I request the revised ordinance continue to reflect State law mandating ADUs by right:

1. No more than 800 square feet of detached ADUs exempt from lot coverage requirements,

2. Maximum floor area is the great of 50% of the primary unit or 800 sq feet (1 or less bedrooms) or 1000 (2 or more bedrooms),

3. All side and rear yard setbacks must be at least four feet, and

4. Require one onsite parking space per ADU.

Any deviations in setback, lot coverage or other requirements should be decided at a public hearing by the Planning Commission and City Council.

Increasing the size and footprint to 1200 sq feet makes ADUs larger than most of the primary units in our neighborhood.

This proposal will reduce open space between existing houses and trees and greenery, which have an environmental benefit, including cooling. Reducing setbacks to 0 because the unit is at the back of a lot ignores the impact on adjacent lots including reducing privacy and blocking light.

I have been trying to watch this meeting and be involved since 5:30pm, however the stream has been inconsistent with 10-15 seconds of audio/video, followed by 1-2 minutes of frozen audio/video. I am on a hardwired internet connection with 90Mbps internet speed and several of my neighbors have complained of the

I am Z. Wayne Johnson, elected President of the River Oaks Community Association. Our written opposition is in the Staff Report, but want to re-emphasize that our Association and majority of residences remain steadfastly opposed to ARCO alcohol sales of any sort. This position is consistent with the terms of ARCO's original permit to construct, has been revisited in recent times via several public meetings and a petition. There are sufficient other alcohol sales points within very short driving distance, we have not one but two schools in close proximity to ARCO, several nearby neighborhood parks, a homeless issue we have worked to humanely control, and recurrent problems with revelers at Sand Cove Beach. We urge this Commission to standby the pact initially reached with the community and ARCO, and reflect the continuing community concerns for the quality of life and security of our youths by denying this application.

We have lived in River Oaks/Willowcreek for 20 years.

We strongly oppose the sale of liquor and beer at the AM/PM on Orchard Lane. It is within a quarter mile of both an elementary school (Two rivers) and a middle school (Leroy Greene Academy). In addition, it is adjacent to the interchange with Interstate 80 and in close proximity of the major interchange of I-80 and I-5. Some have argued that alcohol is available at nearby establishments, so why not them? This actually is a good argument for denial.

The A-1 market at West El Camino and Gateway Oaks is less than 1/2 mile away. In addition, there are two Bel- Air grocery stores within less than 2 miles from this proposed liquor license. It is not in the community's best interest to have liquor sales in such proximity to schools and a major transit point. The need for alcohol sales is mitigated by availability close by. Liquor licenses are an important commodity of public trust. The argument in favor of this license is not compelling.

I support ARCO getting the beer & wine license. It will be very convenient for ARCO customers to purchase their beer and wine at the same place while stopping to fill gas.I don't believe that multiple packs of these beverages will create any public nuisance. It will also help business owner to help meet their ends.

I support this ARCO gas station getting their beer and wine license. Tobacco is sold at this location, the business has been responsible with that and has not had issues. I would not imagine it being any different with beer and wine. I have met the owners and they truly care about the image of the site. They deserve the opportunity to be able to sell beer and wine.

I oppose the request for an alcohol permit. Here is why - first, the school proximity issue. Several hundred children a day potentially walk or ride their bicycles a day near this place. Secondly, it makes no sense since we are still battling the COVID virus. Customers who shop there are very quick to get out of the store. They drive too fast to begin with. Which brings up another point and that is traffic.Y ou will get more cars and vehicles there if alcohol becomes available. This is an idea that is very bad for our community and urge a NO vote by the City Council. Thank you.

Alcohol sales at this location are completely in the interest of the business and in opposition to the community’s wants and needs. Upon learning of the recent development in the area, this community requested a grocery store, as currently the closest grocery store is 2 miles away and requires crossing one of the largest freeways in the state. In response, the community was not only denied a grocery store, but the ARCO station took the opportunity to pursue alcohol sales, a violation of their original agreement to operate in the neighborhood. Alcohol should not be more accessible than common basic needs, such as food. To not only deny the community of improved access to essential services, but then to bring alcohol sales into the neighborhood, is a smack in the face. If alcohol sales are approved, it will only attract transients with no care for the surrounding neighborhood, and community members will now be burdened with risk of drunk driving and public disturbances.

I live in the Willowcreek neighborhood and I see zero problems with the AMPM selling beer. We have a liquor store in the shopping scented down the street on W El Camino and a 7/11 is planned to be built right across the street from the AMPM. It doesn’t make sense for the AMPM as a business to be excluded from engaging in free market activity that is awarded to the liquor store down the street and the future 7/11 that will be in almost the exact same location.

Most all gas stations sell beer. Whats the problem? Cause schools are close? What like they have open campuses where the kids can just walk down and buy a 6 pack for lunch? No.. Why because it will attract drunks, drug addicts and deralicts? We live in Natomas, we have those people living here anyways. Come on people. Its really not that big of a deal, find a hobby....

As someone who for several years was a traffic and pedestrian safety practitioner for a California State agency, granting a license to sell beer and wine to an establishment this close to schools, crosswalks, playgrounds, etc should be opposed. The health risks to our children are far too great. Given the location, you’re also going to have increased foot and vehicle traffic, which infringes upon pedestrian safety. I would recommend a NO vote on this.

I am writing today to OPPOSE the conditional Use Permit for the sale of beer, wine (or anyi alcoholic beverage or product) to this business. The business is much too close to both Two Rivers Elementary and Leroy Greene Academy schools, and in my view would pose several hazards, including (but not limited to): 1) the potential for drinking while driving by customers of the establishment; 2) increased traffic near to both schools increases the likelihood for a vehicle crash near a school where schoolchildren are present; and 3) increase the potential for vagrancy in and around both schools.

I support this license. I want these people to get the beer/wine license. I have been living in the neighborhood for the past ten years and never had any issues. There are some people opposing this license assuming that the granting of this license will cause issues, however I don't see how this will cause issues. There is a protocol setup for the regulation of selling alcohol. I'm sure these guys will be checking id's when they are making transactions on the alcohol. People who are opposing the license act like they own the neighborhood. Everybody should have the right and ability to conduct their business the way they wish to. California has legalized Marijuana which can be delivered to your door, and now Lots of people are acting like beer/wine is going to be handed out like candy.

Obviously alcohol cannot be sold to minors. We should be supporting small businesses during this pandemic not go against them.

A-1 Mart located on the corner of Gateway Oaks and west el Camino sells liquor and alcohol. Literally this whole neighborhood is surrounded by establishments that serve and sell alcohol. I just received a printout from sac PD Crime Analysis which indicated 53 traffic related incidents btwn Gateway Oaks and Orchard Lane inc DUIs and accidents for 2020 and that was during Covid and that's just south of AM/PM. I oppose this location being able to sell alcohol, this location is too close to our local schools and will attract homeless people that have already tried setting up camp in the field west of the gas station. I have lived on Barandas Drive for 19 years. There is an elementary school and a middle/high school blocks from the AMPM that wants to sell alcohol. Children frequently are at this establishment purchasing snacks and drinks.

This location already has been robbed several times and there are homeless who are agressive that try to station here. We do not need to invite more issues to our neighborhood like drunk driving near our schools. There are several locations near by that already sell alcohol. We don't need one two blocks from an elementary school.

The original conditions of the permit to build the Arco AM/PM were approved on no alcohol being sold at all. I have written and made comments to both the ABC and City in objection to any alcohol sales. We have two schools in walking distance and have issues every summer with people parking in the neighborhood near Sand Cove and leaving trash all over. Alcohol sales at this location will only cause more issues. We already have 3

other locations alone this side of West El Camino to purchase alcohol. I support this businesses right to ask, but it is disingenuous to push for this and to ask for support from people that don’t live here and won’t be affected.

Alcohol sales at this location will create a public nuisance for the neighborhood. The store is locate too close to two schools and the store is heavily trafficked by school aged children. The store is currently a magnet for homeless people aggressively panhandling and harassing patrons. The homeless often consume alcohol on or near the premises. Allowing alcohol sales at this location would create safety concerns for the residents in the neighborhood and the patrons of the store. There are 4 locations within a half a mile where alcohol is available.

There is not a need for additional alcohol sales to be available in this community. This is actively being opposed by law enforcement and the Natomas School District. Supporters of this license clearly have no concern for the safety of community or children..

I fully support this location selling beer. It’s unfair that many other similar businesses in close proximity are allowed to sell beer and this business is not. The owners of this business have and are working hard and diligently to make sure that this place is well maintained and the customers are taken care of. Not giving this business an opportunity to sell beer would be a very biased decision.

I support this location selling alcohol. It doesn't make sense that the nearby stores have permits to do so, while this one does not. The schools are nearby the other locations that sell alcohol as well. As for the homelessness issue, I don't see how homeless people have the funds to purchase alcohol, nor how they would discover that this location would sell alcohol either. Invalid argument. The owners would not permit them to disturb or harass anyone nearby the location, let alone enter the premises if they do not intend on purchasing anything. The owners of this location are very friendly and have kids of their own who attend nearby schools/events as well, and would not make a decision to do something that would negatively impact their children's safety. They would not sell alcohol to underage kids. I do not see that danger in adding alcohol to the inventory.

I don't know why people opposing it saying there is two schools in the neighborhood, they not going to sell beer to the kids, they are not that stupid. I have two children that attend the nearby schools and the thought of more traffic, more panhandlers and homeless people causes me GREAT concern. Alcohol sales at this location will create a public nuisance for neighborhood. The store is heavily trafficked by school aged children. The store has been robbed several times and alcohol sales would create more opportunities to rob of cash and beer runs/thefts. The store is currently a magnet for homeless people aggressively panhandling and harassing patrons. Allowing alcohol sales at this location would create safety concerns for the residents in the neighborhood and the patrons of the store. There are 4 locations within a half a mile where alcohol is available. There is no need for additional alcohol sales to be

I oppose granting beer/wine license at this location. This location is in proximity of two schools and three parks. In addition, with the new developments at the Cove and Core, students will pass by this location daily. The ARCO has already attracted a public nuisance and safety issues to the neighborhood (evidenced by the numerous calls for service to police), and adding alcohol sales will only exacerbate this problem. This location is already a magnet for homeless people who camp nearby and loiter around the ARCO. Alcohol is already available at four other locations within a half mile to this location. The Natomas School District also opposes alcohol sales at this location.

Good morning! I live little more than a block from the Arco gas station and I oppose the licensing of alcohol sales there, for a few reasons. First, I it will create a public nuisance for the neighborhood. The store is very close to two schools and the store is heavily trafficked by school aged children all days of the week. This Arco is right next to and across the street from residential neighborhoods. There are also 2 schools in closs proximity. There are several other places a short distance away that sell alcohol. Allowing Arco to sell beer will encourage more homeless in the area, which has already been a problem with the vacant land next to the Arco.

Granting this license will adversely impact the quality of life for the residents in the area. Therefore, I am opposed to allowing beer sales at this Arco.

I support AMPM being able to sell beer at this Orchard Lane location. I have not seen the rampant homelessness congregating at this location that others have claimed. By forcing people that want to get a beer (which you can get pretty much everywhere else) to go down the street to the A1 Mart where there is more panhandling and problems is ridiculous. Let this business sell beer so that they can compete with other similar businesses that are able to sell these additional items.

ROCA urges the Commission to read our latest response in your packets. It responds to some misconceptions voiced at the last hearing, and corrects some misstatements by the applicant. We are not opposed to alcohol sales overall, evidenced by existing locations. This particular intersection is directly close to 2 schools, athletic fields and 3 parks for daytime, after school, evening and weekend activities. Our Association members regularly clean up bottles, cans, needles and other refuse now that the requested sales are likely to aggravate. We live there and deal with it. Majority of our residents DO NOT live in gated developments, and are not affluent. We represent the full spectrum of ethnicities, religions and economic levels. I really appreciate having the Arco in the neighborhood; however, the proximity to multiple schools is extremely concerning. With the construction of additional housing across El Camino, there will be increased foot traffic across this location by kids. In addition, city records indicate that, in 2018 alone, the store was the site of multiple disturbances, assault, and calls for assistance, and robbed on January 23, April 22, November 21, December 28.

It should also be noted that this business’s original permit was conditioned on not selling alcohol.

I live in Willowcreek and I fully support AMPM getting a permit to sell beer/wine. I do not foresee any negative impact to the neighborhood with the support of this measure. The arguments opposed to the measure are weak, and a convenience store selling beer and wine will not increase crime in the neighborhood like some people oddly speculate. The AMPM is an honest, tax paying business, and the owners should not be excluded from participating in the free market that other nearby businesses are able to participate in (ex. A1 market, 49er truck stop). Those in opposition need to focus on real issues in the neighborhood such as people selling illegal drugs next to Two Rivers, and should stop worrying about a tax paying business selling a legal product.

Please reconsider your decision to support. I remain opposed to another gas station selling alcohol to drivers. As staff told you, it is too close to nearby schools and parks to be in compliance with city policy. Since the last meeting had such fatal technological issues, you couldn't hear from all the community, and the community couldn't witness your decision. Please put on the record your rationale for supporting alcohol sales in a location that is strongly opposed by the neighborhood and the staff. Be sure those supporting this live in 95833 and are not just friends of the owner. Thank you.

It is california and i think its common saying that "Y ou can’t be a real country unless you have a beer and an airline — it helps if you have some kind of a football team, or some nuclear weapons, but at the very least you need a beer." So please raise your voice to get lisence for this convinient store for all of us! Thanks

I represent the Friends of Natomas, an ad-hoc group of parents in the neighborhood, and we adamantly OPPOSE the approval of an alcohol license for this business. We are not anti-business at all. However, we take issue with the location of the gas station's proximity to our local schools and park areas. This is where our children play, and with summer around the corner, we believe it would not be in their best interests to have yet another business allowed to sell alcohol. We would support this beautiful gas station to sell beer and wine at this location. They run a very good business and the store is clean and gives great Service. We would like to support local small businesses.

Thank you
