8. ORDINANCES

8.1. Roseville Municipal Code Amendment – Regulations for Fireworks Memo from Senior Deputy City Attorney Travis Cochran and City Attorney Michelle Sheidenberger recommending the City Council introduce for first reading ORDINANCE AMENDING SECTION 16.16.140 OF CHAPTER 16.16 OF TITLE 16 OF THE ROSEVILLE MUNICIPAL CODE REGARDING
REGULATIONS FOR FIREWORKS. The proposed revisions to Section

16.16.140 build upon the changes adopted by the City Council last year, and will
make the ordinance clearer and allow for better and more efficient enforcement against illegal fireworks. Specifically, the revised ordinance clarifies that the term “possession” of prohibited fireworks includes actual, constructive, or joint possession; expands the concept of “host liability” to include the street and/or sidewalk that is immediately adjacent to the host’s property as well as any other property where a host is exercising apparent control of the property; and clarifies that each individual prohibited firework constitutes a separate violation of the Roseville Municipal Code. There is no direct fiscal impact associated with the proposed ordinance, although the proposed changes may lead to higher numbers of administrative citations being issued for fireworks violations and/or more successful collection of the corresponding fines.
