Description/Analysis
Issue Detail: On February 1, 2022, the Sacramento City Council passed a Motion authorizing a Storm Drainage property related fee ballot election. The Storm Drainage measure would generate approximately $20 million a year to fund repairs, maintenance, and improvements to the City’s aging stormwater system, which protects local rivers, and water sources from pollution and toxins, and protects homes and businesses from flooding. Additionally on February 1, 2022, the Sacramento City Council adopted ballot procedures that state: “A ballot may be completed by an owner of the parcel subject to the fee, or person legally authorized to submit a ballot on behalf of the record owner.” This action would delegate authority to the City Manager or the City Manager’s designee to vote on the City’s behalf for the Storm Drainage ballot election.
Policy Considerations: Article XIIID, section 6, subdivision (c) of the California Constitution requires the City of Sacramento to conduct a mailed ballot election before adopting or increasing certain property-related fees. Sacramento City Code section 3.44.110 and Resolution R2022-0035 sets forth procedures for fees or charges for which Article XIIID, Section 6, subdivision (c) of the California Constitution requires a mailed ballot procedure.
Economic Impacts: Not Applicable.
Environmental Considerations:
California Environmental Quality Act (CEQA): This report concerns administrative activities and governmental fiscal activities that do not constitute a “project” as defined by the CEQA Guidelines Sections 15378(b)(2) and (5) and, thus, are not a “project” subject to the provisions of CEQA (CEQA Guidelines Section 15060(c)(3)).
Sustainability: Improvements to the City’s Storm Drainage System support the City goals of increasing the reliability of the system and of protecting the quality of our creeks and rivers.
Commission/Committee Action: The Department of Utilities presented four Rate Workshops to the Utilities Rate Advisory Commission (URAC) from September through November of 2021.
The Department of Utilities presented three updates to the Water Committee from April through November of 2021. A public Rate Hearing was conducted with the URAC on January 26, 2022, and the URAC recommended the ballot initiative to the City Council for consideration.

ELECTION
BACKGROUND
A. Article XIIID, section 6, subdivision (c) of the California Constitution requires the City of Sacramento to conduct a mailed ballot election before adopting or increasing certain property-related fees.
B. On February 1, 2022, the Sacramento City Council passed a Motion authorizing a Storm Drainage property relate d fee ballot election. Additionally on February 1, 2022, the Sacramento City Council adopted ballot procedures that state: “A ballot may be completed by an owner of the parcel subject to the fee, or person legally authorized to submit a ballot on behalf of the record owner.”
C. The City owns 2,007 properties that are included in the S torm Drainage Fee Ballot Election as shown in Exhibit A to this resolution. The City owned properties will have a total annual storm drainage fee of approximately $496,000.
BASED ON THE FACT S SET FORTH IN THE BACKGROUND, THE CITY COUNCIL RESOLVES AS FOLLOWS:
SECTION 1: The City Manager or the City Manager’s designee is authorized to submit ballots for the City-owned properties included in the storm drainage property-related fee ballot election listed in Exhibit A to this resolution.
SECTION 2: Exhibit A is a part of this resolution.
