Tameka Usher, Administrative Services

Administrative Services - Human Resources
Recommendation:
A
.
Adopt a Resolution of the City Council of the City of Rocklin Approving Amendment No. 3 to the Professional Services Agreement with Liebert Cassidy Whitmore and Authorizing the City Manager to Execute Amendment No. 3.
B
.
Adopt a Resolution of the City Council of the City of Rocklin to Approve a Side Letter of Agreement to the Memorandum of Understanding Between the City of Rocklin and the Rocklin Police Officers’ Association.
C
.
Adopt a Resolution of the City Council of the City of Rocklin to Adopt a Revised Management Salary Schedule.
Background:
Liebert Cassidy Whitmore Contract Amendment
On January 1, 2023, the City entered into a contract with Liebert Cassidy Whitmore (LCW) for special counsel legal services to support public safety and employment, related law issues as they arise, legal opinions, and policy review. Subsequently, due to vacancies in the City Attorney’s Office, Amendment No. 1 was executed June 1, 2023 under the City Manager’s authority for additional employment law and public safety legal support. Amendment No. 1 increased the contract ceiling to $100,000.
As the City Council conducted its recruitment for a City Attorney, Amendment No. 2, which increased the contract ceiling to $200,000, was approved by the City Council on November 14, 2023. The new City Attorney assumed office on February 5, 2024; however, the Assistant City Attorney position remains vacant. Due to the continued vacancy in the City Attorney’s Office, staff recommends the City Council authorize Amendment No. 3 to amend the term of the Professional Services Agreement through December 30, 2024 and to increase the “not-to- exceed” amount to three hundred thousand dollars ($300,000). Given the significant, ongoing demands placed on the City Attorney's Office and Administrative Services, this amendment will provide the City with additional options for competent and professional legal services to respond to employment law and public safety legal services, as needed.
Item Number 2B.
13 Rocklin Police Officers' Association Side Letter
On February 13, 2024, the City Council approved a Side Letter Agreement between the City and Rocklin Police Officers’ Association (RPOA), which modified two provisions of the Memorandum of Understanding, including sign-up limitations and maximum sign-up terms in subsections 33.3.1 and 33.3.6 of Article 33 concerning schedules for Union employees.
However, the Side Letter did not modify subsection 33.1, which states that the effective date of such schedules is “to be effective on January 1 the following year.” Given such, RPOA expressed a desire to implement the sign-up sections for the current calendar year. Therefore, the City and the RPOA seek to revise the Side Letter (adopted on February 13, 2024) to state that it is retroactively effective January 1, 2024.
Management Salary Schedule Adjustment- Assistant City Attorney Title 2 of the California Code of Regulations, section 570.5 requires the City's salary schedules to be approved and adopted by the City Council at a public meeting.
The Assistant City Attorney position is vacant and the City Attorney would like to move forward with recruitment efforts to fill the vacancy. The Assistant City Attorney classification has been vacant since January 2023. During that time, the City conducted one recruitment that did not result in filling the position. Subsequently, a compensation study was conducted utilizing the City’s pre-determined labor market agencies to assess the market competitiveness of the current salary range of the Assistant City Attorney. The market results demonstrate that the salary range is significantly below the median of the City’s pre-determined labor market agencies. Given these circumstances, a salary range increase is appropriate in order to make progress toward aligning the Assistant City Attorney salary with the market and increase the likelihood of attracting qualified, experienced candidates. Therefore, in connection moving forward with a new Assistant City Attorney recruitment, staff recommends adjusting the salary range from salary range 26 ($125,048- $170,427) to 31 ($141,480- $192,823) of the Management Salary Schedule.
Fiscal Impact:
The LCW Contract Amendment No. 3 will result in an increase to the contract of $100,000; the RPOA Side Letter has no direct fiscal impact; and, the Management Salary Schedule change will result in a net increase cost of $28,600.
Sufficient funds are available in the City Attorney's Office budget to support the increases from the staff recommendations.

Subject:
Amendment to the Fiscal Year 2023/24 Budget and the 2024-2028 Capital Improvement Program
Date:
April
9, 2024
Submitted By:
David Mohlenbrok, Director of Community Development
Hunter Young, City Engineer/Deputy Director of Community Development Department:
Community Development
Recommendation:
Adopt a Resolution of the City Council of the City of Rocklin Amending the FY 2023/24 Budget and the 2024–2028 Capital Improvement Program.
Background:
On June 27, 2023, the City Council adopted the fiscal year (FY) 2023/24 budget and the 2024–2028 Capital Improvement Program (CIP). Additionally in June 2023, the City brought back in-house the City Engineer position that was vacated upon the retirement of the prior contracted City Engineer. Since summer 2023, engineering staff have diligently worked to deliver CIP projects that were previously in the design phase.
With a desire to plan for future needs beyond the construction projects noted previously, staff reviewed the Circulation Element of the General Plan and considered what major roadway projects the City may need to initiate now, and has identified the following projects:
Rocklin Road Widening - CIP Project No. 50129 (Sierra College Boulevard to Interstate 80) .
This early phase will study the right of way needs for future work, and in particular impacts to property owned by Sierra College. No environmental document or final design is planned at this time.
Sunset Boulevard Widening - CIP Project No. 50094 (Highway 65 to East of University Avenue)
. Currently this section of Sunset Boulevard is predominantly 4-lanes with the ultimate 6-lane configuration abutting each end. With entitled commercial and residential development projects just to the north of Sunset Boulevard on University Avenue required to widen the north half of Sunset Boulevard to its ultimate configuration as a condition of approval, staff desires to begin design, environmental work, and right of way support to widen the south half of Sunset Boulevard to its ultimate alignment as adjacent properties exist with no planned development that could be conditioned to widen the south half of the roadway.
Item Number 2C.
25 Whitney Ranch Parkway Widening - CIP Project No. 50081 (Highway 65 to University Avenue)
. Currently this section of Whitney Ranch Parkway is mostly 2 and 4-lanes with a proposed ultimate 6-lane configuration. Placer County Department of Public Works currently has construction drawings to construct this section of Whitney Ranch Parkway and install a traffic signal at the University Avenue/Whitney Ranch Parkway intersection as part of its Placer Parkway project.
Due to several commercial and residential projects in Rocklin anticipated to come on line in the next 24 months resulting in significant traffic, and understanding that these projects will likely be open for business or occupied by residents before Placer County is able to widen the roadway and install a new traffic signal at Whitney Ranch Parkway/University Avenue, staff proposes taking the lead of roadway widening on Whitney Ranch Parkway and traffic signal installation, but only within Rocklin city limits thus avoiding the extensive coordination for work performed in Caltrans right of way.
This approach permits the commercial projects, most notably the Whitney Ranch Retail center with Nugget Markets as the anchor tenant, to open for business without significantly impacting traffic in this area. In addition to work on Whitney Ranch Parkway, the City will design and construct a second northbound left turn lane from University Avenue to westbound Whitney Ranch Parkway.
Staff has coordinated with Placer County, and County staff support the City delivering that portion of the work within Rocklin city limits. The Placer Parkway project is funded by the South Placer Regional Transportation Authority (SPRTA). As such, the City will work with SPRTA staff to develop a funding agreement to pay for those improvements the County would have otherwise constructed. For City work unrelated to the County’s Placer Parkway project, the City proposes to use impact fees to pay for design and construction.
To aid in the delivery of the above three projects, staff recommends utilizing the recently awarded on-call design contracts. However, at the time the FY 2024–2028 CIP was developed, the three proposed projects identified above were not contemplated, and as such, no City Council-approved budget exist. Staff proposes amending the CIP to incorporate the following projects and associated budgets as follows:
Rocklin Road Widening - Project No. 50129 (Sierra College Boulevard to Interstate 80) :
$200,000 in Traffic Impact Fees (Fund 302).
Sunset Boulevard Widening - Project No. 50094 (Highway 65 to East of University Avenue) :
$200,000 in Traffic Impact Fees (Fund 302).
Whitney Ranch Parkway Widening - Project No. 50081 (Highway 65 to University Avenue) :
200,000 in Whitney Ranch Interchange Impact Fees (Fund 325).
This funding will allow staff to begin work on these projects. Additional funding for future fiscal years will be included in the proposed FY 2025 – 2029 CIP to be brought before the City Council at a future meeting.
Additionally, staff recommends one additional CIP amendment for clarification. The City Council approved the Park Drive Pavement Rehabilitation construction contract on December 12, 2023; however, the fiscal impact identified Gas Tax funds from another project without 26 specifying which project. Staff recommends the City Council reallocate $275,000 in the SB 325 Sales Tax Funds (210) from the Sierra College Boulevard Roadway Rehabilitation (Project No. 50091) to the Park Drive Pavement Rehabilitation (Project No. 50005). Sufficient funds are available in Project No. 50091 to support the staff recommendation.
Environmental Analysis:
Each individual project identified in this staff report has, or will have, a separate environmental document associated with it. No environmental analysis is necessary at this time.
Fiscal Impact:
The fiscal impacts for each new project are as follows:
1 .
Rocklin Road Widening - Project No. 50129 (Sierra College Boulevard to Interstate 80) – $200,000 in Traffic Impact Fees (Fund 302).
2 .
Sunset Boulevard Widening - Project No. 50094 (Highway 65 to East of University Avenue) – $200,000 in Traffic Impact Fees (Fund 302).
3 .
Whitney Ranch Parkway Widening - Project No. 50081 (Highway 65 to University Avenue) – $200,000 in Whitney Ranch Interchange Impact Fees (Fund 325)
Sufficient funds are available in Funds 302 and 325 to support the staff recommendations.

Vacant Property Weed Abatement
Date:
April
9, 2024
Submitted By:
Justin Nartker, Director of Public Services
Richard Lawrence, Public Services Manager
Department:
Public Services
Recommendation:
Adopt a Resolution of the City Council of the City of Rocklin Declaring Conditions at Locations within the City of Rocklin to be a Public Nuisance, Ordering Weed Abatement of Same, and Setting the Date and Time for a Protest Hearing.
Background:
Rocklin Municipal Code (RMC) Chapter 8.12 requires that the property owners of vacant parcels within the City clear their properties of weeds and debris thereby eliminating potential fire hazards. This requires continual maintenance, during the fire season, as weeds are seasonal and continue to grow making them a recurrent nuisance pursuant to Government Code Section 39562.1.
As part of the weed abatement and rubbish program, the City will send notification (Attachment 3) to approximately 170 property owners reminding them of their responsibility to maintain their parcels on an annual basis as well as provide them with the City Council- adopted Vegetation Maintenance Standards, the date for the protest hearing, and other pertinent timeframes involved. Failure to comply will result in the City performing the weed abatement and charging parcel owners for the services rendered. If payment is not made to the City, a lien will be placed against the property.
Declaring the private parcels a public nuisances will allow the City to take action in the event the owners do not complete the required weed abatement by June 1, 2024, and/or fail to address the re-growth issue during fire season.
To complete the weed and rubbish abatement process, the City is required to hold a notice to protest hearing to hear objections from any landowners whose property has been declared a nuisance. As required by statute, notices will be sent to the owners of the properties declared a nuisance, via certified letters mailed April 10, 2024, and the Protest Hearing will be set for the April 23, 2024 City Council Meeting. After hearing any objections, the City Council shall allow or overrule any objections. At that time, the City Council acquires jurisdiction to proceed Item Number 2F.
41 and perform the work of removal, and by approving the attached resolution makes the order to proceed with abatement.
Fiscal Impact:
There is no direct fiscal impact. The Weed Abatement project is included each year in the Operating Budget.

DECLARING CONDITIONS AT LOCATIONS WITHIN THE CITY OF ROCKLIN
TO BE A PUBLIC NUISANCE, ORDERING WEED ABATEMENT OF SAME,
AND SETTING THE DATE AND TIME FOR A PROTEST HEARING
WHEREAS, there is an accumulation of combustibles, weeds, and other rank growth on the vacant parcels identified in Exhibit “A” which pose a hazard to the public health and safety, those conditions constitute a public nuisance, and substantially increase the fire hazard; and
WHEREAS, the City’s Standards for Maintenance of Vacant Parcels and Rocklin Municipal Code Chapter 8.12 require property owners of vacant parcels within the City to clear their properties of weeds and debris thereby eliminating potential fire hazards; and
WHEREAS, declaring the properties identified in Exhibit “A” public nuisances will allow the City to take action in the event the owners do not complete the required weed abatement by June 1, 2024, and/or fail to address the re-growth issue during the burn season
.
NOW THEREFORE, the City Council of the City of Rocklin does resolve as follows:
Section 1. Upon sufficient information presented to the City Council by City staff the Council finds and declares that conditions at the locations listed on Exhibit “A”, attached hereto and incorporated herein by this reference, constitute a public nuisance and are detrimental to the public health, safety, and welfare.
The City Council also finds and declares that weeds on the locations listed on Exhibit “A” are seasonal and recurrent nuisances.
Section 2. The City Council orders that the nuisance be abated in accordance with the City’s Vegetation Maintenance Standards and the Rocklin Municipal Code Chapter 8.12 before June 1st, 2024, or the property owners show cause to the City Council at a hearing on April 23, 2024, at 6:00 p.m. or as soon thereafter as the matter may be heard, at the City Council Chambers. If such abatement is not accomplished in the time set forth above, or if satisfactory cause is not shown as to why it should not be abated, the City may cause the abatement to be accomplished and the cost thereof be placed as a special assessment against the property.
Section 3. The City Clerk is hereby directed to mail notice to the owners of the property in accordance with provisions of Section 39567.1 of the Government Code.

ABOUT THE CITY OF ROCKLIN’S WEED ABATEMENT PROGRAM
Dear Parcel Owner,
Records on file with the Placer County Assessor's Office indicate that you are the owner of vacant property located in the City of Rocklin. This certified letter is to inform you that on April 9th, 2024, the Rocklin City Council declared all vacant parcels in the City of Rocklin a public nuisance and ordered the nuisance to be abated by June 1 st, 2024. The City’s “Annual Weed Abatement Program for Maintaining Vacant Parcels” requires the reduction of any fire hazard and/or public nuisance in the City. As part of this program, each property owner is required to take appropriate action to maintain their property throughout the year in accordance with the enclosed Vegetation Maintenance Standards.
THE CITY DOES NOT OFFER THE OPTION TO HAVE A CONTRACTOR MAINTAIN PRIVATE VACANT PARCELS FOR YOU. IT IS THE PROPERTY OWNER’S RESPONSIBILITY TO COMPLY WITH THE VEGETATION MAINTENANCE STANDARDS.
To ensure fire hazards and/or a public nuisance does not exist on vacant parcels, the City’s inspector will be inspecting parcels between May 15th and June 1st. If the City’s inspector during that 2-week period deems parcels non-compliant or partially compliant with the Vegetation Maintenance Standards, the City has the right to abate the public nuisance beginning June 1st.
All costs incurred from performing this work, including direct costs and expenses, any applicable fines, and administrative charges and postage, will be charged to the property owner. In the event that parcels are found to be non-compliant more than once in the same calendar year, no further abatement proceedings are required and the City may proceed directly to abate the public nuisance and collect all associated costs. If such costs are not paid as required, those unpaid costs will constitute a lien and will be recorded against the property until paid. (See Gov.
Code §§39560-39588; RMC Chapter 8.12 Weeds and Rubbish.) If you have completed the required abatement and your property currently meets the enclosed Standards, please be advised any re-growth throughout the season must also be abated and maintained at a maximum of 4” inches in height.
The enclosed NOTICE TO DESTROY WEEDS AND REMOVE
RUBBISH sets forth your opportunity to object to the City Council’s declaration that your property is a public nuisance at a meeting of the Rocklin City Council on April 23, 2024, at 6:00 p.m.
Pursuant to Government Code section 39570, the decision of the City Council regarding any protest is final.
If you have questions or need any additional information, please contact us at (916) 625-5500.
Sincerely,

57 VEGETATION MAINTENANCE STANDARD
Scope:
This guideline provides the requirements for open space land and all parcels within the City of Rocklin to reduce the impact of wildland fire. For the purpose of this guideline, certain terms are defined as follows:
Definitions:
Defensible Space. Defensible space is the buffer you create on your property between a structure and/or property line and the grass, trees, shrubs, or any wildland area that surround it. This space is needed to slow or stop the spread of wildfire and it helps protect your home from catching fire—either from embers, direct flame contact or radiant heat.
Wildland Urban Interface. The WUI is the zone of transition between unoccupied land and human development. It is the line, area or zone where structures and other human development meet or intermingle with undeveloped wildland or vegetative fuels.
References:
Rocklin Municipal Code Chapter 8.10 - Fire Safe Vegetation and Debris Management
Rocklin Municipal Code Chapter 8.12 - Weeds and Rubbish Operational Standards for ALL Parcels:
Zone 1 (Within 30 feet of the property line or structures):
Cut, mow, graze annual grass down to a maximum height of 4 inches. Create horizontal space between shrubs and trees. (See diagram) Create vertical space between grass, shrubs and trees. (See diagram) Remove branches that hang over property line.
Trim trees regularly to keep branches a minimum of 10 feet from other trees. Create a separation between trees, shrubs.
Zone 2 (Extends from 30 feet to 100 feet from structures):
Cut, mow, graze annual grass down to a maximum height of 4 inches. Create horizontal space between shrubs and trees. (See diagram) Create vertical space between grass, shrubs and trees. (See diagram) 58 Operational Standards for VACANT Parcels:
The required maintenance for vacant properties is based on the size of the parcels as listed below.
A. Five (5) acres or smaller shall be totally disced or mowed B. Larger than five (5) acres and smaller than twenty-five (25) acres require fire breaks consistent with Zone 1, or one hundred (100) feet off closest structure, whichever is greater. The remainder of the parcel will require the appropriate number of thirty (30) foot fire breaks to segment (checkerboard) the land into four (4) acre +/ - sections.
C. Larger than twenty-five (25) acres require fire breaks of thirty (30) feet off property line or one hundred (100) feet off closest structure, whichever is greater. The remainder of the parcel will require the appropriate number of thirty (30) foot firebreaks to segment (checkerboard) the land into five (5) acre + /- sections.
EXCEPTION: An approved fire access road plan may be substituted in lieu of five (5) acre segments.
Parcels under agricultural or pasture land use require fire breaks of (30) feet adjacent to all developed areas, fences, or structures. The remainder of the property must be mowed or disced at time of harvest or have sufficient animals present to maintain height of combustible growth of six (6) inches. Fire breaks may be constructed by discing, mowing, or the use of a blade. The maximum height of combustible growth within a firebreak is four (4) inches. If a blade is used, the side boundaries of the break shall be leveled. Windrows are not permitted.
Parcels may be maintained to allow reasonable access for firefighting operations. Rubbish and/or debris must be removed prior to any work on the property.
Discing - Discing shall include rototilling or cultivating. Discs shall be set at an angle sufficient to cut and bury the growth existing at the time.
Mowing - If this is used, the mowing shall be done each time the combustible growth exceeds four (4) inches.

Staff Report
Subject:
Local Vendor Goods and Supplies
Date:
April
9, 2024
Submitted By:
Justin Nartker, Director of Public Services
Richard Lawrence, Public Services Manager
Department:
Public Services
Recommendation:
Adopt a Resolution of the City Council of the City of Rocklin Approving and Authorizing the City Manager to Issue Purchase Orders for the Procurement of Goods and Supplies from Normac.
Background:
Throughout the year, City departments have ongoing needs to purchase materials and supplies to perform required maintenance, repairs, and rehabilitation services for critical public infrastructure. Staff conducted its annual review of purchases made in Fiscal Year (FY) 2022/23, and the first half of FY 2023/24, and anticipates procuring goods and supplies from the locally situated vendor, Normac (irrigation and landscaping supplies). These purchases are necessary to ensure the continued delivery of programs and services citywide, and adequate purchasing authority is needed in accordance with the Rocklin Municipal Code (RMC).
Chapter 3.04 of the RMC requires City Council approval for the purchase of goods and supplies for an amount more than $50,000. The majority of the purchases for goods and supplies are made on an as-needed basis and on average, purchases would cost $1,300 per job; however, the cumulative need is anticipated to exceed $50,000 per vendor. Therefore, staff recommends approval and spending authority to cover the estimated expenditures for the locally situated vendor, Normac, for an amount not to exceed $250,000.
Per RMC Chapter 3.04.090 (B), staff has conducted a good faith review of available sources and determined that there is only one source for the required goods and supplies. During this review staff performed a cost comparison with multiple vendors (local retail and on-line) and found that Normac was the most competitively priced, was the only vendor that had products in stock or same day availability, and was the only vendor that had the selection of commercial grade products required.
Staff recommends that the City Council determine that Normac meets the RMC requirements Item Number 2G.
62 and that purchases for goods and supplies are authorized.
Supplies purchased directly from Normac, are on an as-needed basis. If approved, staff will continue to follow the purchasing requirements of the RMC related to formal and informal bidding procedures, prior to making any purchases.
Fiscal Impact:
There is no additional fiscal impact to the staff recommendation, as the cost of goods and supplies are included in the individual department’s budget and will be charged accordingly at the time of use.

THE PROCUREMENT OF GOODS AND SUPPLIES FROM NORMAC
WHEREAS, Rocklin Municipal Code section 3.04.090 (B) indicates that purchasing goods, services, or construction items from a sole or limited source after conducting a good faith review of available sources may be authorized by the City Council for purchases over $50,000; and WHEREAS, staff performed a cost comparison with multiple vendors (local retail and on- line) and found that Normac is the most competitively priced, the only vendor that had products in stock or same day availability, and is the only vendor that had the selection of commercial grade products required; and
WHEREAS, staff estimates that a total expenditure of $250,000 would be necessary for the purchase of goods and supplies in Fiscal Year (FY) 2023/24 and FY 2024/25; and WHEREAS, there is no fiscal impact as the cost of goods and supplies are included in the individual department’s FY 2023/24 budget and proposed FY 2024/25 budget and will be charged accordingly at the time of use.
NOW THEREFORE, the City Council of the City of Rocklin does resolve as follows:

Approval of the Draft South Placer County District Transportation Expenditure Plan
Date:
April
9, 2024
Submitted By:
David Mohlenbrok, Director of Community Development
Hunter Young, City Engineer/Deputy Director of Community Development Department:
Community Development
Recommendation:
Adopt a Resolution of the City Council of the City of Rocklin Approving the Draft South Placer County District Transportation Expenditure Plan for the Proposed Transportation Improvement Plan and Retail Transactions and Use Tax Ordinance and Approving a Notice of Exemption.
Background:
Placer County Transportation Planning Agency (PCTPA) will be presenting an overview of the proposed Transportation Improvement Plan and Retail Transportation and Use Tax Ordinance, and how the program will work. The only action before the City Council at this time is to accept staff’s recommendation to approve the Draft South Placer County District Transportation Expenditure Plan (Expenditure Plan) as presented herein.
Who is PCTPA?
PCTPA is the State of California-recognized Regional Transportation Planning Agency responsible for planning and delivery of funding, programs, and capital improvement projects that reduce congestion in Placer County with the exception of the Lake Tahoe basin. PCTPA is led by nine board members comprised of local City Council members and Placer County Supervisors and one member of the public, who collectively provide balanced representation for all citizens of Placer County.
Placer County Congestion
The population of southern Placer County has grown drastically in the past 25 years, resulting in localized and regional congestion. To preserve the quality of life for residents and businesses, it is necessary to fund local and regional infrastructure needs.
PCTPA has identified the three contiguous cities of Roseville, Rocklin, and Lincoln as the “South Placer County District” and anticipates placing a one-half of one percent (0.5%) sales tax measure for critical transportation infrastructure projects on the November 2024 ballot. If a sales tax measure is ultimately placed on the ballot and approved by voters, the proposed Item Number 5A.
65 Expenditure Plan, attached herein, would focus on funding capital improvements within Roseville, Rocklin, and Lincoln, most notably supporting the I-80/Rocklin Road Interchange with the westbound auxiliary lane, the Highway 65/I-80 interchange, and Highway 65 improvements between Galleria Boulevard and Twelve Bridges Drive. All of these major roadway improvements would directly benefit Rocklin residents, business owners, and commuters.
A sales tax, such as the one being contemplated, requires that the tax be tied to a specific expenditure plan that identifies a list of projects on which the funding must be spent. The Expenditure Plan would:
Impose a one-half of one percent (0.5%) retail transactions and use tax to be collected for a period of thirty (30) years for transportation improvements to meet the County’s transportation needs, including major highway and road projects, local road maintenance and transportation improvement projects, rail and transit projects (including services for the elderly and disabled), bicycle and pedestrian projects, and other unanticipated but needed improvements.
Provide for the formation of an Independent Citizen Oversight Committee which will review the independent annual fiscal audit of the expenditures of the Transportation Tax funds and will issue an annual report on its findings regarding compliance with the Expenditure Plan and the requirements of the Ordinance.
Require that funds collected be spent on various types of improvements subject to the following program types and corresponding percentages:
Major Highway and Road Program – 52%
Rail and Transit Program – 12%
Local Transportation Program – 25%
Bicycle and Pedestrian Program – 5%
Competitive Projects Program – 5%
Program Administration – 1%
No decision has been made yet to proceed with a transportation sales tax ballot measure in Placer County, however, PCTPA has been and will continue to meet with key City, Town, and County leaders, elected officials, stakeholders, and community groups to understand the current needs and funding gaps.
Before PCTPA, acting as the Local Transportation Authority, can consider adopting the proposed Ordinance, the draft Expenditure Plan must be approved by the Board of Supervisors and the City and Town Councils representing both a majority of the cities and town in the County, and a majority of the population residing in the incorporated areas of the County. As such, staff recommends the City Council adopt a resolution approving the Draft South Placer County District Transportation Expenditure Plan.
If the Expenditure Plan is approved by the Board of Supervisors and the City and Town Councils representing both a majority of the cities and towns in the County, and a majority of the population residing in the incorporated areas of the County, PCTPA, acting as the Local Transportation Authority, will consider adopting the Ordinance at its May 2024 meeting.
Following adoption of the Ordinance, the Board of Supervisors would be asked to place the Ordinance on the November 2024 ballot.
66 Environmental Analysis:
The Expenditure Plan is not a project within the meaning of the California Environmental Quality Act (CEQA) and is therefore exempt from CEQA review. Prior to the commencement of any project included in the Expenditure Plan, any necessary environmental review required by CEQA shall be completed.
Fiscal Impact:
There is no direct fiscal impact associated with approving or denying the proposed South Placer County District Transportation Expenditure Plan.

APPROVING THE DRAFT SOUTH PLACER COUNTY DISTRICT
TRANSPORTATION EXPENDITURE PLAN FOR THE PROPOSED
TRANSPORTATION IMPROVEMENT PLAN AND RETAIL TRANSACTIONS
AND USE TAX ORDINANCE AND APPROVING A NOTICE OF EXEMPTION WHEREAS, in 2006, the Placer County Board of Supervisors designated the Placer County Transportation Planning Agency (PCTPA) as the Local Transportation Authority, in anticipation of placing a potential sales tax measure on the ballot in 2008, which was subsequently put on hold; and WHEREAS, in 2016 a countywide sales tax measure was put on the ballot and failed to garner the required super-majority (66.67%) vote total; and WHEREAS, in 2018, State Assembly Bill 1413 was passed by the legislature and signed by the Governor allowing PCTPA, acting as the Local Transportation Authority, to create a District within Placer County for the purpose of implementing a sales tax measure; and
WHEREAS, since 2020, PCTPA has considered the potential of putting a sales tax measure on a future ballot for a “South Placer County District” inside of Placer County, which District consists of the three contiguous cities of Roseville, Rocklin, and Lincoln; and
WHEREAS, as competition for State and Federal highway funds increases as available funding decreases, it has become necessary to seek alternative methods to fund critical infrastructure projects and/or to be utilized as matching funds to be more successful when pursuing State and Federal grant funding; and WHEREAS, the proposed South Placer County District Expenditure Plan (Expenditure Plan, attached as Exhibit A) was formulated with a broad spectrum of countywide input collected over several years; and
WHEREAS, PCTPA anticipates placing a sales tax measure of one-half of one percent (0.5%) on the November 2024 ballot; and
WHEREAS, before PCTPA, acting as the Local Transportation Authority, can consider adopting the proposed Transportation Improvement Plan and Retail Transactions and Use Tax Ordinance (Ordinance), the proposed Expenditure Plan must be approved by the Board of Supervisors and the City and Town Councils representing both a majority of the cities and town in the County, and a majority of the population residing in the incorporated areas of the County; and 68 WHEREAS, if the Expenditure Plan is approved by the Board of Supervisors and the City and Town Councils representing both a majority of the cities and towns in the County, and a majority of the population residing in the incorporated areas of the County, PCTPA, acting as the Local Transportation Authority, will consider adopting the Ordinance at its May 2024 meeting; and WHEREAS, following adoption of the Ordinance, PCTPA will request the Board of Supervisors place the Ordinance approving the sales tax on the November 2024 ballot; and
WHEREAS, the Expenditure Plan, as a funding mechanism that does not commit any public agency to funding or approving any specific project or activity listed herein, is not a project within the meaning of the California Environmental Quality Act (CEQA) and is therefore exempt from CEQA review.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rocklin as follows:
Section 1. The Expenditure Plan, attached hereto as Exhibit A and incorporated herein by this reference, is hereby approved.
Section 2. Based on the review and determination of the Environmental Coordinator, and for the reasons stated in the Notice of Exemption, attached hereto and incorporated by reference herein as Exhibit B, the City Council finds that the Expenditure Plan is exempt from review under CEQA, and therefore approves the Notice of Exemption.
Section 3. Upon approval of the Project by the City Council, staff is hereby directed to file a Notice of Exemption, pursuant to CEQA.

EXHIBIT A
EXPENDITURE PLAN
EXHIBIT A TO ORDINANCE NO. 24-01
South Placer County District
Transportation Expenditure Plan
This South Placer County District Expenditure Plan (the “Expenditure Plan” or “Plan”), was prepared by the Placer County Local Transportation Authority (the “Authority”) for the purpose of establishing a one-half of one percent (0.5%) retail transactions and use tax for transportation purposes (the “Transportation Tax”) within the incorporated terri- tory of the cities of Lincoln, Rocklin and Roseville (collectively referred to as the “Dis- trict”), to be collected for thirty (30) years, if approved by the voters on November 5, 2024. This is proposed by the Authority as a means to fill the shortfall in funding needed to: implement necessary highway, local road, interchange, rail, and transit projects; se- cure new transportation corridors through environmental clearance and right of way pur- chases; provide adequate maintenance and improvements on the local street and road system; promote economic growth throughout the County; and meet the needs of com- muters and the specialized needs of the growing senior and disabled population. The Authority has evaluated all alternative funding sources and the funds generated from the Transportation Tax are for the sole purpose of funding the construction, reconstruction, rehabilitation, or replacement of public infrastructure for transportation purposes, or the acquisition or lease of real property for public infrastructure for transportation purposes consistent with Transportation Improvement Plan and Retail Transactions and Use Tax Ordinance (“Ordinance”).
Chapter 1: Goals and Objectives
1.1 Maintain and Improve the Quality of Life in Placer County by Supple- menting Existing Funds for Transportation
Reduce current congestion and provide adequate transportation facilities to accommo- date reasonable growth in the future.
70 2
Provide funding for the adequate maintenance and improvement of local streets and roads, and transit infrastructure within, or for the benefit of, the City of Lincoln, City of Rocklin, and City of Roseville.
Enhance Placer County’s ability to secure state and federal funding for transportation by offering local matching funds.
1.2 Provide for Accountability in the Expenditure of Taxpayer Funds Provide for mandatory dedication of Transportation Tax funds only for the transportation infrastructure improvements and programs identified in this Plan and no other purpose.
Provide for mandatory, annual financial and performance audits of program expenditures to ensure that all funds are spent in accordance with this voter adopted Plan and Ordi- nance.
Provide for an independent Citizen Oversight Committee to review the mandatory annual financial audits of program expenditures and to produce an annual report of findings to the Authority Board and the public.
Provide for a Maintenance of Effort requirement in funds made available to city govern- ments for local street and road programs to ensure the new money for this purpose is adding to current funding levels.
Provide for the strict limitation of Authority costs in implementing this Plan, by limiting, in law, funds expended for salaries and benefits of Authority staff to implement the Plan to no more than one percent (1%) of the annual amount of revenues raised by the Transportation Tax and prohibiting all expenditures for general employee salaries or other operating expenses of the Authority.
Provide for this Plan to be reviewed at least every ten (10) years for the period it is in effect to ensure that the changing needs and priorities of the jurisdictions are met, as provided in Section XII of the Ordinance.
Provide for the mandatory termination of the Transportation Tax in thirty (30) years from the operative date, requiring additional voter approval at a general election for any ex- tension.
1.3 Provide for Equity in the Distribution of Transportation Tax Revenues Address the unique needs of each of the areas of the District. Provide a reasonable bal- ance between competing highway, rail, transit, bicycle/pedestrian, and local streets and road needs.
1.4 Provide for Local Control of the Transportation Improvement Plan 71 3
Provide cost effective, local administration of the Plan through the existing Placer County Transportation Planning Agency which is designated as the Placer County Local Trans- portation Authority. No new agency will be created to administer these funds.
Delegate appropriate administrative responsibility to the cities and other local agencies designated by a city or the Authority for local programs.
Chapter 2: Taxpayer Accountability Safeguards
2.1 Legal Dedication of Funds
Funds generated by the Transportation Tax, net of the amount of fees paid to the Cali- fornia Department of Tax and Fee Administration (CDTFA), may only be used for trans- portation purposes as described in the Ordinance governing this Plan, including the ac- quisition, construction, environmental mitigation, and maintenance of streets, roads, highways, including state highways and public transit systems and equipment, and for related transportation purposes. These purposes include but are not limited to expendi- tures for planning, environmental reviews, engineering and design costs, related right- of-way acquisition, and construction, engineering, project management, and administra- tion.
2.2 Mandatory Annual Fiscal and Performance Audit
No less than annually, the Authority shall conduct an independent fiscal audit of the ex- penditure of all funds generated by the Transportation Tax and an independent perfor- mance audit to ensure the expenditure of funds is consistent with the Plan and Ordinance.
The audits, which shall be made available to the public, shall report on evidence that the expenditure of funds is in accordance with this Plan as adopted by the voters in approving the Ordinance on November 5, 2024. In addition, the audits shall determine compliance with the Maintenance of Effort requirements and requirements described in Section 3.3 of this Plan entitled "Local Transportation Program."
2.3 Independent Citizen Oversight Committee
A four (4) member Independent Citizen Oversight Committee shall be formed to review the annual independent fiscal and performance audits of the expenditures of the Trans- portation Tax funds and issue to the Authority Board of Directors an annual report on its findings regarding compliance with the requirements of the Expenditure Plan and the Ordinance. The annual report shall also be made available to the public by posting it in a manner that is easily accessible to the public. Membership in the Independent Citizen Oversight Committee shall be composed of one registered voter appointed by the gov- erning body of each District city council and one appointed by the Placer County Board of Supervisors. The appointee of the County shall reside in the District. Persons currently employed by the Placer County Transportation Planning Agency, County of Placer or any 72 4
District incorporated city therein, or currently serving as a city councilmember or member of the Board of Supervisors, are not eligible for membership on the Citizen Oversight Committee.
2.4 Mandatory Plan Update and Termination of Transportation Tax This Plan shall be reviewed by the Authority at least every ten (10) years that the Trans- portation Tax is in effect to reflect current and changing transportation priorities and needs in the District, as defined by the duly elected local government representatives on the Authority Board. Any changes to this Plan must be adopted in accordance with Sec- tion XII of the Ordinance and with current law in effect at the time of the update and must be based on findings of necessity for change by the Authority. The Transportation Tax authorized to be collected by the voters shall expire in thirty (30) years, unless the voters approve an extension of the Transportation Tax prior to the expiration date, as may be required under state law in effect at the time of the vote for extension.
Chapter 3: Specific Transportation Programs to Be Funded The Transportation Tax shall be allocated by the Authority for projects within or benefiting the District cities consistent with the following provisions and are limited to the purpose of funding the construction, reconstruction, rehabilitation, or replacement of public infra- structure for transportation purposes, or the acquisition or lease of real property for public infrastructure for transportation purposes.
3.1 Major Highway and Road Programs – 52%
Many more state highway improvement projects are needed to deal with congestion and safety problems in the District than existing state and federal revenues can fund. Approx- imately $3,318 million in major highway/road improvements over the thirty (30) years have been identified in this Plan. Projected state and federal funds are estimated to be $431 million and will fund about 13% of the improvement costs needed and identified in this Plan. Funds generated by the Transportation Tax will supplement those funding sources with an estimated $825 million (25% of the improvement costs) and, along with an estimated $2,062 million in developer impact fees (62% of the improvement costs), will cover the remaining costs estimated to accomplish these improvements. The actual amount of funds available for expenditure on state highway improvement projects from the identified sources and the amount expended for such purposes may vary from these estimates.
52% of the Transportation Tax is allocated to Major Highway/Road Projects. The Major Highway/Road projects to be implemented with the Transportation Tax revenues are as follows:
73 5
ROUTE LIMITS PROJECT
SR 65 Galleria Blvd. to Twelve Bridges. Widen to 3-5 lanes each direction
I-80/SR 65 Interchange Improvements Improve interchange safety and capacity
I-80 I-80/Rocklin Road Interchange
and Auxiliary Lane
Improve interchange
safety and capacity
Baseline Road Foothills Blvd to SR 70/99 Widen to 4-6 lanes and grade separation at
railroad crossing
SR 65 SR 65/Nelson Lane Interchange
SR 65/Nicholas Road Interchange
Improve to grade sep-
arated interchange
Placer Parkway SR 65 to SR 70/99 Construct 4 lane ex-
pressway
The final scope and project limits of all improvements proposed for the State Highway system will be determined through the environmental clearance process.
The Authority may add additional Major Highway/Road projects, should the Transporta- tion Tax produce more revenue than now predicted or the Authority be more successful than anticipated in attracting state/federal matching funds, developer impact fees, or obtaining other grants and funds for transportation infrastructure purposes, or due to unforeseen circumstances.
3.2 Rail and Transit Program – 12%
This Plan will provide an estimated $187 million of Transportation Taxes to expand rail, add bus rapid transit, and implement programs to meet the transit needs of seniors, disabled persons and commuters.
3.2.a. Transportation Services for Seniors, Disabled Persons and Local Residents
Seniors and disabled persons are becoming an increasing percentage of the population each year and will drive demand for more frequent transit service to more areas. In addition, a number of transportation programs have been implemented which meet specialized needs for transportation to medical services, social service agencies and programs, shopping and other purposes that cannot be met by conventional transit. Local residents are also in need of improvements in local transit service. An estimated 74 6
$75 million in Transportation Tax funds will be used for transit infrastruc- ture.
3.2.b. Capitol Corridor Rail and Bus Rapid Transit Service The existing Capitol Corridor rail service has provided a viable alternative to the automobile for daily commuters to downtown Sacramento and re- duces traffic on I-80. The current service level needs to be augmented by expanding capacity between Sacramento and Roseville to bring ten (10) round trips per day to Placer County. In addition, establishment of frequent and timely bus rapid transit service that provides a reasonable alternative to the automobile for existing and future daily commuters who travel to and within the South Placer area is needed. An estimated $50 million of Transportation Tax funds will be made available for capital of these rail and bus rapid transit infrastructure improvements and to match available federal funds.
3.2.c. Commuter/Express Bus Service
Commuter bus services provide a safe, convenient, and comfortable al- ternative to driving and removes congestion from highways. There is strong demand to expand this highly popular effective service to connect more residential areas and major employment centers. An estimated $62 million of Transportation Tax funds will be made available for capital of commuter and express bus infrastructure, and to match available federal and state funds.
The actual amount of funds available for expenditure on transit and other projects described in this Section from the identified sources and the amount expended for such purposes may vary from these estimates.
3.3 Local Transportation Program – 25%
The local transportation systems, particularly local streets and roads are critical to the everyday movement of people within the District.
Much of the road system is aging, has potholes, and is in need of expanded maintenance and rehabilitation. Current resources, without the establishment of Transportation Tax revenues for transportation, cannot provide adequate funding to maintain the local street and road system at the level necessary to adequately serve the public.
The priorities for local transportation vary among individual local jurisdictions. While overlay, reconstruction, repair, and maintenance of the local road system are needs com- mon to all and are specifically allowable as an expenditure of these funds, there are additional needs as well. Transportation Tax funds can be used for transportation pro- jects, as designated by this Plan. Some examples of allowable projects include widening existing local roads, traffic signalization, traffic safety improvements, sidewalks, bike 75 7
paths, transit centers, local matching funds for transportation grants or earmarks, charg- ing stations for electric vehicles, compressed natural gas or other alternative fuels, light- ing, landscaping, park and ride lots, and Safe Routes to School programs.
This Plan will provide an estimated $394 million of Transportation Taxes specifically for these purposes. The funds will be distributed to the cities within the District for connecting roadways, trails and transit systems within or benefiting the District cities by a formula based on an equal weighting of each jurisdiction’s proportionate share of the total County population. Allocations will be updated annually based on California Department of Fi- nance population data.
The actual amount of funds available for expenditure on local transportation projects from the identified sources and the amount expended for such purposes may vary from these estimates.
In order to be eligible for these funds, each jurisdiction shall satisfy and continue to satisfy the following requirements:
1. By July 1 of each year, file with the Authority a Five-Year Capital Improvement program including all capital transportation projects, including those projects funded by the jurisdiction’s share of the Transportation Tax.
2. Adopt and administer a development impact fee program that requires new development to pay a fair share of necessary transportation improvements at- tributable to the new development.
3. By December 31 of each year, file with the Authority an annual Expenditure Report for the prior fiscal year identifying the amount of Transportation Taxes, developer impact fees and other local agency funds expended by the jurisdic- tion, and certify that the maintenance of effort requirements of the Ordinance and the Expenditure Plan have been satisfied.
3.4 Bicycle and Pedestrian Program – 5%
Bicycle, pedestrian, and neighborhood electric vehicle (NEV) travel provide a viable alter- native for short distance trips and enhance the quality of life in our neighborhoods. Safe, easy to use facilities in key areas support the attractiveness of these clean and healthy transportation modes. An estimated $75 million in net Transportation Tax funds will be used to match local, state, and federal funds to construct and improve bicycle, pedestrian, and neighborhood electric vehicle facilities and otherwise to support walkable and bike- able communities including Safe Routes to School.
The Authority shall establish the criteria by which projects are deemed eligible for fund- ing under this Program, and the selection criteria by which such eligible projects are selected. The initial criteria shall be established by the Authority within one year of the 76 8
adoption of the Ordinance. The eligibility and selection criteria may include safety, con- nectivity to schools and to the overall system estimated demand/usage, ability to attract matching funds, and lack of other funding in the overall Transportation Expenditure Plan.
3.5 Competitive Projects Program – 5%
It is recognized that the Plan cannot anticipate every factor that could affect transporta- tion needs over its thirty (30) year life. New technologies, new travel patterns, and new transportation modes are amongst the many possibilities that may arise in the future. To provide the flexibility to meet those unanticipated needs and opportunities, the Transpor- tation Plan is anticipated to provide approximately $79 million to a Competitive Projects Program. The Authority shall establish the criteria by which projects are deemed eligible for funding under this Program, and the selection criteria by which such eligible projects are selected. The initial criteria shall be established by the Authority within one year of the adoption of the Ordinance. The eligibility and selection criteria may include safety, congestion relief, ability to attract matching funds, and lack of other funding in this overall Transportation Expenditure Plan. Any Competitive Projects Program funds unspent at the conclusion of the thirty (30) year Plan would be added to the Local Transportation Program.
Chapter 4: Bond Financing
Construction of the highway and rail projects and implementation of the local streets and roads and other programs identified in this Plan are needed as soon as possible. In order to accomplish this, some level of borrowing will be required, with debt to be repaid with Transportation Tax revenues. The Authority will determine the extent of borrowing that is reasonable and that can be supported by Transportation Tax revenues as the Plan is implemented.

Rail and Transit Program 12%
Local Transportation Program 25%
Bicycle and Pedestrian Program 5%
Competitive Projects Program 5%
Transparency, Accountability, and Administration 1%
TOTAL 100%
The Authority may reallocate the expenditure of Transportation Taxes in any given year on a different percentage basis provided that the percentage allocations set forth above are achieved over the duration of the Ordinance.
Chapter 6: Funding Flexibility and Bonding to Expedite
Projects
To deliver transportation projects more quickly for the benefit of Placer County residents, visitors, and businesses, the Authority may temporarily shift Transportation Tax revenues and developer impact fees administered by the South Placer Regional Transportation Au- thority (“SPRTA”) amongst projects in any given year. However, the proportionate shares for funding contributions and purposes over the 30-year period may not be changed without an amendment of this Plan as required by law and Section XII of the Ordinance.
Transportation Tax revenues subject to this temporary shift specifically exclude those annually allocated to the cities under the Local Transportation Program (Section 3.3 of this Plan).
Chapter 7: Informing the Public of Local Funding Support All projects using $1 million or more of Transportation Tax revenues shall be signed to inform the public that Transportation Tax revenues support the project.
Chapter 8: Severance Provisions
If any provision of this Plan, or the application thereof, is for any reason held invalid and unenforceable by a court of competent jurisdiction to a person or circumstance, the re- mainder of the Plan and the application of such provision to other persons or circum- stances shall not be affected thereby, and the Authority declares that it would have passed each part of this Plan irrespective of the validity of any other part. 78 EXHIBIT B
