D. Based upon Section 15183(f) of the CEQA Guidelines, the Midas Apartments project’s CEQA Guidelines Section 15183 Consistency Checklist identifies the 2012 General Plan Update policies and/or actions that apply to the development of the project and have been determined in the General Plan EIR to substantially mitigate environmental effects. To the extent that the 2012 General Plan Update policies and/or actions substantially mitigate a particular project impact, the impact shall not be considered peculiar, pursuant to Section 15183(f) of the CEQA Guidelines, thus, eliminating the requirement for further environmental review.

E. Pursuant to CEQA Guidelines Section 15183, the City of Rocklin finds that although the proposed project could have a significant effect on the environment, because all potentially significant effects (a) have been analyzed adequately in an earlier EIR pursuant to applicable standards, and (b) have been avoided or mitigated pursuant to that earlier EIR, including revisions or mitigation measures that are imposed upon the proposed project, nothing further is required beyond compliance with the mitigation measures established in the City of Rocklin General Plan EIR, compliance with the City of Rocklin’s uniformly applied development policies or standards, and compliance with the conditions of approval established for the project.

Section 2. Based on the review and determination of the Environmental Coordinator, and for the reasons stated above and in the Notice of Exemption, attached hereto and incorporated by references herein as Exhibit 1, the City Council of the City of Rocklin finds the project is exempt from review under the California Environmental Quality Act.

Section 3. The City Council of the City of Rocklin hereby approves the Notice of Exemption for the Project.

Section 4. Upon approval of the project by the City Council, the Environmental Coordinator may file the Notice of Exemption with the County Clerk of Placer County and with the State Office of Planning and Research, pursuant to the provisions of Section 21152(b) of the Public Resources Code and the State EIR Guidelines adopted pursuant thereto.

Midas Apartment Parking Enforcement Plan
Midas Apartment property manager shall follow these procedures to carry out the Parking Enforcement Plan for the Midas Apartments. The Parking Enforcement Plan will be enforced by onsite property management staƯ and after-hours security patrol.

Parking Spaces. Permitted parking in designated spaces only. Only one vehicle may be parked in each space. No curb parking will be permitted. Vehicles may not be parked or temporarily parked in areas designated as fire zones or marked as No Parking areas.

Vehicles may not be parked for more than seven days in any unassigned parking space unless approved by management.

Tandem Spaces. Tandem parking spaces will be marked and assigned to specific units upon resident request on a first come first serve basis at the discretion of the property manager. If residents have a reserved tandem parking space, residents must use both assigned tandem space and may not use any other open or non-reserved parking spaces.

Tandem spaces may not be used for any purpose other than parking a vehicle. Use of the space for additional storage, boats, RV’s, trailers, or other oversized vehicles is strictly prohibited.

Vehicle Standards. Only currently registered vehicles may be parked on the property.

Vehicles which lack an engine, transmission, wheels, tires, doors, windshield, or any other major part or equipment necessary to operate safely on the highways are not permitted on the property.

The parking of boats, trailers, inoperable vehicles and commercial vehicles is prohibited.

Towing. Vehicles parked in violation of 1) the property’s Parking Enforcement Plan, 2) local laws or ordinances, 3) belongs to a resident or occupant who has surrendered or abandoned the dwelling, 4) is parked in a marked handicap space without the legally required handicap insignia, 5) bis parked in a space marked for manager, staƯ, or guest at the oƯice, 6) blocks another vehicle from exiting, 7) parked in a fire lane or designated “no parking” area, 8) parked on the grass, sidewalk, or patios, or 9) blocks garbage trucks from access to a dumpster are considered Immediate Tow OƯenses and subject to immediate towing without notice at the vehicle owner’s expense.

Enforcement. In the event that any vehicle is found to be in violation of any provision of these guidelines, such vehicle will be cited and immediately towed, without any further warning. No exceptions or grace period will apply to “Immediate Tow OƯenses.” In the event that any vehicle is found to be in violation of any provision of these guidelines other than those provisions specifically identified as an “Immediate Tow OƯense,” such vehicle will be subject to the following enforcement measures:

A written citation will be issued to the oƯending vehicle disclosing the nature of the violation, and that such vehicle is subject to towing at the vehicle owners’ expense immediately upon discovery in subsequent violation of the same provision within the same calendar month.

No less than 72 hours shall prior to the vehicle being subsequently observed for compliance with the originally violated provision.

In the event that the vehicle is again found to be in violation of the same provision of the guidelines within the same calendar month, a second citation will be issued to the vehicle at which time the vehicle will be immediately towed at the vehicle owner’s expense without additional warming.

Decal Guidelines and Procedure. The issuance of a parking decal is vehicle specific and requires the submission and execution of a valid Midas Apartment lease.

Parking decals are transferable only among names listed on the lease and shall become void if applied to a vehicle other than the specific vehicle for which it was approved.

The validity of a parking decal which has been issued depends on the proper display of such parking decal on the vehicle, which becomes the responsibility of the vehicle owner.

The proper display of a parking decal is defined as the unobstructed view of such parking decal as applied to the lower driver’s side corner of the interior of the windshield, with the number and logo of such parking decal facing the exterior of the vehicle. Parking decals shall not be applied to a removable device, such as a clear plastic placard, etc.

Parking decals are renewed annually at the time of lease renewal. In the event of a transfer of ownership of a vehicle which has been issued a parking decal, such parking decal shall become void. The total number of parking decals issued shall not exceed the approved number of residents, guests, and employee parking.

Third Party Lease. No parking space can be subleased, sublet, or charged for a fee to third parties.
