Description/Analysis

Issue Detail: The City provides residential garbage collection, recyclable materials pickup, yard waste/organics pick up, and street sweeping through its Recycling and Solid Waste (RSW) Division. Costs for these services are covered by monthly rates assessed on residential customers that are adjusted every few years based on the projected cost of services. The current rates were approved by the City Council in December 2019 to cover anticipated RSW costs for the following one and one-half years.

Projections for future costs to provide services demonstrate the need for higher rates to cover anticipated costs, including approved cost of living/inflationary cost increases, new state requirements to divert organic waste from the landfill stream and treat it separately, increased costs associated with reduced markets for recyclable materials, and other regulatory requirements. Affected customers have been notified of the proposed rate increase and related public hearings. If approved, rate adjustments would become effective on April 1, 2022, January 1, 2023, and January 1, 2024.

Policy Considerations: On October 4, 2021, the City mailed a notice to all affected property owners and tenants to provide notification of the proposed rate increase and of a public hearing on the proposed rates with the Utilities Rate Advisory Commission (URAC) on November 17, 2021. The California Constitution requires the notice to be mailed at least 45 days prior to the public hearing. The notice included instructions on protest procedures and informed customers that the proposed rate increase may not proceed if a majority of the affected property owners formally protest in writing or at the public hearing.

Under Proposition 218, utilities are limited to charge rates sufficient to recover the cost of providing utility services. The rate model was developed based on these principles.

Economic Impacts: Not applicable

Environmental Considerations:

California Environmental Quality Act (CEQA): The adoption of recycling and solid waste rates is exempt from CEQA review under Public Resources Code Section 21080(b)(8).

Sustainability: The Recycling and Solid Waste Division implements numerous programs to reduce waste going into landfills, including collecting recyclables, green waste, and providing recycling and composting education programs.

Much of the proposed rate increase is needed to implement new state requirements to recycle food waste and food soiled paper (organics) in order to keep these methane generating materials out of landfills.

Commission/Committee Action: On November 17, 2021, the URAC held a public hearing on the proposed recycling and solid waste rate changes. At the conclusion of the public hearing, the URAC approved staff’s recommendation by a 4-0 vote.

At the time of the public hearing, 195 written and public hearing protests were validated and reported to the URAC, representing less than one percent of the parcels that will be subject to the proposed rates. Attached as Exhibit C are the Proposition 218 protest results.

Adopting property-related fees or fee increases that require public notice before the URAC does not require Law and Legislation Committee review, pursuant to the Council Rules of Procedure (Chapter 13, section (B)(1)(b)(vi)).

Rationale for Recommendation: The proposed rate adjustments are necessary to recover operating expenditures and achieve at least a 90-day operating reserve, which is necessary to address any unexpected changes and respond to emergencies. The recommended adjustments achieve the following rate stabilization objectives:

1. Ensure Proposition 218 compliance by charging what it costs to provide services;

2. Closing the gap between revenues and expenditures by commodity; and

3. Achieve a prudent reserve level of ninety (90) days.

Financial Considerations: Rates were generated based on the cost modelling of actual and projected costs associated with providing services for the next three years. Residential waste collection and disposal services are fully covered through ratepayer fees. If the rate adjustment is approved, the Solid Waste Fund (Fund 6007) is projected to have sufficient funding to deliver services and retain a prudent reserve for emergencies. If rates are not adjusted at this time, a larger increase will be necessary later. At current rates, if no action is taken, it is estimated that the Solid Waste Fund will be insolvent by Fiscal Year (FY) 2025/26.

In addition to the direct impacts to the Solid Waste Fund (Fund 6007), there are also indirect impacts that may lead to future pressure to the General Fund. Specifically, the Sacramento Utility Rate Assistance (SURA) program, which utilizes General Fund resources. The projected RSW fee increase can be absorbed by the existing SURA budget if the current discount rate is decreased to 25% and if the participant level remains at 8,500. The Department of Utilities is requesting City Council approval to decrease the SURA discount rate to 25% (Report 2021- 01356), which will be heard by the Budget and Audit Committee.

The Department of Utilities will return to City Council for direction if the SURA program becomes financially unsustainable.

Local Business Enterprise (LBE): Not applicable

Background: RSW continues to maximize efficiency while controlling and minimizing costs. If an adjustment is delayed it will result in the need for a larger adjustment later.

The tables below show the 5-Year Solid Waste Fund Summary without and with the proposed rate adjustment.

If approved, a series of rate adjustments would become effective on the following dates: April 1, 2022, January 1, 2023, and January 1, 2024.

The proposed rate adjustment is necessary due to the following factors:

1. A 100% increase in yard waste/organics processing cost related to the implementation of Senate Bill 1383 (SB1383), which requires separation of food waste and organics from the garbage collection and disposal stream.

2. Increased cost for processing recyclables because of global recycling challenges and reductions in markets for recyclables in foreign markets.

3. Maintenance of a prudent 90-day operating fund reserve.

4. The City’s need for additional routes by adding 13 additional vehicles and drivers.

Enhanced Services and Benefits

As a result of new rates, the following enhanced services and environmental benefits will be realized:

1. Food Waste Recycling – Food waste and food soiled paper (organics) will be incorporated into residents’ yard waste containers beginning in July 2022, removing these methane-generating materials from landfills and processing organics (yard waste plus food waste) into compost, advancing the objective of reducing greenhouse gases.

2. Tenant Household Junk Pickup – RSW will expand household junk appointments to tenants, not just owners, for up to two household junk appointments per year.

3. Maintenance of 4-week street sweeping service (implementation in Spring 2022) that helps keep pollutants out of area waterways through runoff.

4. Ability to adequately respond to increases in garbage, recycling, and household junk pick up requests with more people telecommuting and spending more time at home, with associated higher levels of waste generation at home.

5. Long-term replenishment of the RSW reserve fund to a minimum 90-day safety net for garbage, recycling, yard waste/organics, and street sweeping should there be additional circumstances, like the pandemic, or a natural disaster that compromise the ability for the City to perform essential services.

Efficiencies

RSW continues to generate operational efficiencies and reduce costs by:

1. Funding a vehicle replacement program to replace vehicles at the end of their useful life, reducing vehicle maintenance costs.

2. Completing a citywide re-route and re-organization from 4-day/10 hour to 5-day/8-hour workweek in February 2021 to balance collection routes that have become unbalanced.

3. Expanding public education and outreach programs to reduce contamination and improve the diversion rate from the 51.2% reported in Calendar Year 2020.

4. Maintaining a safety officer to reduce employee injury and proactively address safety issues.

5. Constructing a compressed natural gas station at the Meadowview Corporation Yard that will reduce drive time, increase productivity, and reduce the City’s carbon footprint.

6. Purchasing and testing an electric refuse collection vehicle to determine the viability for broader use and implementation.

7. Completing yard waste/organics agreements with three vendors, up to 5+ years in length with facilities geographically located closer to city routes. While higher processing fees, there are less vehicle miles travelled.

While RSW continues to take steps to reduce costs and implement operational efficiencies, rate adjustments are periodically necessary to align revenues with expenditures and to expand operations to adjust for regulatory compliance and citywide growth.

Outreach

This rate proposal was included in the Proposition 218 rate change mailing sent to City recycling and solid waste utility service customers on October 4, 2021. Under Proposition 218, the owner of record or the tenant of a parcel subject to the proposed rate may submit a written protest against the proposed changes. If written protests are filed by a majority of the affected parcels, the proposed rate changes will not be imposed. The written protests received are summarized in Exhibit C.

As part of the rate adjustment process, RSW has conducted extensive public outreach to the community about its services, financial status, need for rate adjustments, and how funds will be used.

RSW offered presentations to more than 90 neighborhood associations and was invited to over 25 neighborhood meetings across the eight City Council districts. In addition, RSW provided outreach flyers, newsletter articles, and social media content to local organizations for inclusion in their membership communication channels. RSW’s web page www.sacrecycle.org features information about the proposed rate adjustments. There are also links to the URAC meetings and rate workshops, with supporting documents accessible on the website. The rate proposal fact sheet and social media content was published on the City’s Facebook and Twitter platforms.

The required Proposition 218 notice about the rate adjustment and public hearing was mailed to 139,523 customers. Information was provided in Spanish, Chinese, Vietnamese, and Russian on how to access more information in native languages through an interpreting service.

Staff is recommending a three-year rate adjustment cycle that recovers operating costs and achieves at least 90-days of operating reserves. Below is the rate information that was included in the Proposition 218 Notice.

ORDINANCE NO.

Adopted by the Sacramento City Council

Date Adopted

AN ORDINANCE AMENDING THE CITY OF

SACRAMENTO FEE AND CHARGE REPORT

FOR RECYCLING AND SOLID WASTE RATES

BE IT ENACTED BY THE COUNCIL OF THE CITY OF SACRAMENTO:

SECTION 1.

The Sacramento City Council makes the following findings:

A. Articles XIIIC and XIIID of the California Constitution (Proposition 218) establish procedures for the approval of taxes, assessments, and property-related service fees by local government agencies.

B. Prior to the imposition or increase of recycling and solid waste rates that are “property-related service fees,” within the meaning of Proposition 218, Proposition 218 required that a notice describing the proposed fee or fee increase and establishing a date, time, and location of a public fee or fee increase hearing(held not less than 45 days after the notice is mailed), be mailed to the record owner of each parcel subject to the proposed fee or fee increase.

Under sections 13.02.040(C) and 3.44.100(B) of the Sacramento City Code, for fee or fee increase proposed by the City of Sacramento, the public hearing is held by the City’s Utilities Rate Advisory Commission.

C. Proposition 218 required that all protests filed against the proposed fee increase be considered at the public hearing. The agency may not approve the fee increase if written protests against the proposed fees are presented by a majority of owners of the affected parcels.

D. On October 4, 2021, the City mailed a notice to all owners of property subject to the City’s recycling and solid waste service rates. The notice: (i) described proposed rates and service changes for the City’s recycling and solid waste rates and service changes to take effect on April 1, 2022, January 1, 2023, and January 1, 2024, respectively; (ii) provided the date, time, and location of the

Page 9 of 16 ends

public hearing when these proposed rates would be heard by the City’s Utilities Rate Advisory Commission; and (iii) provided notice that an owner or tenant had the right to file a written protest against the proposed rates at or before the time set for public hearing.

E. The Utilities Rate Advisory Commission held the public hearing on November 17, 2021 and considered all protests against the proposed rates as well as all testimony and other information presented by City staff and members of the public.

F. As of the date and time of the public hearing, the number of written protests received against the proposed recycling and solid waste service rates was less than a majority of record owners or tenants of the parcels that will be subject to the proposed rates.

G. Upon conclusion of the public hearing, the City’s Utilities Rate Advisory Commission approved the recommendation to the City Council relative to the proposed increases to the recycling and solid waste service rates.

H. The City Council has considered the Utilities Rate Advisory Commission’s recommendations and all other information presented to it and in the public record, and finds that the recycling and solid waste service rates approved and imposed in Section 2 of this ordinance do not exceed the reasonable costs of providing these services, and that the revenues derived from these recycling and solid waste service rates will not exceed the funds required to pay the costs of providing recycling and solid waste services.

I. Based on the information presented to it and upon all information in the public record, and pursuant to Public Resources Code section 21080(b)(8), the City Council finds that the approval and imposition of the recycling and solid waste service rates in Section 2 of this ordinance are exempt from the California Environmental Quality Act, and finds that the rates are for the purpose of:

1. Providing funds to meet operating expenses, including employee wage rates and fringe benefits;

2. Permitting the generation of necessary cash flow to meet financial reserve needs and requirements; and

3. Funding the purchase or lease of necessary supplies and equipment for providing the recycling and solid waste services.

SECTION 2.

The recycling and solid waste service rates shown on Exhibit A, to take effect on April 1, 2022, are hereby approved and imposed. The City of Sacramento Fee and

Page 10 of 16 ends

Charge Report is amended to include the recycling and solid waste service rates shown on Exhibit A, which is incorporated herein by this reference.
