Description/Analysis

Issue Detail: On March 4, 2021, the George Sim Community Center had a fire in the historical side / multipurpose room (C900) and in the kitchen and restrooms. Although the building’s fire suppression system worked properly and quickly put out the fire, the building sustained substantial fire, smoke, and water damage. The City retained John F. Otto, Inc., DBA Otto Construction (Otto) for the following activities: 1) make the site structurally safe and remove all of the fire and water damaged materials; 2) provide design-build services, using design consultants to prepare engineered construction documents for repairing the damaged areas back to pre-fire condition; and 3) perform necessary construction to return the area to pre-fire condition.

The Department of Public Works drafted an emergency contract with Otto (Contract No. 2021- 0563) to address the George Sim Community Center fire damage. The sum for the first two phases came to $242,725. This fell within the City Manager’s authority and did not require City Council approval. In addition to contracting with Otto, the City also contracted with Service Master to provide site cleanup and smoke removal. Even though the remainder of the building did not suffer direct damage, there was extensive smoke throughout the building which required cleanup.

Phase three of the project includes the required construction to repair the fire damaged area.

Otto provided a proposal for the repair of the fire damage totaling $916,966. This results in a change order to the original emergency contract (Contract No. 2021-0563). With this action, the total not-to-exceed contract total will be $1,159,691.

Policy Considerations: The recommendations in this report to ratify the emergency construction contract already entered into and executed with Otto are in accordance with the provisions of City Code Chapter 3.60.70.

Economic Impacts: Change Order No. 1 to Contract No. 2021-0563 with Otto is expected to create 6.97 jobs (4.31 direct jobs and 2.48 jobs through indirect and induced activities) and create $895,437 in total economic output ($573,998 of direct output and another $321,439 of output in indirect and induced activities).

The indicated economic impacts are estimates calculated using a calculation tool developed by the Center for Strategic Economic Research (CSER). CSER utilized the IMPLAN input-output model (2009 coefficients) to quantify the economic impacts of a hypothetical $1 million of spending in various construction categories within the City of Sacramento in an average one- year period. Actual impacts could differ significantly from the estimates and neither the City of Sacramento nor CSER shall be held responsible for consequences resulting from such differences.

Environmental Considerations:

California Environmental Quality Act: No environmental review is necessary because the recommendations in this report involve the repair of an existing structure with no expansion beyond the previously existing level of use and are therefore considered to be an exempt project or activity in accordance with Section 15301 of the CEQA Guidelines.

Sustainability: None.

Commission/Committee Action: None.

Rationale for Recommendation: Due to the nature of the incident and the fire damage to the building, the Facilities & Real Property Management (FRPM) Division determined the best option to quickly make the building safe and begin the required repair process was to utilize an on-call contractor that had already been pre-qualified to perform work for the City, through RFQ Q20014541004, issued on December 23, 2020. Deemed as an emergency, FRPM retained Otto to provide the mitigation, demolition, and cleanup from the event. Working with Risk Management and the City’s property insurer, Otto was also chosen to provide the building restorations, since the firm had provided the mitigation, cleanup, and demolition and was familiar with the work. The City, the City’s property insurer, and Otto developed and agreed upon the cost and scope of work for the restoration. The City entered an emergency contract with Otto (Contract No. 2021-0563) to complete the George Sim Community Center Fire Repair Project.

At this time, City Council approval of budgetary adjustments, ratification of the emergency construction contract, and execution of Change Order No. 1 are necessary to complete the repairs to the damaged area.

Financial Considerations: The repairs are needed in response to a fire. Such claims are handled through the City’s Risk Fund. A series of budgetary actions to complete transfers from the Risk Fund to the project need to be completed. Upon approval of the transfer of $1,436,138 (General Fund, Fund 1001) from the FY2021/22 Public Works Department expenditure budget and the transfer of $154,979 (General Fund, Fund 1001) from the General Fund Administrative Contingency, there will be sufficient funds within the George Sim Community Center Fire Repair Project (C15001700) to complete the repairs to the damaged area.

Local Business Enterprise (LBE): John F. Otto, Inc., DBA Otto Construction is an LBE.

RESOLUTION NO. 2022-

Adopted by the Sacramento City Council

BUDGETARY ADJUSTMENTS AND CHANGE ORDER FOR THE GEORGE SIM COMMUNITY CENTER FIRE REPAIR PROJECT (C15001700)

BACKGROUND

A. On March 4, 2021, the George Sim Community Center had a fire in the historical side / multipurpose room (C900) and in the kitchen and restrooms. Although the building’s fire suppression system worked properly and quickly put out the fire, the building sustained substantial fire, smoke, and water damage.

B. The City retained John F. Otto, Inc., DBA Otto Construction (Otto) for the following activities: 1) make the site structurally safe and remove all of the fire and water damaged materials; 2) provide design-build services, using design consultants to prepare engineered construction documents for repairing the damaged areas back to pre-fire condition, and 3) performing the necessary construction to return the area to pre-fire condition. The Department of Public Works drafted an emergency contract with Otto (Contract No. 2021-0563) for the George Sim Community Center Fire Damage.

C. Phase three of the project includes the required construction to repair the fire damage area. Otto provided a proposal for the repair of the fire damage totaling $916,966. The total not-to-exceed contract will be $1,159,691.

BASED ON THE FACTS SET FORTH IN THE BACKGROUND, THE CITY COUNCIL RESOLVES AS FOLLOWS:

Section 1. The George Sim Community Center Fire Repair Project (C15001700) is established as a new Capital Improvement Project.

Section 2. The City Manager or the City Manager’s designee is authorized to increase the Fiscal Year (FY) 2021/22 Human Resources Department revenue budget by $1,436,138 (Risk Fund, Fund 6502), increase the FY2021/22 Public Works Department expenditure budget by $1,436,138 (General Fund, Fund 1001), and establish the appropriate transfers between the funds.

Section 3. The City Manager or the City Manager’s designee is authorized to transfer $1,436,138 (General Fund, Fund 1001) from the FY2021/22 Public Works Department expenditure budget to the expenditure budget of the George Sim Community Center Fire Repair Project (C15001700).

Page 24 of 25 ends

Section 4. The City Manager or the City Manager’s designee is authorized to transfer $154,979 (General Fund, Fund 1001) from the General Fund Administrative Contingency to the expenditure budget of the George Sim Community Center Fire Repair Project (C15001700).

Section 5. The City Manager or the City Manager’s designee is authorized to make the appropriate budgetary adjustments necessary to the expenditure budget of the George Sim Community Center Fire Repair Project (C15001600) based on actuals received when and if the City receives the third-party insurance reimbursement for the structure fire.

Section 6. The emergency construction contract with John F. Otto, Inc., DBA Otto Construction for the George Sim Community Center Fire Repair Project (C15001700) is ratified.

Section 7. The City Manager or the City Manager’s designee is authorized to execute Change Order No. 1 to Contract No. 2021-0563 with John F. Otto, Inc., DBA Otto Construction in an amount not to exceed $916,966 for a new not to exceed amount of $1,159,691.
