The statement shall set forth the facts that show whether or not there was a consumption of an alcoholic beverage or the ingestion or administration of a drug by the defendant in connection with the offense.
(b)The court shall advise the defendant, prior to the acceptance of the plea offered pursuant to a factual statement pursuant to subdivision (a), of the consequences of a conviction of a violation of Section 23103 as set forth in subdivision (c).

https://legiscan.com/CA/text/AB1546/id/3457266/California-2025-AB1546-Amended.html 32/49
(c)If the court accepts the defendant’s plea of guilty or nolo contendere to a charge of a violation of Section 23103 and the prosecutor’s statement under subdivision (a) states that there was consumption of an alcoholic beverage or the ingestion or administration of a drug by the defendant in connection with the offense, the resulting conviction shall be a prior offense for the purposes of Section 23540, 23546, 23550, 23550.1, 23560, 23566, or 23622, as specified in those sections.
(d)The court shall notify the Department of Motor Vehicles of each conviction of Section 23103 that is required under this section to be a prior offense for purposes of Section 23540, 23546, 23550, 23550.1, 23560, 23566, or 23622.
(e)Except as provided in paragraph (1) of subdivision (f), if the court places the defendant on probation for a conviction of Section 23103 that is required under this section to be a prior offense for purposes of Section 23540, 23546, 23550, 23550.1, 23560, 23566, or 23622, the court shall order the defendant to enroll in an alcohol and drug education program licensed under Chapter 9 (commencing with Section 11836) of Part 2 of Division 10.5 of the Health and Safety Code and complete, at a minimum, the educational component of that program, as a condition of probation. If compelling circumstances exist that mitigate against including the education component in the order, the court may make an affirmative finding to that effect. The court shall state the compelling circumstances and the affirmative finding on the record, and may, in these cases, exclude the educational component from the order.
(f)(1)If the court places on probation a defendant convicted of a violation of Section 23103 that is required under this section to be a prior offense for purposes of Section 23540, 23546, 23550, 23550.1, 23560, 23566, or 23622, and that offense occurred within 10 years of a separate conviction of a violation of Section 23103, as specified in this section, or within 10 years of a conviction of a violation of Section 23152 or 23153, the court shall order the defendant to participate for nine months or longer, as ordered by the court, in a program licensed under Chapter 9 (commencing with Section 11836) of Part 2 of Division 10.5 of the Health and Safety Code that consists of at least 60 hours of program activities, including education, group counseling, and individual interview sessions. (2)The court shall revoke the person’s probation, except for good cause shown, for the failure to enroll in, participate in, or complete a program specified in paragraph (1). (g)Commencing January 1, 2019, the court may require a person convicted on or after January 1, 2019, of a violation of Section 23103, as described in this section, to install a functioning, certified ignition interlock device on any vehicle that the person operates and prohibit that person from operating a motor vehicle unless that vehicle is equipped with a functioning, certified ignition interlock device. If the court orders the ignition interlock device restriction, the term shall be determined by the court for a period of at least three months, but no longer than the term specified in Section 23575.3 that would have applied to the defendant had the defendant instead been convicted of a violation of Section 23152, from the date of conviction. The court shall notify the Department of Motor Vehicles, as specified in subdivision (a) of Section 1803, of the terms of the restrictions in accordance with subdivision (a) of Section 1804. The Department of Motor Vehicles shall place the restriction in the person’s records in the Department of Motor Vehicles. A person who is required to install a functioning, certified ignition interlock device pursuant to this subdivision shall submit the “Verification of Installation” form described in paragraph (2) of subdivision (g) of Section 13386 and maintain the ignition interlock device as required under subdivision (f) of Section 23575.3. The department shall monitor the installation and maintenance of the ignition interlock device installed pursuant to this subdivision. (h)The Department of Motor Vehicles shall include in its annual report to the Legislature under Section 1821 an evaluation of the effectiveness of the programs described in subdivisions (e) and (g) as to treating persons convicted of violating Section 23103.
(i)This section shall remain in effect only until January 1, 2033, and as of that date is repealed, unless a later enacted statute, that is enacted before January 1, 2033, deletes or extends that date.

RE: Assembly Bill 1546 - SUPPORT
Dear Assemblymember Wicks,
The California Contract Cities Association (CCCA) writes to express our support of Assembly Bill 1546, which heightens criminal penalties for driving under the influence (DUI), particularly for repeat offenders.
Over the past decade, nearly 40,000 Californians have lost their lives in roadway collisions, many of which are caused by drunk drivers with a documented history of dangerous conduct. By lengthening license revocations for DUI offenses, strengthening the punishment for repeat offenders, and expanding ignition interlock requirements, AB 1546 will go a long way in holding the most dangerous motorists accountable for reckless driving. Through a thoughtful, graduated structure, AB 1546 will balance prevention measures and penalties in a way that reflects the severity of repeated violations. We applaud Assemblymember Schultz for his continued leadership on this critical public safety issue.
CCCA represents 80 cities throughout California. For more than 65 years, CCCA’s mission has been to advance the benefits of the contracting model and strengthen local control.
With collaborative governance as a focal point, CCCA has advanced its mission through education, advocacy, networking, and legislative access to protect and enhance the quality of life for more than 7.5 million residents. As a matter of policy, our organization supports and defends the rights of cities on policy issues pertinent to them.
We thank you in advance for your consideration of our support of AB 1546.
Yours in service,
Marcel Rodarte, Executive Director

Department of Commerce | National Oceanic and Atmospheric Administration | weather.gov Warmer Ocean Temps Come Without a Guarantee
Climate models are showing a high probability of a very strong to possibly record-breaking El Niño in terms of Nino 3.4 SST anomalies. While this does tilt the odds towards a more active storm track and associated impacts in Southern California, it is far from guaranteed.

Department of Commerce | National Oceanic and Atmospheric Administration | weather.gov El Niño Impacts across
Southern California
Department of Commerce | National Oceanic and Atmospheric Administration | weather.gov Climate Signals vs. Short-Range Storm Forecasting
Ocean Temperatures vs. Atmospheric
Coupling: While record ocean warmth is a key
indicator of El Niño, the atmosphere must actively
interact—or "couple"—with that heat to effectively steer storm tracks into Southern California. Although the
ocean is already warmer than normal and is expected
to remain so through the winter, it is currently uncertain whether the necessary atmospheric coupling will occur
6 Department of Commerce | National Oceanic and Atmospheric Administration | weather.gov Climate Signals vs. Short-Range Storm Forecasting
Seasonal Backdrop vs. Individual Storms:
El Niño shapes the overarching climate patterns over a
season, but it is not a storm itself. While it sets the broader environmental stage, it does not dictate the
timing, track, or intensity of specific weather systems
7 Department of Commerce | National Oceanic and Atmospheric Administration | weather.gov Climate Signals vs. Short-Range Storm Forecasting
Forecast Horizons for Burn Scars
and Infrastructure:
● Accurately predicting Quantitative
Precipitation Forecasts (QPF), peak
hourly rain rates, and debris flow
thresholds relies on short-range,
high-resolution modeling and real-time
observational data
● As a result, site-specific forecasts are
delivered within a few days of a storm's
onset, once the system enters a reliable
window of predictability
8 Department of Commerce | National Oceanic and Atmospheric Administration | weather.gov Climate Signals vs. Short-Range Storm Forecasting
Our Objective Role of the NWS: As part of our
Impact-Based Decision Support Services (IDSS), our role is to provide you with objective forecast data, clear ranges of uncertainty, and expected timing to help guide your
critical decisions
9 Department of Commerce | National Oceanic and Atmospheric Administration | weather.gov Calibrating Risk: Probabilities vs. Certainties
10 Understanding the odds: While a strong El Niño tilts broad regional probabilities toward a wetter season, the likelihood of severe impacts occurring in any specific neighborhood or location remains far from guaranteed
Department of Commerce | National Oceanic and Atmospheric Administration | weather.gov Calibrating Risk: Probabilities vs. Certainties
11 Risk Analogy (To a Winning Sports Team on a Road Trip): Facing a top-ranked sports team on the road increases the statistical chance of a tough game, but it is far from an automatic loss; most outcomes are decided in the moment, or play-by-play. Thus, an active seasonal setup stacks the odds, but it does not predetermine a disaster
Department of Commerce | National Oceanic and Atmospheric Administration | weather.gov Calibrating Risk: Probabilities vs. Certainties
12 Grounded Communication: To keep our communities from tuning out important alerts (warning fatigue), we will talk about seasonal climate trends as shifted odds or increased chances, rather than inevitable disasters
Department of Commerce | National Oceanic and Atmospheric Administration | weather.gov Addressing and Preventing Warning Fatigue
13 Preserving Warning Integrity: To ensure the public
remains responsive during actual emergencies, we
are avoiding extreme or catastrophic language when
discussing long-range, probabilistic climate outlooks.
We want people to take action when it truly matters.
● Protecting Life-Safety Compliance: We are
concerned that if communities anticipate an
immediate disaster that fails to materialize early
in the winter, public compliance with critical
short-fuse Warnings drops significantly later in
the season
Department of Commerce | National Oceanic and Atmospheric Administration | weather.gov Addressing and Preventing Warning Fatigue
14 Clear Horizon Separation:
● Seasonal Climate Outlooks: These provide
broad shifts in probability to build long-term
situational awareness and support long-range
planning efforts
● Event-Driven Watches & Warnings: These are
reserved strictly for imminent, high-confidence
hazards that pose a direct threat to life and
property
Maintaining Trust: By keeping our seasonal risk
messaging proportional, we ensure that our
high-urgency alerts carry the maximum possible
impact when severe weather actually threatens
Department of Commerce | National Oceanic and Atmospheric Administration | weather.gov Delineating Operational Forecasts from Hypotheticals
15 Operational Reality vs. "What-If" Scenarios:
● Research-Based Analyses: These often explore
theoretical maximums, compounding risks, and
extreme tail-risk possibilities (such as statewide
worst-case scenarios)
● NWS Operational Products: These focus on
actionable, real-world probability distributions driven by reliable ensemble modeling. While we do message
reasonable worst-case scenarios, we only do so when
sufficient scientific evidence and reliable probabilities exist—typically when a specific storm is clearly on the horizon
Department of Commerce | National Oceanic and Atmospheric Administration | weather.gov Delineating Operational Forecasts from Hypotheticals
16 Why we aren’t providing site specific forecast information yet? ● The probabilities of specific weather conditions at any one location this far out are still too small (despite being elevated above normal) to reliably provide explicit predictions
Department of Commerce | National Oceanic and Atmospheric Administration | weather.gov Delineating Operational Forecasts from Hypotheticals
17 Why we aren’t providing site specific forecast information yet? ● Although the very strong El Niño elevates the baseline risk for high-impact scenarios, such as freshwater flooding, coastal flooding, damaging surf, and severe weather, current probabilities are not high enough to issue explicit predictions without serious concerns for warning fatigue. Should a destructive weather event materialize, forecast confidence will rapidly increase within a few days of onset, at which point our messaging will reflect that heightened certainty
Department of Commerce | National Oceanic and Atmospheric Administration | weather.gov Delineating Operational Forecasts from Hypotheticals
18 Why we aren’t providing site specific forecast information yet? ● Given the nonlinear changes in event confidence as we go through the next several months, we plan to host two webinars each week for NWS partners as an opportunity to share the latest expected conditions and discuss any questions

Subject: Adopt Resolution No. 1423 and approve an Americans with Disabilities Act (ADA) Complaint Policy to ensure compliance with the ADA, 28 Code of Federal Regulations (CFR) Part 35.107 and Section 504 of the Rehabilitation Act of 1973 Background:
The Americans with Disabilities Act (ADA) of 1990, specifically Title II, requires public entities to ensure that individuals with disabilities have equal access to public programs, services, and activities.
As part of these requirements, public agencies must adopt and publish an ADA Complaint Policy to ensure the prompt and equitable resolution of complaints alleging disability-based discrimination.
The City currently has a designated ADA Coordinator who will also serve as the Section 504 Coordinator, as required by Section 504 of the Rehabilitation Act of 1973 due to the City’s acceptance of federal funding. Because the responsibilities of the ADA Coordinator and Section 504 Coordinator are similar, combining the roles will facilitate communication, coordination, and administration of the City’s accessibility responsibilities.
In addition to ensuring accessibility within public facilities and infrastructure, ADA compliance involves program accessibility, policy implementation, employee training, and coordination throughout City operations.
To formalize these responsibilities and better align ADA oversight with the City’s administrative coordination, accessibility improvements, risk management, and employee training efforts, the City Council is being asked to adopt Resolution No. 1423 approving the City’s ADA Complaint Policy (Attachment A).
Discussion:
ADA/Section 504 Nondiscrimination and Complaint Policy
The proposed policy affirms the City’s commitment to providing individuals with disabilities equal access to its programs, services, activities, and facilities. It establishes a clear and accessible process for the prompt and equitable resolution of accessibility complaints and protects individuals who submit a complaint, assist another person, or participate in the complaint-resolution process from retaliation. It also authorizes the ADA/Section 504 Coordinator or designee to coordinate the City’s
review and response.
The policy would be adopted by the City Council as Exhibit A to Resolution No. 1423 (Attachment B).
ADA Complaint Procedures and Complaint Form
To implement the policy, staff has prepared administrative complaint procedures and an optional complaint form (Attachment C). Approval of these materials is not being requested; they provide administrative guidance for the complaint process and are being presented to the City Council for its information.
Individuals are not required to use the complaint form and may submit a complaint through an accessible alternative method, as described in the procedures and on the form. To facilitate public access, the complaint procedures and form will be posted on the City’s website and made available at City Hall.
Designated ADA/Section 504 Coordinator
The City has designated an ADA/Section 504 Coordinator to coordinate the City’s accessibility compliance efforts and the review of complaints. The Coordinator’s responsibilities include:
• Receiving and coordinating the investigation of ADA/Section 504 complaints; • Working with appropriate City staff to respond to accessibility concerns; • Coordinating compliance with applicable ADA/Section 504 program and service requirements; and
• Maintaining records of complaints and resolutions in accordance with the City’s recordsretention schedule.
Fiscal Impact:
None.

Related Administrative Policy: ADA/Section 504 Nondiscrimination & Complaint Policy Administered By: ADA/504 Coordinator
Approved By: City Manager
Effective Date: 9/14/26
Last Revised: 9/14/26
1. Purpose and Scope
This administrative procedure implements the City's ADA/Section 504 Nondiscrimination and Complaint Policy and provides for the prompt and equitable resolution of complaints alleging discrimination on the basis of disability or the denial of equal access to City programs, services, activities, or facilities.
This procedure is intended for members of the public, including applicants, participants, beneficiaries, visitors, and other individuals who believe they have experienced disability discrimination or an accessibility barrier involving a City program, service, activity, or facility.
Employment-related disability discrimination complaints involving City employees or applicants for City employment are addressed through the City's applicable personnel or employment procedures.
The City encourages individuals to contact the ADA/504 Coordinator when an accessibility concern arises.
An individual is not required to file a formal complaint before contacting the City regarding an accessibility concern.
2. Who May Submit a Complaint
Any individual who believes they have been subjected to discrimination on the basis of disability or denied equal access to a City program, service, activity, or facility may submit a complaint.
A complaint may also be submitted by an authorized representative on behalf of another individual.
3. Methods for Submitting a Complaint
A complaint may be submitted to the ADA/504 Coordinator by email, mail, telephone, in person, through the City's ADA/Section 504 Complaint Form, or through another accessible method.
Use of the City's ADA/Section 504 Complaint Form is optional.
An email, letter, or other communication containing sufficient information for the City to understand and investigate the complaint will be accepted as a complaint. A complainant will not be required to resubmit the same information on the City's complaint form solely because the information was initially provided by another method.
Rev. 9/14/26 Page 2 of 6 ADA/Section 504 Complaint
Procedure & Form
The City will provide reasonable accommodations and accessible alternative methods for submitting a complaint when needed because of a disability. Assistance in preparing or submitting a complaint is available from the ADA/504 Coordinator.
A complaint should provide, to the extent known or available:
• the complainant's name and preferred method of contact; • a description of the alleged discrimination or accessibility concern; • the date and location of the occurrence, if applicable; • the City program, service, activity, facility, or department involved, if known; and • the resolution or corrective action requested, if known.
A complaint will not be rejected solely because all requested information has not been provided when sufficient information is available for the City to understand and investigate the complaint.
4. Time for Submitting a Complaint
Complaints should be submitted as soon as reasonably possible following the alleged discrimination or accessibility issue and generally within 60 calendar days of the occurrence.
The ADA/504 Coordinator may accept a complaint submitted after 60 calendar days when good cause exists, including disability-related circumstances or other circumstances that reasonably affected the individual's ability to submit the complaint within that period.
5. Acknowledgment
The ADA/504 Coordinator or designee should acknowledge receipt of the complaint within 15 calendar days.
The acknowledgment should provide contact information for questions regarding the complaint and may request additional information when reasonably necessary to investigate or resolve the matter.
Acknowledgment of a complaint does not require a meeting with the complainant.
6. Review and Investigation
The ADA/504 Coordinator or designee will review the complaint and conduct an appropriate investigation.
The Coordinator may communicate with the complainant and consult with appropriate City departments, employees, witnesses, legal counsel, contractors, or other individuals as reasonably necessary to understand, investigate, and resolve the complaint.
A meeting or interview with the complainant may be offered or conducted when it would assist in understanding or resolving the complaint but is not required in every case.
The City may seek informal or early resolution when appropriate. Participation in informal resolution does not prevent a complainant from continuing through the complaint process if the matter is not resolved.
7. Determination and Response
Following review and investigation, the City will provide the complainant with a written determination or other accessible response appropriate to the individual's communication needs.
The determination should explain the City's findings or position and, when appropriate, identify actions taken or proposed to resolve the complaint.
The City should generally provide its determination within 30 calendar days following acknowledgment of the complaint or receipt of reasonably necessary additional information.
Rev. 9/14/26 Page 3 of 6 ADA/Section 504 Complaint
Procedure & Form
When additional time is reasonably necessary to complete the investigation, the City should notify the complainant and provide an updated anticipated response date.
8. Administrative Review
A complainant who is dissatisfied with the City's determination may request further administrative review.
A request for review should generally be submitted within 15 calendar days following receipt of the City's determination. Additional time may be provided when warranted by disability-related or other reasonable circumstances.
To the extent practicable, the administrative review should be conducted by an appropriate City official or designee who was not responsible for making the initial determination.
The reviewing official may obtain additional information from the complainant, City staff, or others when reasonably necessary to complete the review.
The City will communicate its final determination in writing or through another accessible format or communication method appropriate to the complainant.
9. Accessible Communication and Assistance
The City will provide reasonable accommodations, appropriate auxiliary aids and services, accessible formats, and accessible alternative communication as necessary to provide individuals with disabilities an equal opportunity to participate in the complaint process.
Depending upon individual needs and circumstances, methods may include accessible electronic formats, large print, Braille, audio, telecommunications relay services, or other effective methods of communication.
Requests for a particular auxiliary aid, service, format, or communication method will be addressed in accordance with applicable ADA effective communication requirements.
10. Retaliation
The City prohibits retaliation, coercion, intimidation, threats, or interference against any individual for exercising rights protected by the ADA or Section 504, submitting a complaint, assisting another individual with a complaint, or participating in an investigation or complaint-resolution process.
11. Information Associated With Complaints
Information obtained in connection with an ADA/Section 504 complaint will be handled with appropriate sensitivity and may be shared with appropriate individuals as reasonably necessary to investigate, respond to, or resolve the complaint or as otherwise required or permitted by law.
The City does not guarantee complete confidentiality of complaints or information submitted during the complaint process.
12. Records
Records associated with ADA/Section 504 complaints, investigations, determinations, administrative reviews, and resolutions will be maintained in accordance with the City's applicable records-retention policies and legal requirements.
13. Other Complaint Rights
Use of the City's complaint procedure does not prevent an individual from pursuing other available remedies or filing a complaint with an appropriate federal or state agency. Use of the City's complaint procedure is not a prerequisite to exercising other rights available under applicable law.

Subject: Consideration of an Advertisement in the Peninsula Symphony’s 60th Season Program Book
Background:
The City received a request from the Peninsula Symphony to purchase an advertisement in its upcoming 60th Season Program Book (Attachment A). The Peninsula Symphony shared that all four Peninsula cities have supported its program book in the past and that Rolling Hills is currently the only Peninsula city that has not yet committed to an advertisement. The City Council considered and approved a similar request in support of the Symphony’s 57th season in 2023 (Attachment B).
For six decades, the Peninsula Symphony has served the Peninsula and surrounding South Bay communities by presenting four free, high-quality concerts each year at Redondo Union High School.
Its orchestra and Board are composed largely of Peninsula residents, including professional musicians and individuals from a wide range of professional backgrounds. The organization is sustained by dedicated volunteers, local musicians, donations, and community support.
The Peninsula Symphony has also received generous support from Rolling Hills residents over the years, including the late Bee Allen and Dorothy Lay.
Discussion:
The Peninsula Symphony is requesting that the City support its 60th season by purchasing an advertisement in its program book. A quarter-page advertisement costs $250. Purchasing the advertisement would recognize the Symphony’s milestone anniversary and demonstrate the City’s support for a long-standing community organization that provides free concerts to residents throughout the Peninsula and South Bay.
The City Council may approve the purchase of a quarter-page advertisement or provide alternative direction to staff.
Fiscal Impact:
The cost of a quarter-page advertisement is $250. Although this expense was not specifically included in the Fiscal Year 2026–27 Budget, sufficient funds are available in the City’s miscellaneous
expenditure account. Alternatively, the City Council may direct staff to return with an appropriate budget amendment.
Recommendation:
Provide direction to staff.
