommercial signs are placed by individuals or groups that are not-for-profit, staff recommends setting the the proposed fee per violation at $25, which is $22 lower than the fully burdened cost. This fee would be charged against the deposit submitted prior to someone placing a temporary noncommercial sign per RMC 17.75.070 (D).
Fiscal Impact:
There is no direct fiscal impact in adopting the proposed Ordinance. The collection of sign abatement fees could result in a slight revenue for the City, but this would be offset by staff time to abate signs.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROCKLIN
ADOPTING A FEE FOR THE ABATEMENT OF TEMPORARY
NONCOMMERCIAL SIGNS
WHEREAS, through enactment of Rocklin Municipal Code Chapter 3.32, the city maintains a service fee cost comparison system for the purpose of recovering some or all of the costs reasonably borne of providing services of a voluntary and limited nature through fees for those services, so that general taxes are not diverted from general services of a broad nature and utilized instead to subsidize such services of limited benefit; and

WHEREAS, such signs do not require a Sign Permit per Rocklin Municipal Code section 17.75.020; and
WHEREAS, the placement of temporary noncommercial signs during an event can result in the necessary abatement of such signs that are not removed in a timely manner or are placed on public property; and
WHEREAS, staff have conducted an analysis of cost to abate those signs that are not in compliance with the municipal code and such a rate amounts to less than the fully burdened cos t to abate the sign;
NOW, THEREFORE, the City Council of the City of Rocklin does resolve as follows:
Section 1. The recitals set forth above are true and correct.
Section 2. The City Council establishes the following fees as set forth in Exhibit A to this resolution in order to recover the cost to abate signs that are placed in violation with the Rocklin Municipal Code and/or signs that damage public property.

Staff Report
Subject:
Section 115 Trust for Pension
Date:
September 26, 2023
Submitted By:
Daniel Choe, Deputy Director of Administrative Services Department:
Administrative Services - Finance
Recommendation:
Adopt a Resolution of the City Council of the City of Rocklin Approving the Adoption of the Public Agencies Post-Employment Benefits Trust Administered by Public Agency Retirement Services (PARS).
Background:
During the fiscal years 2021/22 and 2022/23, a portion of year-end savings was set aside to fund a Section 115 Pension Trust, in order to bolster the City's financial health by addressing its future pension obligations and unfunded accrual liabilities. Instead of allocating all resources to the California Public Employees’ Retirement System (CalPERS), the City chose to establish a Section 115 Trust. This strategic move is intended to alleviate budgetary pressures stemming from unforeseen spikes in employer contribution rates during emergencies or challenging budget years, providing enhanced flexibility and local control.
Subsequently, the plan to establish a Section 115 Trust for pension prefunding was presented to the Investment Advisory Committee on February 23, 2023. The Committee voted 3-0 to recommend the City Council move forward with the plan.
On April 20, 2023, the Administrative Services Department released a Request for Proposals (RFP) for the Establishment, Administration, and Management Services of a Section 115 Trust for Pensions. The department received three proposals; however, only two of these proposals, one from the CalPERS and the other from Public Agency Retirement Services (PARS), were considered responsive and responsible bids.
The evaluation committee, comprised of staff from the City Manager’s Office, Administrative Services Department, and a member from the City’s Investment Advisory Committee, evaluated the proposals. Their evaluation considered various factors, including contractors’ qualifications in relation to the project, their demonstrated ability to provide the required services in a timely manner, professional references, fee structures, and the overall quality of their responses to the questionnaire outlined in the RFP.
Item Number 5A.
203
Following a comprehensive evaluation process, the proposal submitted by PARS received the highest ranking and was deemed the most knowledgeable provider. PARS has an impressive track record with over 40 years of experience working with public agencies, including 21 years in administering Section 115 Trust Administration services, and a portfolio of over 500 participating agencies nationwide. Several additional factors contributed to PARS being selected:
Pioneering Role
: PARS is recognized as a pioneer and leading provider of Section 115 Trusts. They are also the developer of both the Pension Rate Stabilization Program and Other Post-Employment Benefits (OPEB).
IRS Private Letter Ruling
: PARS successfully obtained an IRS Private Letter Ruling, ensuring the tax-exempt status of any investment income and capital gains derived from trust assets.
Pension Prefunding Expertise
: PARS is the single largest provider of pension-prefunding services, trusted by over 280 California agencies for pension prefunding.
Reimbursement Flexibility
: PARS offers the unique advantage of allowing two years of reimbursements back to the City. This feature proves invaluable in case of unforeseen emergencies or challenging budget years.
Diverse Investment Strategies
: PARS stands out by providing a range of investment
strategies tailored to the City’s unique demographics. They offer four distinct investment strategies, granting the City flexibility in managing its assets.
PARS possesses extensive experience in managing pension trusts and offers a higher level of service, including comprehensive assistance in developing an investment policy related to pension prefunding, providing funding recommendations, and ensuring greater flexibility in investment options. These services are guided by a professional fund management team selected and closely monitored by the City. Furthermore, contributions to and distributions from the trust are determined at the discretion of the City, providing a high degree of control and customization.
The City’s all-in-fees for trust administration, investment advisory/management, and trustee is approximately 0.304% of assets. The City currently has $1,339,300 set aside for a Section 115 Pension Trust. Staff recommends utilizing the $1.3 million as an initial contribution to fund the Section 115 Pension Trust.
Attachment 1 is the Resolution for the City Council to adopt a Section 115 Pension Trust administered by PARS, as well as appointing the City Manager, or designee, as Plan Administrator. Attachment 2 is the Contract with PARS. Upon adoption of the Resolution, the Contract will be processed along with the corresponding agreements from Vanguard and US Bank to fully implement the Section 115 Trust.
Fiscal Impact:
With approval of staff recommendation, the City would use approximately $1.3 million from the fund balance of the General Fund, which was set aside for this purpose, to provide an initial contribution towards funding the Section 115 Pension Trust.

City Council
Staff Report
Subject:
Safe and Sane Fireworks – Use for Special Occasion and Increased Community Accountability
Date:
September 26, 2023
Submitted By:
Aly Zimmermann, City Manager
Department:
City Manager's Office
Recommendation:
Introduce, Waive the Full Reading and Read by Title Only an Ordinance of the City Council of Rocklin Amending Chapter 8.24 of the Rocklin Municipal Code, Fireworks, to Modify the Prohibitions against the use of Fireworks to Allow for Exceptions for Special Occasions and to add Host Liability for Fireworks Ordinance Violations.
Background:
Staff are proposing an amendment to the Rocklin Municipal Code Chapter 8.24, section 110 Discharging fireworks, to allow for the discharge of safe and sane fireworks for special occasions. To implement, staff intends to utilize the existing Residential Street Closure (block party) permit. Those interested in discharging fireworks would need to submit an application with the City of Rocklin providing information about the dates and times of the event. The application would then be reviewed by the City Manager with advice of the Fire Chief and the use of safe and sane fireworks would be approved or denied as appropriate.
In order to create more accountability for the unauthorized discharge of fireworks within the City, staff are also proposing adding section 160, Host Liability, to Chapter 8.24. Any person who hosts an event in which unlawful fireworks are discharged would be strictly liable for the use of fireworks in violation of Chapter 8.24. Those liable shall be subject to administrative citations and fines. The unlawful discharge of fireworks creates a nuisance and has the potential to impact the safety of the public. The intent of the citation and fine is to discourage the unlawful use of fireworks and to ensure that those who wish to discharge safe and sane fireworks undergo the appropriate permit approval process.
Environmental Analysis:
The proposed action is not a project under Section 15061(b)(3) of the California Environmental Quality Act Guidelines, and as such is exempt from environmental review.
Fiscal Impact:
There is no direct fiscal impact to the staff recommendation.
Item Number 5B.
