Description/Analysis
Issue Detail: The Infrastructure Finance Division of the Finance Department has previously maintained on-call Master Service Agreements (MSAs) to provide expertise in the formation of special districts, development impact fee programs, and preparation of other related financial and technical reports and analyses. The current MSAs for these purposes, adopted by Council on June 21, 2016, expire June 29, 2022.
The Finance Department issued a Request for Qualifications on October 22, 2021, to solicit the professional services of consultant firms with expertise in special districts, public- infrastructure financing, and financial analysis. Nine firms submitted Statements of Qualifications. A selection committee chose six of the nine firms to execute MSAs with the City due to their experience, knowledge, and expertise in specific areas. The six firms selected were: Economic & Planning Systems, Francisco & Associates, Goodwin Consulting Group, Harris & Associates, NBS, and Willdan Financial Services.
Policy Considerations: MSAs with financial and special tax consultants supplement City staff resources in specific areas of expertise and provide segregation of duties in processes involving reimbursements to developers. The recommendation in this report is in accordance with City Code Chapter 3.64 regarding contracts for professional services.
The Sacramento City Code Section 4.04.020 and Council Rules of Procedure (Chapter 7, Section E.2.d) mandate that unless waived by a 2/3 vote of the City Council, all labor agreements and all agreements greater than $1 million shall be made available to the public at least ten (10) days prior to Council action. This item was published for 10-day review on March 10, 2022, in compliance with the City Code.
Economic Impacts: None.
Environmental Considerations:
California Environmental Quality Act (CEQA): Approval of the professional service agreements does not constitute a project under CEQA pursuant to CEQA Guidelines section 15378(b)(2) because the requested action amounts to continuing administrative activities and general policy and procedure making.
Sustainability: Not applicable.
Commission/Committee Action: None.

Rationale for Recommendation: The Finance Department manages MSAs to utilize financial and special tax consultants to form assessment and special tax districts, and to prepare development impact fee programs, financial strategies, and assessment and special tax methodologies. Other City departments and divisions are permitted to issue task orders (referred to as “Addendums”) for services under these MSAs (within the not-to-exceed amount of the MSA). Such other City departments and divisions include the City Treasurer, the Office of Innovation and Economic Development, Community Development, Transportation Division in Public Works, Youth, Parks and Community Enrichment, and Utilities.
The MSAs establish on-call agreements that can be utilized for a specific project or expertise.
By pre-qualifying consultants through the use of MSAs, a consultant selection process for each individual project is not necessary, thereby streamlining the study and analysis process and enabling City staff to be more responsive in the formation of special districts, the creation of financing programs, preparation of financial and other technical reports, and the many related ad hoc issues that arise.
Financial Considerations: No consultants are engaged on a task without an identified, authorized source of funds. Once the funds are identified, the existence of the MSAs permits staff and the consultant to commence work immediately.
In most cases, all costs associated with consultant services will be funded from assessment districts, community facilities districts, fee districts, redevelopment areas or directly by a developer. Developer funding is always secured by advance funding agreements.
Local Business Enterprise (LBE): Three of the six firms selected to execute MSAs are LBE qualified.
