Description/Analysis

Issue Detail: Sacramento City Code Chapter 3.124 and the Landscaping and Lighting Act of 1972 (California Streets and Highways Code § 22500 et seq.) require that the City Council order the preparation of an annual engineer’s report for City maintenance assessment districts (Districts) and order the filing of such report with the City Clerk.

Districts formed under the Landscaping and Lighting Act of 1972:
• Citywide Landscaping and Lighting District
• Village Garden Landscape Maintenance District
• Power Inn Road Maintenance District
• Neighborhood Landscaping District
• Neighborhood Lighting District

Districts formed under the City Code Chapter 3.124:
• Willowcreek Maintenance Assessment District
• Northside Subdivision Maintenance District
• Laguna Creek Maintenance District
• Neighborhood Water Quality District

The Districts were formed to provide various maintenance and operations improvements such as street landscape and lighting, park, open space, drainage basin, and wetlands maintenance, as well as water quality programs. More detailed descriptions of the services and improvements provided in each district, and the individual annual budgets, will be brought to Council for approval over the next few months.

The recommended action to direct the filing of the annual engineer’s reports with the City Clerk is the first step in the process of ordering the maintenance and levying the assessment. The individual annual reports for each district will be brought later to City Council for approval pursuant to Section 22623 of the Streets and Highways Code and Section 3.124.190 of the Sacramento City Code.

Policy Considerations: The recommended action supports funding for maintenance and operations improvements in the Districts via property-based assessments.

Economic Impacts: None.

Environmental Considerations:

California Environmental Quality Act Guidelines (CEQA): Under CEQA, administration of the Districts does not constitute a project and is therefore exempt from review [14 Cal. Code Regs. §15378(b)(5)].

Sustainability: Not applicable.

Commission/Committee Action: None.

Rationale for Recommendation: City Council is required to order preparation of annual engineer’s reports and filing of the reports with the City Clerk for existing assessment districts pursuant to Section 22622 of the Streets and Highways Code and Section 3.124.190 of the Sacramento City Code.

Financial Considerations: The recommended action orders preparation of the engineer’s reports and filing of such reports with the City Clerk. The reports will be used to establish budgets for each district and such reports will be submitted to City Council at a future date.

There are no financial considerations with this report.

Local Business Enterprise (LBE): Not applicable.
