The misallocated sales tax and transaction and use tax identified by MuniServices, LLC's audit and recovery services were significantly higher than initially projected. Ordinances (for introduction and adoption - appropriation/urgency measures)

7.35. Crimson Ridge Park (CO-62) Reimbursement – Budget Adjustment Memo from the Park Planning & Development Superintendent Tara Gee and Parks, Recreation & Libraries Director Jill Geller recommending the City Council adopt ORDINANCE NO. 6503 AUTHORIZING CERTAIN AMENDMENTS TO THE FISCAL YEAR 2021-22 BUDGET AND DECLARING THIS

ORDINANCE TO BE IMMEDIATELY EFFECTIVE AS AN APPROPRIATION MEASURE. On August 2, 2021, City Council approved a Park Development Agreement (PDA) between the City and Lennar Homes in which the City agreed to reimburse Lennar Homes $248,803 for paid neighborhood park fees collected prior to the approval of the PDA. Typically, park fee credits are given to offset the up-front costs for the developer to construct a park early. Since Crimson Ridge Park was originally to be constructed by the City, neighborhood park fees were collected. Lennar Homes subsequently sought to build the park “turn-key”. This prompted the need for a PDA. In the PDA, the reimbursement amount of $248,803 is triggered when a payment bond has been secured. On May 17, 2022, a letter was received which confirmed that a payment bond has been posted. The letter also formally requested reimbursement. If approved, funding is provided through the Campus Oaks Neighborhood Park Fund. There will be no General Fund impact.

BUDGET AND DECLARING THIS ORDINANCE TO BE IMMEDIATELY
EFFECTIVE AS AN APPROPRIATION MEASURE. Staff requests Council approval of an internal transfer of land from the Parks, Recreation and Libraries Department to the Environmental Utilities (EU) Department.

The transfer includes
property contained in eight City-owned parcels and supports development of five of the City’s planned Aquifer Storage and Recovery production well and pump station facilities and for land adjacent to a monitoring well. 7.38. Mobile Message Board - Budget Adjustment

Water Conservation Administrator Bobby Alvarez and Environmental Utilities Director Richard Plecker recommending the City Council adopt ORDINANCE NO. 6508 AUTHORIZING CERTAIN AMENDMENTS TO THE FISCAL YEAR 2021-22 BUDGET AND DECLARING THIS ORDINANCE TO BE IMMEDIATELY EFFECTIVE AS AN APPROPRIATION MEASURE.

Staff
requests Council approve a budget adjustment to fund the purchase of a mobile messaging board through the Fleet Replacement Fund for the Water Efficiency Section of the Water Utility Division. The board will be used to advertise drought messaging, events, and water saving reminders throughout the year. This budget adjustment requests an increase in the Water Efficiency Section budget of $19,054 to fully fund the cost of the mobile messaging board. That amount will be paid to the Fleet Replacement Fund, which purchases City vehicles. This will result in a decrease in the Water Operations Fund’s available resources of $19,054. The future rent and replacement for this vehicle (approximately $3,000 for the next fiscal year) will be paid for via appropriations in the FY2022-23 Water Operations Fund budget. The Water Operations Fund receives revenue from water utility sales.
