Description/Analysis

Issue Detail: Per City Charter section 31, the city council shall hold regular meetings and provide the time, place, and manner of holding its meetings, by annual resolution. A majority of regular council meetings shall be held after 5:00 p.m. All meetings of the council shall be open to the public, except as permitted by state law.

On November 16, 2021, City Council (R2021-0337), Housing Authority (R2021-0023), Financing Authority (R2021-0001), Public Financing Authority (R2021-0001) and Redevelopment Agency Successor Agency (R2021-0002) approved their 2022 regular meeting schedules. Since that time, there has been a request for four additional SHRA-focused meetings for City Council and the Housing Authority, for a total of eight SHRA-focused meetings, to be held at 2:00 p.m. on January 11, 2022, March 8, 2022, April 12, 2022, May 10, 2022, June 14, 2022, September 13, 2022, October 11, 2022, and December 13, 2022. The addition of these meetings revised the previously approved 2022 regular meeting schedules for the City Council and its concurrent legislative bodies, Housing Authority, Financing Authority, Public Financing Authority and Redevelopment Agency Successor Agency. As such, revised 2022 regular meeting schedules are attached for consideration.

Also, on November 16, 2021, City Council passed Motion No. 2021-0317, approving the 2022 standing committees and boards, commissions and committees meeting schedules. Since that time, the 2022 Water Committee regular meeting schedule has been revised and is attached for consideration; the revised schedule reduces the regular meetings from six to four (1:00 p.m. on February 8, 2022, May 24, 2022, August 9, 2022, and November 29, 2022). The Animal Care Services Citizens Advisory Committee 2022 regular meeting schedule was not available for inclusion with the November 16 package and is included here for consideration, with meetings on the 2
nd Wednesday of each month (except during July and December) at 5:30 p.m.

The attached meeting schedules also include the following Winter and Summer Recesses.

Policy Considerations: Approving an annual meeting schedule of legislative bodies is consistent with City Charter section 31, the Council Rules of Procedure, the Brown Act, and the requirements of the Financing Authority legal counsel.

Commission/Committee Action: City Council and the Housing Authority are adopting separate resolutions for their respective revised 2022 meeting schedules and are included as attachments to this report. Additionally, it is requested City Council approve the 2022 revised meeting schedule for the Water Committee and the 2022 meeting schedule for the Animal Care Services Citizens Advisory Committee.

Rationale for Recommendation: Per the City Charter, meetings are generally held on the designated Tuesdays of the month, with Council, Financing Authority, Housing Authority, Public Financing Authority, and Redevelopment Agency Successor Agency sitting concurrently as noted on the agenda and minutes. The standing committees also generally meet on Tuesdays and the boards, commissions, and committees meet as indicated.

Adopted by the Sacramento City Council

Approving the 2022 Meeting Schedule for City Council and Rescinding Resolution No. 2021-0337

BACKGROUND

A. The Brown Act requires that legislative bodies, except for advisory bodies and standing committees, provide the time and place for regular meetings by ordinance, resolution, bylaws, or by whatever other rule is required for the conduct of business by that body.

B. Per City Charter section 31, the City Council shall hold regular meetings and provide the time, place, and manner of holding its meetings by annual resolution. A majority of regular council meetings shall be held after 5:00 p.m. All meetings of the council shall be open to the public, except as permitted by state law.

C. On November 16, 2021, City Council adopted Resolution No. 2021-0337, approving the 2022 City Council Meeting Calendar. The meeting calendar has since been revised to add four additional SHRA focused meetings as proposed in Exhibit A.

BASED ON THE FACTS SET FORTH IN THE BACKGROUND, THE CITY COUNCIL RESOLVES AS FOLLOWS:

Section 1. Resolution No. 2021-0337 is hereby rescinded.

Section 2. The City Council 2022 meeting schedule as shown in Exhibit A of this resolution is approved.

Adopted by the Sacramento City Financing Authority

Establishing the Date, Hour and Place of the Holding of the 2022 Regular Meetings of the Governing Board of the Sacramento City Financing Authority

BACKGROUND

A. The Sacramento City Financing Authority (the “Authority”) is a joint exercise of powers authority duly organized and existing under and by virtue of the Joint Exercise of Powers Act, comprising Articles 1, 2, 3 and 4 of Chapter 5 of Division 7 of Title 1 (commencing with Section 6500) of the Government Code of the State of California (the “Act”) and a Joint Exercise of Powers Agreement, dated as of October 1, 1989, as amended and supplemented (the “Agreement”), by and between the City of Sacramento (the “City”) and the City’s former redevelopment agency.

B. As set forth in the Agreement, the Authority is administered by a governing board (the “Board”) consisting of the members of the City Council of the City ex officio.

C. The Agreement provides that the Board shall hold at least one regular meeting each year, and, by resolution, may provide for the holding of regular meetings at more frequent intervals.

D. The Agreement requires the Board to fix, by resolution, the date upon which, and the hour and place at which, each regular meeting of the Board shall be held.

E. The Board has determined to fix the date upon which, and the hour and place at which, regular meetings of the Board shall be held as set forth below.

F. On November 16, 2022, the Financing Authority adopted Resolution No. 2021-0001, approving the 2022 Meeting Schedule for the Sacramento City Financing Authority.

Since then, four additional meetings have been added for SHRA-focused meetings for the Housing Authority as proposed in Exhibit A which also revises the Financing Authority meeting schedule.

BASED ON THE FACTS SET FORTH IN THE BACKGROUND, THE SACRAMENTO CITY FINANCING AUTHORITY RESOLVES AS FOLLOWS:

Section 1. The Authority hereby finds and determines that the statements in paragraphs A through F of the Background are true.

Section 2. The Board hereby fixes the date upon which, and the hour and place at which, regular meetings of the Board shall be held as follows: regular meetings of the Board shall be held on each date and at the same hour and place as regular meetings of the City Council of the City; provided, that, with respect to any such regular meeting, if the Secretary of the Authority has not received a request from an officer of the Authority for any item of business to be considered and therefore no agenda is posted for such regular meeting, as required by Section 54954.2 of the California Government Code, then such regular meeting shall be deemed cancelled.

Section 3. All actions heretofore taken by any member of the Board or by any officer of the Authority and other appropriate officers and agents of the Authority with respect to the matters herein set forth are hereby ratified, confirmed and approved.

Section 4. Sacramento City Financing Authority Resolution No. 2021-0001 is hereby rescinded.
