Item: 13.A.

Meeting Date: 8/25/2025
To: City Council
From: Christian Horvath, Assistant to the City Manager / City Clerk Thru: Karina Bañales, City Manager
Subject: Consideration of authorizing the Mayor to sign a joint Palos Verdes Peninsula Cities letter to Governor Newsom regarding the expansion of Executive Order N-32-25 and suspension of SB9 applications within Very High Fire Hazard Severity Zones Background:

The City of Rolling Hills and Palos Verdes Peninsula (PVP) region (City of Rancho Palos Verdes, Palos Verdes Estates, and Rolling Hills Estates) collaborates on wildfire preparedness and prevention measures as a historically considered wildfire-prone community.

The PVP region has varying Fire Hazard Severity Zones as designated by the California Department of Forestry and Fire Protection (CAL FIRE) that classify areas into “Moderate,” “High,” or “Very High” fire hazard severity zones based on statewide criteria.

In January 2025, the Greater Los Angeles Area was devastated by multiple fires, including the Palisades and Eaton fires, and was considered among the most destructive disasters in California history. A State of Emergency was proclaimed for Los Angeles and Ventura Counties, including numerous Executive Orders to provide relief to impacted communities and to suspend or partially suspend housing laws.

In July 2025, the California State Governor issued Executive Order N-32-25 (Attachment B), which suspends Government Code Sections 65852.21 and 66411.7, including Senate Bill (SB) 9 (Atkins) provisions related to housing development for areas located within Very High Fire Hazard Severity Zones (VHFHSZ).

Aimed at addressing California’s housing crisis, SB 9 was signed into law in 2021, allowing increased residential development in single-family zones by requiring housing development applications to be reviewed and approved ministerially, including urban lot splitting. Many cities throughout California, including the City of Rolling Hills, and advocacy groups such as the League of California Cities, have opposed SB 9, citing local control issues such as the overriding of established zoning ordinances and housing elements.

Communities like the PVP face critical issues of being in fire severity zones and having limited

Page 161 of 228 ends

ingress and egress routes that can also be narrow and congested due to topographical challenges.

The Cities are committed to public safety and, as such, have developed a joint letter (Attachment A) to request the expansion of Executive Order N-32-25, thereby suspending SB 9 applications in the PVP region for areas located in the VHFHSZ.

The City of Rancho Palos Verdes Mayor signed the letter on August 15. Rolling Hills Estates is scheduled to receive the same report and request on August 26, followed by Palos Verdes Estates on September 9.

Discussion:

None.

Fiscal Impact:

None.

Recommendation:

Approve as presented and authorize the Mayor to sign.

Governor Gavin Newsom
1021 O Street, Suite 9000
Sacramento, CA 95814
RE: Executive Order N-32-25 Suspending SB 9 applications within “Very High Fire Hazard Severity Zones” affected by the Palisades and Eaton Fires Dear Governor Newsom,
On behalf of the residents of the Palos Verdes Peninsula, the City Councils of Rancho Palos Verdes, Palos Verdes Estates, Rolling Hills Estates, and Rolling Hills respectfully request your urgent action to expand Executive Order N-32-25 to all high fire prone areas in the State of California including the Palos Verdes Peninsula (Peninsula).

The devasting fires in Pacific Palisades/Malibu and Altadena in January 2025 highlight the significant dangers to human life and property in fire-prone regions. These incidents underscore the critical need to prioritize public safety over urban densification in these vulnerable zones. Your Executive Order N-32-25 does just that, and we applaud you for recognizing the high risk that densification in certain areas has on human life and property.

The housing crisis that the state is facing is real, and we do not deny the fact that measures are needed to provide more housing, especially affordable housing. However, there are factors that need to be considered, such as high fire risk areas, when applying higher density requirements found in legislation similar to SB 9. Communities such as the Palos Verdes Peninsula – a majority of which are in high fire hazard severity zones - should not be subject to higher density when considering the following:

1. Narrow Streets and Limited Access: Many areas on the Peninsula and other Very High Fire Hazard Severity Zone (VHFHSZ) locations are served by narrow, winding streets that are already inadequate for current traffic volumes. These streets cannot accommodate increased density without creating severe risks during wildfire evacuations. In addition, insufficient parking and narrow streets in the Palisades not only affected the timely deployment of firefighting resources but also delayed protection for structures.

2. Congested Evacuation Routes: With limited exit points from the Peninsula, increased population density would create potentially fatal bottlenecks during mandatory evacuations. Palos Verdes Drive is the only exit route for much of the

We ask you to recall the Palisades Fire that resulted in residents in traffic jams, forced to abandon their cars and flee the fire on foot. Firefighters had to use bulldozers to clear those cars from the roadways in order to access critical routes.

3. Inadequate Emergency Infrastructure: Current infrastructure, including insufficient parking and limited access for emergency vehicles, further exacerbates the risk to residents and first responders in fire emergencies. As seen in the Pacific Palisades fire, delays caused by parked vehicles blocking emergency access could be the difference between saving lives and catastrophic loss.

4. Increased Wildfire Vulnerability: Higher-density housing developments in fireprone areas increase ignition sources and complicate fire suppression efforts, putting more lives and structures at risk.

Our communities were developed years ago in topographical areas that have limited ingress and egress under today’s development standards. In 2020, the Legislature passed SB 182, which would have required that new housing developments in very high fire zones include various elements to better withstand wildfires. SB 182 would have mandated design elements such as evacuation routes, vegetation management, and firesafe construction. It also would have required the regional housing needs allocation plan to further the objective of reducing development pressure within very high fire risk areas.

Unfortunately, you vetoed that legislation.

Despite this, each of the Peninsula Cities has worked closely with the State and the Department of Housing and Community Development (HCD) to comply with housing and safety element requirements. This commitment has been maintained despite escalating concerns from residents over public safety, particularly as it relates to the compounding risks of wildfires, evacuation logistics, and inadequate infrastructure in VHFHSZ.

As such, we ask you to act now on behalf of the over 100,000 residents of the Peninsula and other communities in VHFHSZ throughout the State of California by expanding Executive Order N-23-25, thereby suspending SB 9 applications in our communities so we can focus on emergency preparedness that will help avoid the next disaster.

From: Christian Horvath, Assistant to the City Manager / City Clerk Thru: Karina Bañales, City Manager
Subject: Consideration of creating a limited Ad Hoc Committee to discuss potential Red Flag Warning Municipal Code changes related to parking and potential prohibition on highrisk outdoor activities; and appointment of two Council members Background:

At the August 11, 2025 City Council meeting, staff presented a report related to National Weather Service Red Flag Warning Days and potential changes the Municipal Code would require specific to parking (as recommended by the Traffic Commission) and prohibition of high-risk outdoor work activities.

After public comment and discussion, the City Council made two motions which passed unanimously:

1. To appoint an Ad Hoc committee to work out issues related to prohibited activities and parking concerns

2. To request the Traffic Commission look further into current parking ordinances and roadway definitions and bring back recommendations to the City Council Unlike standing committees, a temporary advisory committee (or ad hoc committee) composed solely of less than a quorum of the City Council that serves a limited or single purpose, that is not perpetual, and that will be dissolved once its specific task is completed is not subject to the noticing and meeting requirements of the Brown Act. Government Code § 54952 (b); see also Freedom Newspapers, Inc. v. Orange County Employees Retirement System Board of Directors (1993) 6 Cal.4th 821, 832. Once the ad hoc committee sufficiently investigates and comes to a final recommendation, it would dissolve.

While nothing prohibits the ad hoc committee from noticing and having meetings that are open to the public, it would not be mandated by the Brown Act. This would allow members to more readily react to issues and more fully investigate possible solutions outside the confines of a formal Brown Act meeting.

Tonight, staff request the City Council discuss the formation of an Ad Hoc Committee and appoint two

Meeting Date: 8/25/2025
To: City Council
From: Samantha Crew, Management Analyst
Thru: Karina Bañales, City Manager
Subject: Receive and file a Public Safety and Emergency Preparedness Update Background:

The City of Rolling Hills is committed to maintaining a safe and well-prepared community through proactive public safety initiatives. This commitment is advanced through collaboration with emergency service providers, regional agencies, and utility partners to ensure a coordinated approach to safety and disaster readiness. Providing regular updates to the City Council and residents strengthens awareness of local hazards, highlights ongoing preparedness measures, and encourages community participation. Consistent reporting also supports informed policy decisions and reinforces the City’s responsibility to promote preparedness and safeguard the well-being of residents.

Discussion:

This Public Safety and Emergency Preparedness Report outlines current activities and upcoming priorities that advance the City’s readiness, response, and recovery efforts. The report reflects the City’s ongoing work with law enforcement, fire services, and regional partners throughout the Palos Verdes Peninsula to build capacity and improve coordination in times of emergency. It also provides a framework for evaluating current progress, setting future goals, and directing initiatives that further strengthen community safety and resilience.

Emergency Siren System
Following the August 11 City Council meeting, staff met with HQE to evaluate options for strengthening the City’s emergency evacuation siren system. Discussions included the potential installation of a siren pole in the Flying Triangle and the addition of a fourth pole to improve coverage in the Southfield neighborhood. HQE’s engineers are actively exploring the feasibility of a siren in the Flying Triangle to determine whether the location can provide the needed coverage and stability.

HQE, which is currently installing the SAFE Network in Paradise, California, anticipates deploying the system in Rolling Hills in late fall, with full operation expected by the end of the year. Once the system is active, residents will have the opportunity to purchase individual SAFE Units for their homes at an estimated cost of $100 per unit, with orders placed through a dedicated website managed by HQE.

The company expressed confidence that the SAFE Network’s indoor-based system will provide reliable indoor coverage across Rolling Hills, regardless of terrain, and noted that additional gateways can be installed on utility poles if needed. HQE is gathering information to provide pricing options for

Page 170 of 228 ends

camouflaging the poles to help minimize visual impacts while maintaining system effectiveness.

Peninsula Multi-Jurisdictional Hazard Mitigation Plan (MJHMP) As part of the ongoing update to the Peninsula Multi-Jurisdictional Hazard Mitigation Plan (MJHMP), staff, in coordination with the Planning Department, have completed the first draft of the Rolling Hills Annex. This draft reflects the City’s unique community profile, identifies local hazard vulnerabilities, and outlines mitigation strategies tailored to Rolling Hills. The annex has been submitted to the consultant, Black & Veatch, for initial review, and feedback is expected in the coming weeks. In addition, staff continue to actively participate in bi-weekly MJHMP coordination meetings with Black & Veatch and representatives from neighboring Peninsula jurisdictions. These meetings provide an opportunity to ensure consistency across all city annexes, share best practices, and maintain alignment on regional mitigation goals.

Backup Power Project
The City’s Backup Power Project continues to move forward with steady progress. On August 15, Willdan completed and approved the plan check for the generator installation, marking an important milestone in the project timeline. Staff received the final stamped design documents on August 20 and subsequently held a pre-preparation meeting with the design engineer. Bid preparation is now underway, with the release of the bid expected soon. Anticipated timelines indicate that bids should be received in early October, after which the project will advance toward construction and installation.

Once complete, the generator will provide the City with a reliable backup power source to ensure continuity of operations during outages and emergencies.

Metropolitan Water District of Southern California (MWD) HeloPod Dip Tank
The MWD has been approved as a viable location for the installation of a HeloPod dip tank, which will provide an important water source for firefighting helicopters. Following an evaluation of the MWD reservoir, the site was accepted, and preparations are now underway to accommodate the new equipment. Chief Kane and his team are coordinating efforts to ready the area by clearing trees to allow helicopter access and ensuring the necessary connections to the City’s water pipelines. The HeloPod is expected to be delivered and installed within the next few weeks, after which MWD will collaborate with the Los Angeles County Fire Department to conduct testing and confirm system readiness. Once operational, this installation will further strengthen regional firefighting capabilities and enhance wildfire response for the surrounding communities.

Cal Water
At the direction of Councilmember Leah Mirsch, staff is responding to questions asked by resident Fred Visco (Attachment A). Although not all questions are answered in this report, staff will continue to work with CalWater on responses that they can provide.

Wildfire Hardening Reliability Project
City staff and Cal Water continue to collaborate on a future presentation regarding the Apoolosa Project. At this stage, Cal Water reports that its work is focused on coordination with the Association and residents for easement access.

Water Main Leak – Quail Ridge Lane Question #1
On August 26, 2024, Cal Water received a report of a leak near 5 Quail Ridge Lane at approximately 7:28 p.m. The leak was determined to be caused by tree root intrusion around the water main. To complete the repair, the tree was removed, the water main was repaired, and service was restored the same day.

Page 171 of 228 ends

Determining Cal Water Infrastructure Leaks Question #2 and #3 Cal Water’s water distribution network is a closed-loop system, meaning the potable/domestic water supply is the same water source that supplies fire hydrants. The system remains pressurized at all times, ensuring that leaks would be visible to Cal Water personnel and to the public. In addition to visual detection, Cal Water has implemented several measures to identify potential leaks that are not immediately apparent.

Beyond its Supervisory Control and Data Acquisition (SCADA) system, which remotely monitors the water system and provides alerts for issues such as sudden pressure or supply drops, Cal Water has also deployed data loggers to detect immediate ruptures—referred to as water main breaks—and acoustic sensors to identify slow, non-surfacing leaks.

A fact sheet has been prepared that outlines these measures in greater detail, explaining how they enhance Cal Water’s ability to identify and respond to leaks or breaks more quickly (Attachment B).

One simple method presented for evaluating potential leaks in the system involves comparing the volume of water supplied to the tank located north of Spur Road against the cumulative usage of the individual parcels it serves.

Old Existing Infrastructure on Cinchring Question #4
Through Cal Water's ongoing main replacement program, its engineering and operations teams examine the entire water distribution system and determine which pipeline projects to prioritize for replacement based on leaks, age, criticality, and other factors. The Palos Verdes distribution system includes all of Rolling Hills, Rolling Hills Estates, Palos Verdes Estates, Rancho Palos Verdes, and a portion of Lomita. Due to the significant land movement, Cal Water prioritized main replacements in the areas experiencing ongoing land movement, bringing many underground pipes above-ground.

There are no current plans to replace additional infrastructure in areas not seeing land movement and where its infrastructure is not being impacted. Cal Water will, however, continue to monitor the area and evaluate whether any other sections of the water main eventually need to be replaced due to the land movement.

Once these projects are approved and installed, they increase system reliability, enhance water quality, and provide additional firefighting capabilities. It is important to note that no urban water system is designed to fight prolonged and widespread fires such as wildfires; however, Cal Water has taken a number of steps operationally to better prepare for and respond to such fires.

Tsunami Response
Recently, staff participated in a debrief with Area G public safety partners to review the recent tsunami response. While the incident itself did not escalate into a significant emergency, it served as an important opportunity to practice coordinated response procedures across multiple agencies and jurisdictions. The exercise highlighted the value of maintaining strong regional partnerships and provided practical insights into operational strengths as well as areas needing refinement. As is common in emergency situations, some communication gaps were observed, particularly related to the timeliness and consistency of community notifications across the Peninsula. These findings will inform future planning efforts, with a focus on improving notification protocols and enhancing the overall effectiveness of the region’s emergency communication systems.

Conclusion on Kenneth Fire False Alert and Distinction from Alert SouthBay The Kenneth Fire false alert incident demonstrated how technical errors in third-party alerting software can result in widespread public confusion and loss of trust in emergency communications.

As outlined in the Sounding the Alarm report (Attachment A), what was intended as a targeted evacuation warning for residents near Calabasas and Agoura Hills was mistakenly distributed countywide, reaching nearly 10 million people. The alert was cancelled within minutes, but duplicate

Page 172 of 228 ends

and delayed messages continued to circulate, underscoring systemic vulnerabilities within the broader County-managed alerting process.

The Congressional investigation into the incident found that a failure in software safeguards allowed the Wireless Emergency Alert (WEA) to be issued without the correct geographic boundaries, defaulting instead to all of Los Angeles County. Subsequent findings by the FCC revealed that duplicate alerts were not caused by damaged cell towers, as initially believed, but by technical issues, including equipment overload and the absence of unique alert identifiers. The report stresses that such false or unclear alerts can cause “alert fatigue,” making the public less likely to respond promptly to legitimate warnings in the future.

It is important to note that this erroneous alert was issued through the Los Angeles County system and was not connected to Alert SouthBay. Alert SouthBay operates independently and separately from Alert LA County, serving 14 South Bay cities with its own training, safeguards, and notification methods. The City’s participation in Alert SouthBay ensures that local residents are supported by a regional program designed with multiple protective measures to prevent the type of error described in Sounding the Alarm report (Attachment C).

Moving forward, the lessons outlined in the Congressional report reinforce the need for improved technology standards, rigorous user training, and enhanced safeguards at all levels of government.

While the Kenneth Fire false alert highlights areas for systemic reform, the City’s continued use of Alert SouthBay provides an additional level of assurance that residents will continue to receive accurate and timely emergency notifications when needed.

Emergency Preparedness and Public Safety Website Update The City continues to prioritize emergency preparedness and public safety by providing residents with clear, accessible resources on its website. City Intern Lucas Balbi has been assisting staff in updating and expanding these sections, ensuring residents have practical guidance on topics such as Alert SouthBay & Know Your Zone, the Block Captain Program, Home Hardening and Canyon Management, Defensible Space and Plant Selection, Earthquake Safety, Wildfire Readiness, Landslide Awareness, Flood and Storm Response, Power Outages, and Equine Safety. These resources play an important role in helping residents stay informed and ready to protect their families and properties. This effort is ongoing, and the website will continue to evolve with regular updates as new information, tools, and best practices become available.

Prepared Peninsula Expo
Preparations are underway for the 2025 Prepared Peninsula Expo, scheduled for Sunday, October 26, from 10:00 a.m. to 1:00 p.m. at Peninsula High School in conjunction with the PV Farmers Market. The Expo serves as a regional outreach effort to promote disaster readiness through public education and interagency collaboration. This year’s program will include exhibits by law enforcement and the Los Angeles County Fire Department, information on City and School District emergency plans, and interactive activities designed to reinforce household preparedness, including the assembly of emergency supply bags and pet preparedness guidance. The event will also provide family-friendly elements to encourage community participation, while emphasizing the importance of proactive planning to enhance resilience across the Peninsula.

Neighbors Night Out
The City’s recent Neighbors Night Out event was a great success, bringing together residents, partners, and community organizations in the spirit of public safety and neighbor-to-neighbor connection. Special appreciation is extended to Willdan and Malaga Bank for their generous donations, which helped make the evening possible, and to Kristen Raig and her staff at the Rolling Hills Community Association, as well as City Intern Teagan Nash, for their outstanding work in

Page 173 of 228 ends

planning and coordination. The event featured participation from the Los Angeles County Sheriff’s Department, the Mounted Posse, and the Los Angeles County Fire Department, along with representatives from the South Bay Council of Governments, Willdan, Cal Water, the Women’s Community Club of Rolling Hills, the Rolling Hills Courts Club, and booths hosted by both the City and the RHCA. Modeled after the National Night Out initiative, which promotes police-community partnerships and neighborhood camaraderie. The City’s version provided an opportunity for residents to meet local agencies, strengthen community ties, and celebrate the cooperative spirit that is essential to safety and resilience in Rolling Hills.

Free Firescaping Class
West Basin Municipal Water District, in partnership with the City of Rolling Hills, will host an in-person Firescaping Workshop on October 2 from 6–8 p.m. Led by Douglas Kent, MS, MLA, author, activist, educator, and ecological land management specialist, this workshop will provide practical guidance on creating fire-resistant landscapes using native plants and smart irrigation practices. Kent, who has been helping communities build fire protection since 1993 and teaches at USC and UCLA Extension, is also the author of Firescaping: Protecting Your Home with a Fire-Resistant Landscape. The first 25 attendees will receive a free copy of his book and dinner will be served.

National Preparedness Month

Alfred Visco Statement At Rolling Hills 5/28/25 City Council Meeting At theRolling Hills CityCouncil meeting of December 10, 2024, California Water Service Company (Cal Water) presented information on a wildfire hardening and reliability project on Appaloosa and Upper Blackwater. Included in said presentation was the comment that it would improve fire flow capacity. Cal Water indicated that said project would be completed in April/May 2025. Cal Water also stated that a Geotechnical Report would be prepared and said report would be given to the City.

At the same meeting Cal Water advised that the placing of a portion of their water main lines above ground on Cinchring Road and Quail Ridge Road South had been completed. This generated several comments and questions as follows:

1. A tree had fallen near 3 Quail Ridge Road South which appeared to have a lot of water in the roots and there was a question on whether or not this was due to water from Cal Water infrastructure. Cal Water stated that they would look into it.

2. How does Cal Water know if there is a water main break or a water main leak above and below the above ground water mains? Cal Water stated that they have monitors which check for low pressure which would indicated a water main break and monitors which check for vibrations in the evening which would indicate water main leaks.

3. A simple approach to determine if there were leaks in Cal Water infrastructure was presented ie. determine the amount of water going into the water tank located North of Spur Road and determine the amount of water that was being used by the individual parcels.

4. Is Cal Water planning to remove and replace the old existing underground infrastructure on CinchringRoad? A comment was made by a CityCouncil member that it was his understanding that Cal Water was planning to upgrade all its underground infrastructure and would hope that the land movement areas would be placed in the highest priority.

Since that meeting a sink hole occurred on Cinchring Road which was repaired. No indication from anyone on what caused it.

At the Rolling Hills City Council meeting of January 13, 2025, Istated the following: “The current wildfires have brought another issue which needs to be addressed. Is Cal Water’s infrastructure including but not limited to tanks, reservoirs, fire hydrates and back up energy sources for its pumps sufficient to fight a major wildfire in Rolling Hills. A letter should be addressed to Cal Water, a public hearing should be immediately held, and representatives of Cal Water should be required to attend to address same.” Since that meeting another issue has been raised i.e. the empty reservoir located at the corner of Palos Verdes Drive North and PalosVerdes Drive South (Palos Verdes Reservoir). So far we have heard only happy talk from Cal Water that their system is ready for a wildfire, that the Palos Verdes Reservoir is not needed, and that in any event they do not own it as it is owned by the Metropolitan Water District of Souther California (MWD).

It is my understanding that the Palos Verdes Reservoir is owned by MWD, can store approx. 360

Page 175 of 228 ends

million gallons and has been out of service since March 2022.

Has Cal Water given the Geotechnical Report to the City? Has Cal Water completed the project? Has the City requested information on how much the project has improved fire flow capacity? I strongly urge the City to require Cal Water to supply complete information concerning how they are monitoring their infrastructure for breaks and leaks including complete reports predating the start of the land movement in 2024 which sets forth said break and leak data. Address the tree issue on Quail Ridge Road South. Supply information concerning the recent sink hole on CinchringRoad.

Present a detailed time line for replacing their underground infrastructure on Quail RidgeRoad South and Cinchring Road.

I again urge that a letter be sent to Cal Water demanding that they supply a detailed report on how their system would be able to respond to a major wildfire in Rolling Hills. I also urge a letter be sent to MWD addressing the issue of the Palos Verdes Reservoir and how it could be placed back in service in order to help respond to a major wildfire in Rolling Hills ie. serving as a source of water for aerial applications and/or increasing the amount of water available to Cal Water’s fire hydrates.

Multi-Layered Measures to Detect &
Address Water Leaks and Main Breaks
How Cal Water is working to detect and
mitigate leaks and breaks amid land movement
in Rolling Hills
A main leak is defined as a small, slow loss
of water. In contrast, a main break is defined as an immediate rupture of the pipe, which causes a larger amount of water
loss that surfaces rapidly. All water systems
can reasonably expect to have leaks and
breaks. Please note that detection measures do not prevent leaks from occurring and a single method will not detect every
leak, which is why we have implemented a
layered approach.

Above-Ground Water Main
In the area of Rolling Hills where we have
experienced recent main breaks due to the
land movement, we are moving the main
above-ground to better withstand the
movement. Our team of engineers completed an analysis of the Cinchring Road and Quail Ridge Road area and designed
the alignment of the new, above-ground
main. This alignment was subsequently
approved by the City and HOA.

Status: Crews have completed installation
of about 450 feet of water main and conducted water quality and pressure testing on October 19, 2024. We will tie the new
main into the water system after favorable
test results are received. Additionally, we
recently received approval to install about
180 feet of main on Quail Ridge Road and
are in the process of ordering material.

Monitoring devices
So far, we have installed 5 leak detection
sensors on our infrastructure in strategic
locations in Rolling Hills. These sensors
can help identify slow, unsurfaced leaks
as the water flow detected at that point
increases over time.
• The sensors can hear where a leak may
be occurring and generate a point of
interest.
• The sensors work best with minimal
ambient noise and when there is less
household water use, usually overnight.

For this reason, we have set our sensors
to “listen” between 2-3 a.m. daily.
• When a point of interest is identified,
based on being heard for two consecutive nights, the location is sent to our crews, who will investigate to confirm
whether a leak is occurring. If a leak is
found, then our crews will repair the
leak.
• These sensors are not designed to detect water main breaks. • Due to cellular reception issues on the
Peninsula, some sensors may pick up
noise before others may.

For example, sensors picked up a slow leak
from a valve that was leaking at a rate of
a few drips per second, and crews quickly
responded and tightened the valve.
®
®
(Continued on back)
California Water Service (Cal
Water) has undertaken a multipronged approach to detecting and addressing leaks and breaks
that have been occurring due to
land movement in Rolling Hills.

These tools work together to help
provide a more comprehensive
assessment of leaks that may
occur, particularly if the leaks are
not yet visible above the surface,
or to find water main breaks. Together, these tools are designed to help identify leaks and breaks
sooner, shorten response times,
and reduce the instances of leaks
and breaks.

AT-A-GLANCE:

Multi-Layered Leak/Break Detection
& Mitigation Measures
We have also installed 2 pressure monitors within the Rolling Hills system. These pressure monitors help detect immediate
ruptures, or water main breaks, that affect water pressure. • Pressure monitors are designed to notify us when there are sharper changes in water pressure.
• When the monitors detect a drop in
pressure, an alarm is sent via phone to
our crews, who will respond as quickly
as reasonably possible to address the
break.

For example, a main break that occurred
in the overnight/early morning hours in
Rancho Palos Verdes was detected by
a pressure monitor. Crews investigated
quickly and repaired it.

SCADA monitoring
Our Supervisory Control and Data Acquisition (SCADA) system monitors our water system 24 hours per day, 7 days
per week.
• SCADA monitors, collects, and processes information about the system in real time.
• Besides enabling us to remotely control
the system to allow our pumps, valves,
motors, and other components to
operate seamlessly when needed,
SCADA alerts our crews when there
is a significant change in the system
that could be or cause an issue, such
as rapid pressure loss that could occur
due to a main break.
• Our crews are prepared to quickly investigate any alarms generated by our SCADA system around the clock.

Visual inspection
We have stationed an employee in the
land movement area 24 hours per day,
7 days per week since 2023. This crew is
also now conducting visual inspections of
our water mains in the Rolling Hills land
movement area as part of regular visual
monitoring.

While we have crews in the field, we also
ask our customers to notify us when they
suspect a leak or break so that we can
investigate it. Because our water mains
are pressurized, when there is a main
break, water surfaces very quickly and
visual inspections are among the quickest and most reliable ways to detect a break. There have been instances of main
breaks where our pressure monitors
and SCADA system detected the break
and residents called in the break, within
minutes of each other.

Beyond these efforts, we:
• Are currently responding to all suspected or reported leaks and breaks on a “Code 4” basis, our highest response
priority.
• Have secured additional repair crews.
• Together with engineering and design
professionals, continue to assess various pipe materials and construction methods for our water main replacements as part of our infrastructure improvement process.

SOUNDING THE ALARM:

Lessons from the Kenneth Fire False Alerts
May 12, 2025

Page 179 of 228 ends

EXECUTIVE SUMMARY
In January 2025, a false Wireless Emergency Alert (WEA) was mistakenly sent to nearly 10 million residents across Los Angeles County during the Kenneth Fire, causing widespread public confusion and alarm. Intended to warn only those in the immediate danger zone, near Calabasas and Agoura Hills, the alert instead reached the entire county due to a failure within Genasys Inc.’s alerting software.

In addition, many residents reported receiving the false alert multiple times or after it had been cancelled. The Federal Communications Commission (FCC) found these duplicate or delayed messages were not caused by downed cell towers, as initially believed, but by other technical issues. One major wireless provider experienced equipment overload, and the lack of unique alert identifiers—combined with long alert duration settings and network handoffs—caused some devices to mistakenly reprocess or re-display the same alert.

Following oversight requests by Members of Congress representing Los Angeles County, this report prepared by Congressman Robert Garcia outlines the findings of a Congressional oversight investigation into the causes, impacts, and systemic vulnerabilities that led to the erroneous alert. The investigation revealed technical flaws in third-party software, insufficient warning mechanisms for missing location data, and broader issues with alert messaging clarity.

Key policy recommendations include improved federal funding for local alerting infrastructure, the Federal Emergency Management Agency (FEMA) should provide enhanced training and certification for Alert Originators, standardization of third-party software, implementation of location-aware maps in WEA messages, and finalization of FCC performance standards. These measures are necessary to restore public trust in emergency communications and ensure alerts are accurate, timely, and targeted.

EMERGENCY ALERTS
Following Hurricane Katrina, pursuant to Executive Order 13407, signed by President George W. Bush, the Department of Homeland Security (DHS) created the Integrated Public Alert and Warning System (IPAWS) to create an “effective, reliable, integrated, flexible, and comprehensive communications system to alert and warn” the public.

Congress has provided statutory support for IPAWS, authorizing the inclusion of wireless devices in 2006; codifying several elements of Executive Order 13407 and improving the system's resiliency and security in 2016; and requiring FEMA to develop mandatory minimum requirements for state and local IPAWS users in 2019.

FEMA operates and maintains this IP-based network alerting system, which can be used by the President to send
nationwide emergency alerts, and by state, local, tribal, and territorial public safety entities that need to communicate an emergency alert locally, like Los Angeles County, by
connecting them to the nationwide communications networks capable of delivering these alerts to impacted public
audiences.
(Federal Emergency Management Agency [FEMA])
IPAWS enables the simultaneous distribution of a single emergency alert across multiple communication networks. It authenticates, validates, and distributes alerts through various communication pathways, including:
• Television and radio alerts (Emergency Alert System or EAS) • Wireless text message alerts (Wireless Emergency Alerts or WEA) • NOAA National Weather Radio (NWR)
• Internet-based systems (e.g., outdoor digital signs)

3 ALERTING AUTHORITIES & THIRD-PARTY SOFTWARE
Local public safety agencies are certified by FEMA to become Alerting Authorities, which can use FEMA’s IPAWS system to send alerts. Agencies must complete proficiency demonstrations, and practice monthly. There are 1,963 Alerting Authorities throughout the U.S., including 28 in Los Angeles County alone.

Alerting Authorities purchase and use third-party commercial software, known as Alert Origination Software Providers (AOSP), to assist the Alerting Authority in targeting populations and accessing the IPAWS system to send alert messages. There are over 40 different commercial providers in the market, each with their own unique features and interfaces; and they must all be certified by FEMA.

Los Angeles County uses Genasys Inc.’s software systems to coordinate emergency protective actions, issue emergency alerts and warning messages, and support communicating emergency information to the public.

LA WILDFIRE FALSE ALERTS
Between January 7 and January 27, 2025, state and local California Alerting Authorities used IPAWS to send over 146 alerts to the public.

The Los Angeles County Office of Emergency Management (LACOEM), Los Angeles County Fire Department, Los Angeles County Sheriff’s Department, and other jurisdiction partners used Genasys’ EVAC software system to map zones which may require protective action.

On January 9, 2025, LACOEM used Genasys’ system to send multiple alerts throughout the day for different areas of the County impacted by concurrent, active fires.

At 3:46 p.m., LACOEM began drafting an evacuation warning message intended for individuals near Calabasas, Agoura Hills, and the West Hills community in the western San Fernando Valley, which were under threat from the Kenneth Fire.

However, when the message was sent at 3:56 p.m., instead of being delivered to just the intended area under threat from the Kenneth Fire, the message was mistakenly delivered throughout the entire Los Angeles County. Thus, nearly 10 million people across the County received this alert:
4 LACOEM then takes the targeted areas developed in Genasys’ EVAC software and inputs that targeted geographic area in Genasys’ ALERT software, which is used to send out the alert messages over multiple channels, including IPAWS, to the specified areas of concern.

IPAWS WEA messages use standardized formatting, and in 2019, the FCC expanded messages from 90 to 360 characters (for 4G LTE network technology and beyond).

5 IMPACT
To protect life and property during emergencies, appropriately timed, targeted, and understandable emergency alert messages can mean the difference between life and death.

However, unclear messages, sent to the wrong locations, multiple times, and after the emergency has passed, can lead to alert fatigue and erosion of public trust. Due to the incorrect warning, millions who were never under any wildfire danger were unnecessarily alarmed and confused, causing distress in a dangerous time of out-of-control wildfires.

This had serious implications for public safety and well-being at a time of intense distress for our community. Further, the incident raises a serious risk that future alerts could be ignored or downplayed by more recipients, putting lives at risk.

CONGRESSIONAL INVESTIGATION
From latimes.com
Letters were addressed to:

On February 3, 2025, Congressman
Robert Garcia (CA-42) and thirteen
Members of Congress representing
Los Angeles County sent oversight
letters seeking answers regarding the
erroneous evacuation warnings.

Genasys, Inc., the software company used by the County for mapping targets and issuing Wireless Emergency Alerts (WEA) Los Angeles County
The Federal Emergency Management Agency (FEMA)
The Federal Communications Commission (FCC)
All four entities responded to the oversight letters by the requested deadline of April 1, 2025.

KEY FINDINGS

1. The initial false alert is believed to be caused by technology issues with third-party technology vendor Genasys.

In sending an alert, an Alert Originator designates a broad geographic area (geocode), like a county, where they have permission to send alerts.Within this geocode, a more precise geographic area (polygon) can be used to target alerts to only the area impacted by the threat.
12 12. https://robertgarcia.house.gov/media/press-releases/congressman-robert-garcia-leads-los-angeles-county-members-demand-answers

Page 184 of 228 ends

On January 9, 2025, LACOEM used Genasys’ EVAC software to designate a polygon specific to the area under threat from the Kenneth Fire.

According to Genasys’ internal investigation, LACOEM’s Alert Originator input the correct Kenneth Fire-area polygon into Genasys’ ALERT system, and the geocode (Los Angeles County in this case) was auto-populated across all channels.

The correct Kenneth Fire-area polygon was saved in different channels for SMS, voice calls, emails, TTY (teletype for the hearing impaired), and Genasys’ mobile PROTECT App.

However, the correct Kenneth Fire-area polygon was NOT saved into the IPAWS wireless channel in the Genasys system, and the operator did not realize the polygon was missing.

Genasys believes this may be due to a network disruption, but did not explain the source of the network disruption.

Page 185 of 228 ends

Genasys’ system showed the alert message was in “ready” status and able to be sent—there was a geocode (Los Angeles County) in the IPAWS channel, and IPAWS allows a message to be disseminated county-wide with just a geocode.

The LACOEM Alert Originator had properly input the polygon into the system; but was not alerted by the Genasys’ system that the polygon wasn’t saved in the IPAWS channel.

The Genasys system did not warn the Alert Originator that it did not have a polygon (Kenneth Fire area) in the IPAWS channel, and the message would be sent county-wide; and gave no indication that the IPAWS channel was missing the targeted polygon, despite it being present in the other alert distribution channels.

It should be noted that Los Angeles County’s response does not discuss network issues or the lack of an uploaded polygon, instead noting “This error was unable to be duplicated, but Genasys reported that the issue was traced to the version 2 (“/v2”) user interface of the Genasys system,” and “While the error was unable to be duplicated, additional safeguards were put into place.”
Genasys has since updated its software to include a warning to the user that the alert has a geocode but no polygon and will go county-wide before sending the alert; and now if the other distribution channels have polygon targeting, it will ensure the IPAWS channel also includes that polygon geographic targeting.

The independent after-action review by the McChrystal Group, ordered by the Los Angeles County Board of Supervisors, may want to further investigate Genasys’ claims of what caused the error, and how a network disruption would have occurred or could have blocked the proper upload of a polygon into the IPAWS distribution channel. 7 2. LA County noticed the error quickly and acted immediately to stop the message and send a correction.

Almost immediately, LACOEM noticed
the message was sent county-wide in error,
and cancelled the alert 2 minutes and 47
seconds later.

Twenty minutes after the false alert,
LACOEM issued a new alert, noting the
error in the initial message and clarifying
the evacuation warning was meant only to

8 As the County worked with Genasys and federal partners to understand what caused the error, the next day on January 10, 2025, Los Angeles County temporarily switched from sending messages via the Genasys system to having the California Governor's Office of Emergency Services (CalOES) use their emergency alert and warning system, OnSolve CodeRed, to send local alert notifications for the County. Los Angeles County moved back to using Genasys on January 30, 2025.

3. Los Angeles County could improve the wording of alert messages.

FEMA’s IPAWS Best Practices Guide
recommends the text of alert messages
include six key information elements:

The Kenneth Fire message, which
accidentally went county-wide, could
have been better written to convey
relevant information which could have
improved an understanding of the
nature of the danger.

Los Angeles County may have avoided damage to people outside the impacted Kenneth Fire area had their message included more information on the location or the timing of the danger. This additional information is also important for people who have older phones, where geotargeting is not precise on those devices.

A more precise description of the affected area could have been accomplished with language such as, “An EVACUATION WARNING has been issued for Calabasas/Agoura Hills,” instead of “An EVACUATION WARNING has been issued for your area.” (Federal Emergency Management Agency [FEMA])
In questioning, Los Angeles County states, “The County has and currently does identify specific locations and neighborhoods in its emergency alerts,” however, this specific case raises an area for improvement.

Similarly, damage may have been avoided for those receiving the message late or multiple times had the message included a time stamp explaining when the message was issued.

In questioning, Los Angeles County states, “Yes, the County has updated messaging templates and guidance to include a date and time stamp within the message itself.”
In both examples, Los Angeles County correctly points out that the 360-character limit for IPAWS messages constrains how descriptive alert messages can be drafted. 17 18

9 According to the Federal Communications Commission, “We understand that some people received expired or cancelled WEAs, and reports at the time suggested this was due to cell towers going offline and later sending “cached” WEAs once service was restored.

Based on the FCC’s investigation, however, it appears that cancelled or expired alerts were sent primarily due to other technical issues.

Specifically, one wireless provider reported that a small percentage of its 4G LTE equipment transmitted expired alerts due to an “overload” attributable to the high volume and long duration of alerts sent during the fires. That provider has since deployed a temporary patch to address this issue, and we understand that the provider is developing a permanent repair that will resolve this issue.”
The FCC further explained that given the lack of unique identifiers for alert messages, a cell phone may treat the same alert as two unique messages if received by different network providers, such as when a cellphone roams into another provider’s network or moves from 5G to a 4G LTE network.

Finally, the FCC explains that with messages that have long duration windows—Los Angeles County’s message was set to 24 hours—some cell phones clear the alert in less than 24 hours or when the phone is turned off, and with the alert still active, they may interpret the still-active original alert as a new alert.

4. Repeat messages were not due to downed cell equipment as initially believed, but rather other technical issues.

POLICY PRIORITIES

1. Improve funding for the planning, equipment, training, exercises, operations, and maintenance on IPAWS Systems.

Timely, accurate, and understandable emergency alerts are essential to providing information to individuals at risk in life/safety situations and are a crucial tool for public safety agencies to convey the information citizens need to take protective actions and save lives.

However, the issues highlighted by the Los Angeles Wildfire false alerts reinforce the need for alerting authorities to have the proper planning, equipment, continual training, consistent exercises, and maintenance and upgrade of systems to properly perform in realworld disasters.

Cost burdens constrain state and local governments in all of these areas.

The Congressional Research Service notes cost as a key issue for gaps in coverage among local alerting authorities, noting a 2020 Government Accountability Office (GAO) report found that only 70% of the country's population is covered by a local alerting authority authorized to use IPAWS. 22 22. 23

Page 188 of 228 ends

10 It also notes, “Although many state, local, territorial, and tribal governments use federal grants to supplement the costs of emergency alerting technologies, some local entities "may find it difficult to sustain their investment" in alerting technologies after their grant funding ends.”

2. FEMA needs to enhance minimum requirements for IPAWS Alerting Authorities on an ongoing basis and improve training; and implement standardization for third-party technology providers.

Required training and guidance for
alerting authorities that use IPAWS;
A program for the annual recertification
of IPAWS alerting authorities; and
In 2019, following the false missile alert in
Hawaii, Congress passed a law requiring
FEMA to develop mandatory minimum
requirements for state, local, territorial, and
tribal governments using IPAWS.

FEMA had to include:

A certification program for tools used by IPAWS alerting authorities.

With respect to third-party technology software providers, this report outlines how an unsaved polygon and a defaulted auto-populating of the Los Angeles County geocode in Genasys Inc.’s software was the major cause of the Kenneth Fire faulty alert. This highlights the issues of technology interface, interoperability, and defaults/resets/automated processes that can result in erroneous alerts, which must be improved through coordination by FEMA.

The 2019 law required “the standardization, functionality, and interoperability of incident management and warning tools…”
As FEMA responded to the members of Congress, “The inconsistency between software products complicates FEMA’s ability to provide standardized training, guidance, and technical assistance to state, local and tribal agencies using IPAWs.” FEMA plans to pilot the third-party technology certification program this year.

However, over five years later, while FEMA has taken steps on all of these criteria for Alert Originators, FEMA’s work is not finished.

FEMA reports that a pilot program for IPAWS user certification is starting this year. “The training and certification program will provide Alert Originators critical alerting skills and proficiency, enabling more knowledgeable users with greater capabilities and confidence in using IPAWS.”

11 While LACOEM’s message did include a link to AlertLA.org, where they could have found a map, some users might not have Wi-Fi or cellular data to be able to open the link; and even if they could access the site they needed to scroll down, toggle an interactive map, and zoom in to see whether their neighborhood was included in the evacuation warning area.

In 2023, an FCC working group of public safety officials, wireless providers, mobile device manufacturers, and technical experts (CSRIC VIII) recommended alert messages include a link to access “location-aware” maps to depict the alert’s targeted geographic area and the recipients’ relative position to the hazard, which the working group found was feasible leveraging current technology.

In October 2024, the FCC finalized a rule, with the approval of all five FCC Commissioners, requiring commercial mobile service providers who participate in Wireless Emergency Messages (WEA) to “support the presentation of Alert Messages that link the recipient to a native mapping application on their mobile device to depict the recipient’s geographic position relative to the emergency incident.” These location-aware maps can be achieved with a WEA-enabled map within the WEA message itself, a clickable link in the WEA message to a native mapping application, or to provide a link via a separate pop-up message that directs the user to the WEA-enabled map.

The FCC gave mobile carriers three years to implement the maps, with an effective deadline of December 15, 2026. When fully implemented by mobile carriers, this will be a

12 In February 2020, the Government Accountability Office issued a report on Emergency Alerting, and its first recommendation was that the FCC “should develop specific, measurable goals and performance measures for its efforts to monitor the performance of new WEA capabilities, such as enhanced geo-targeting and expanded alert message length.”

4. The FCC should finalize performance standards.

In its report, the GAO found the “FCC
has not developed goals and performance
measures to help monitor how well the
new capabilities perform during
emergencies. Instead, we found FCC has
taken an ad-hoc approach to monitoring
WEA performance…By developing goals
and performance measures for its efforts
to monitor the new WEA capabilities,
FCC would have clearer direction for
what it plans to achieve and more specific
means to assess the performance of the
capabilities.”
Several of the issues raised in the FCC’s Kenneth Fire investigation could be aided by performance standards. For example, with the overloaded carrier, there is no telling how many other providers across the nation would have similar issues in a future disaster.

Looking at how well capabilities perform, or fail to perform, would allow the FCC to develop guidance or fixes.

The idea of moving from a unique alert identifier issued by each carrier to a single alert identifier for each alert regardless of carrier, would be an example of an action the FCC can initiate in concert with FEMA. Similarly, with guidance on alert timing, or the potential for the FCC to recommend fixes to network issues that are discovered that lead to duplicate messages.

The FCC’s April 2023 Notice of Proposed Rulemaking also included establishing Wireless Emergency Alert performance minimums, stating that the public will benefit from improved and targeted usage of WEA alert messages, and that greater accuracy in sending alert messages will result in less overshoot, which in turn will mean that fewer people will receive alert messages not intended for them. However, this rule was never finalized. 28 28. https://www.gao.gov/products/gao-20-294

13 Congress and federal agencies must act now to close identified gaps in alerting system performance, certification, and public communication. The lessons from the Kenneth Fire should not only inform reforms, but serve as a catalyst to modernize the nation's alerting infrastructure before the next disaster strikes.

CALL TO ACTION
Tragically, at least 18 people died in the Eaton Fire in Altadena, and at least 12 people in the Palisades Fire in Pacific Palisades. The deaths from the Eaton Fire occurred west of Lake Avenue, where residents did not receive an evacuation order until around 3:30 a.m. on January 8, 2025.

This is a serious issue and deserves an independent investigation. Reports currently do not indicate an issue with the IPAWS emergency alert system, and thus are not covered by this Congressional Report.

We expect the independent after-action review by the McChrystal Group, ordered by the Los Angeles County Board of Supervisors, to cover these issues and any necessary recommendations related to a lack of a timely evacuation warning for the Eaton Fire in Altadena.

1 To: Rolling Hills City Council
From: Block Captains and Residents
Re: Siren Project – Addional Poles
Date: August 25, 2025
cc: RHCA Board of Directors
Dear Honorable Mayor and City Council,
The devastang and deadly January 2025 Palisades and Eaton fires accentuated a fatal flaw in our emergency outdoor warning system. As reported by HQE to the City Council on January 27, 2025, the Outdoor Warning Siren System cannot be heard throughout all the city of Rolling Hills. Approximately 212 homes or 30% of Rolling Hills potenally cannot hear the outdoor sirens (See Appendix 1) including but not limited to Poppy Trail, Portuguese Bend South, Pinto, Southfield, Packsaddle, Chesterfield, Chuckwagon, Appaloosa, Pine Tree, Buggy Whip, Hummingbird Lane, and other streets.

The loss of 31 lives, especially 19 in the Eaton Fire, underscores the tragic consequences when emergency noficaons fail. In an area prone to wildfire risk like Rolling Hills, effecve emergency communicaon is paramount to saving lives, especially during the loss of power, cellular service, and internet connecvity that oen accompanies major disasters, rendering other alert methods like Alert SouthBay potenally ineffecve.

During the July 2025 Texas floods, sirens in the town of Comfort provided a crucial alert, enabling residents to evacuate safely and avoid fatalies. This stands in stark contrast to other areas where the death toll soared to over a 100 adults and children, with experts saying beter early warning systems could have reduced casuales, highlighng the urgent need for a robust system here in Rolling Hills.

While we value the aesthec charm of our community, priorizing view preservaon over essenal lifesaving emergency alerts is a dangerous gamble that could cost our residents their lives.

We urgently call upon City Council leadership and staff to take the following concrete steps, demonstrang a clear commitment to the safety and well-being of all residents:

1. Direct staff to work with the vendor to IMMEDIATELY idenfy and present addional locaons for siren poles ensuring 100% audible coverage for every resident in our community.

2. Schedule and conduct a comprehensive public hearing focused on the proposed siren locaons.

This is crucial to address concerns from all residents, not just those directly impacted by pole proximity.

3. Priorize the public safety of all residents above all else. This means allocang necessary resources, including financial, to expedite the Outdoor Warning Siren System expansion.

4. Commit to compleng the installaon of all addional poles and sirens, along with a full system test, by the end of this calendar year, 2025. One year is more than enough me to assess, plan, and execute this crucial phase of the project. This deadline creates a necessary sense of urgency to ensure the community is protected as quickly as possible.

The me for acon is now. Delays in expanding and tesng the Outdoor Warning Siren System put lives at risk.
