Description/Analysis
Issue Detail: The Department of Utilities has raised concerns regarding illegal activities occurring within a section of Dias Avenue. Illegal dumping and other criminal activities were reported to 311 which jeopardize the safety of City Utility Workers in conducting routine maintenance on the site that lies at the east end of Dias Avenue (Storm Pump Station Sump 147). An application for temporary closure of the street has been submitted and processed by Public Works. Dias Avenue is not a through street and terminates before Morrison Creek. The Department of Utilities will install a steel gate across the roadway at the edges of the open road as a deterrent to the illegal activities in the street. Police, Fire, and Public Works Departments support this temporary closure.
Policy Considerations: The procedures for the temporary street closure to vehicular traffic are set forth in the Vehicle Code Section 21101.4 and Sacramento City Code Chapter 12.16 allowing the temporary closure for the protection or preservation of the public peace, safety, health or welfare. The temporary closure will improve and expand public safety and enhance livability.
Economic Impacts: None.
Environmental Considerations:
California Environmental Quality Act (CEQA): The Environmental Planning Services section of the Community Development Department has reviewed the proposed temporary street closure and determined that the activity is exempt from the provisions of the California Environmental Quality Act (CEQA) under Section 15301 of the CEQA Guidelines in that this temporary street closure involves no expansion of use beyond what currently exists. Access to the street will be given to appropriate departments and agencies.
Sustainability: Not applicable.
Commission/Committee Action: None.
Rationale for Recommendation: Temporary closure of the street will provide security for the property owners and Department of Utilities employees for 18 months by reducing opportunities for individuals to commit illegal acts, illegal dumping, and other criminal activity within this street.
The temporary street closure can be extended an additional 18 months through City Council approval.

Financial Considerations: The Department of Utilities, is responsible for all fees required to process this application and installation of the gate. There is sufficient funding available in the department’s FY2021/22 operating budget and no additional resources are needed at this time.
Local Business Enterprise (LBE): Not applicable.

In reference to the requested temporary closure of the subject street in Council District 6, I have reviewed the material of the subject right-of-way. I find that the subject street is under the City of Sacramento’s jurisdiction and the temporary closure o f the subject area does not include a through highway or arterial street. It also appears that maintaining the temporary closure will allow adequate and safe traffic circulation on the adjacent streets. The Department of Public Works support the temporary closure request of the subject street.
