City of Sacramento
Description/Analysis
Issue Detail: Following the direction of the Council in 2017, an equity study related to disparate law enforcement of previous cannabis crimes in the city was conducted. City personnel and community members worked together to create recommendations for an equity program from study data. Following these recommendations, the Council authorized staff to create a program to address the negative impacts of disproportionate enforcement of cannabis-related violations in the city of Sacramento. On August 9, 2018, the Council adopted Resolution 2018-0323, establishing the Cannabis Opportunity Reinvestment and Equity (CORE) Program to assist individuals and communities to address barriers to starting cannabis businesses. Included in the recommendations was a goal of 50% CORE owned businesses.
Presently, the numbers of CORE-owned cannabis businesses have not reached that goal.
The following chart presents a breakdown of pending and issued Business Operating Permits (BOPs) by business type as of December 31, 2021, as compared to non-CORE businesses:
A citywide cannabis study was recently commissioned to be conducted by Economic & Planning Systems, Inc. (EPS) (EPS Study), which will be available on the Office of Cannabis Management's website once it’s completed. The scope of this study was designed with input from Councilmembers with the goal of informing public policy pertaining to land use, fiscal/economic, and other regulations. The study revolves around the following four questions:
a) What is the scale of the industry and its constituent elements in the city? b) How does the industry affect the city’s economy, real estate, and neighborhoods? c) Do city taxes paid by the industry cover its related City-service costs and generate revenue for the City?
d) Based on the literature and case studies, what alternate directions should the city explore regarding municipal oversight of the industry?

City of Sacramento
As the scope was designed to provide a high-level review of cannabis regulations in the city and provide data to respond to Councilmember’s concerns, it was anticipated that follow- on studies may be needed to gain more detailed data in specific subject areas. One of these areas is equity in the cannabis industry in Sacramento. While EPS interviewed CORE members and included case studies of equity programs and efforts in comparable cities and markets, the EPS study was not intended to be an equity study.
A follow-on equity study will both build on the work of EPS and solicit detailed data and analyses through an equity lens on the cannabis industry and the City’s CORE Program. It is anticipated that this equity-informed data will provide insight into and lead to recommendations on how the City and its cannabis programs can best meet the needs of those in historically disinvested communities and those who were negatively affected by the War on Drugs and wish to enter the competitive legal cannabis industry.
Policy Considerations: The Law & Legislation Committee is workshopping topics of interest from the citywide EPS study, including ownership, taxation, undue concentration, and displacement with the goal of having policy recommendations for staff to bring before the Council in April. It is anticipated that the results of the equity study will lead to further policy recommendations for Committee and Council consideration.
Economic Impacts: The cost for the Cannabis Equity Study will be funded by Office of Cannabis Management current funding.
Environmental Considerations: This action is not a project that is subject to CEQA because it is an administrative activity that will not result in direct or indirect physical changes in the environment. (CEQA Guidelines § 15378(b)(5).)
Sustainability: Not applicable.
Commission/Committee Action: It is anticipated that the data and any findings of the completed Cannabis Equity Study will be presented to the Racial Equity Ad Hoc Committee, the Law & Legislation Committee, and the Council.
Rationale for Recommendation: The draft Cannabis Equity Study RFP is being brought to the Racial Equity Ad Hoc committee to provide further opportunity for public input and to ensure alignment with the City’s racial equity efforts.
Financial Considerations: Not applicable.
Local Business Enterprise (LBE): Not applicable.

2. PROJECT OVERVIEW
This RFP solicits proposals from organizations and firms to build on the data from the recent comprehensive study of the city of Sacramento’s cannabis industry by conducting a follow-on equity study. The City is looking for an experienced contractor who can provide this data collection and analysis through an equity lens, including but not limited to disaggregating existing data and data collected to identify disproportionate impacts by racial, ethnic, and economic demographics. It will be paramount that the selected responder has a keen understanding of the unique challenges facing those communities most affected by the War on Drugs and is dedicated to a strategy using social equity tools to analyze data and inform policy recommendations to support the City’s efforts to increase equity and participation by equity members in the City’s cannabis industry, as well as provide a relevant and impactful Cannabis Opportunity Reinvestment and Equity (CORE) Program. The ideal contractor will also have an understanding of the role of local government in the cannabis industry in California. The selected responder will engage city staff and stakeholders, including CORE participants, community members, and partner organizations, focusing particularly on listening to and reflecting the needs of traditionally underserved and underrepresented populations in the regulated cannabis industry.
This project will include:
• An examination of the local, state, and national history of cannabis regulation, the War on Drugs, and its impact on our communities in Sacramento
• Reviewing known characteristics of the City’s existing cannabis industry, utilizing the most recent industry-wide study and discusses barriers to entry in the industry • Looking at other jurisdictions’ equity programs for lessons learned as well as best and emerging practices
• Recommendations to inform strategies to enhance data collection, address barriers, decision support tools/roadmap, and racial equity toolkit/framework for the CORE program and the Office of Cannabis management

4. BACKGROUND
Following direction by the City Council in 2017, an equity study was conducted. City personnel and community members worked together to create recommendations for an equity program from study data.
Following these recommendations, the City Council authorized staff to create a program to address the negative impacts of disproportionate enforcement of cannabis-related violations in the city of Sacramento.
On August 9, 2018, the City Council adopted Resolution 2018-0323, establishing the Cannabis Opportunity Reinvestment and Equity (CORE) Program to assist individuals and communities who face barriers when trying to start cannabis businesses. (https://www.cityofsacramento.org/- /media/Corporate/Files/CMO/Cannabis/Reso-2018-0323.pdf?la=en) Participants in the CORE program receive cannabis-business development resources, business training and mentorship, financial and technical assistance, and support services.
To be eligible for the CORE program, individuals must live or have lived in a low-income household in Sacramento and have been arrested in Sacramento for a cannabis-related crime between 1980-2011 or have an immediate family member who meets those criteria. Individuals are also eligible if they lived in a low-income household in the following zip codes for five consecutive years between 1980 and 2011:
95811, 95815, 95817, 95820, 95823, 95824, 95826, 95828, 95818, 95838 and 95832.
To date, over 300 individuals have qualified for the CORE program, there are over 40 pending applications for cannabis business operating permits by CORE members, and approximately 20 cannabis businesses are at least 51% owned by CORE members. Details of the CORE program can be found at:
https://www.cityofsacramento.org/City-Manager/Divisions-Programs/Cannabis-Management/Core- Program City-wide, there are approximately 260 permitted cannabis businesses and approximately 190 pending applications (including CORE businesses).
5. SCOPE OF SERVICES
The Contractor will conduct a data-driven equity study (Study) of the cannabis industry and the CORE Program in Sacramento, building off the recently completed citywide cannabis study completed by Economic & Planning Systems, Inc. (EPS) (available on the Office of Cannabis Management's website, once published). The goal of the Study is to measure the success of and identify growth opportunities for equity in the cannabis industry and in the CORE program and to inform public policy pertaining to land use, fiscal/economic, and other regulations through an equity lens. Ideally, the Study would be completed within 6 months of contract signing, not to exceed 1 year. Funding for the Study will not exceed $125,000. The Study will revolve, at a minimum, around the following questions and guidelines:
a. What is the state of equity in the cannabis industry in Sacramento and how is that measured? b. What does an equitable cannabis industry mean and how can it be achieved? c. Given the current cannabis industry in Sacramento, what are the appropriate equity metrics for analyzing the success of the CORE program and what should the benchmarks be to address disparities and inequities?
d. What are the barriers and mitigation strategies to participation in the Sacramento cannabis industry for CORE members?
e. Are current city policies and regulations supporting the stated goals of the equity study completed in 2018 to increase the number of CORE businesses? Should those original goals be reevaluated?
f. How are CORE members impacted by current city policies and regulations of the industry? g. Based on the literature and case studies, and given the legal and regulatory parameters within which the City must operate, what alternate directions should the city explore regarding implementation of the CORE program to achieve greater equity in the cannabis industry in Sacramento?
h. Recommendations meant to inform strategies for consistent accessible data collection such as a geo-spatial dashboard.
i. Recommended decision support tools/roadmap racial equity toolkit/framework for the CORE Program and the Office of Cannabis Management.
As part of the Scope, the Contractor shall also perform the following:
1. Engage staff, cannabis business owners and applicants, and CORE members who have yet to apply for a cannabis permit to gain insights and develop a realistic understanding of the Sacramento cannabis industry’s current environment, context, and culture
2. Identify opportunities and make recommendations for changes to policies, procedures, and practices to achieve greater equity in the Sacramento cannabis industry
3. Provide periodic progress reports to the Office of Cannabis Management
4. Provide a detailed briefing on the study results to the City’s Racial Equity Committee and the City Council, as requested
5. Document all data, findings, and recommendations and provide to the city, along with the Study, in electronic format.
