City of Sacramento
Description/Analysis
Issue Detail: Each year, the Sacramento County Board of Supervisors approves its annual allocation of transient occupancy tax (TOT) collections. The County uses a portion of its TOT to fund joint operations it shares with the City. This year, these operations include the Office of Arts and Culture (OAC). The County funds are used to fund projects, programs, activities, and operational expenses of the division. The County Board of Supervisors approved TOT allocations for Fiscal Year (FY) 2021/22 to OAC is in the amount of $388,600. The County’s allocation to OAC will be administered by the City.
On December 14, 2021, City Council adopted Resolution No. 2021-0360 which authorized: 1) accepting $388,600 in total funding from the County of Sacramento to support the Office of Arts and Culture operation; 2) the City Manager or the City Manager’s designee to execute an agreement and any necessary documents with the County of Sacramento to accept the County funding stated above; 3) the City Manager or the City Manager’s designee to increase the expenditure budget in the Cultural Arts Awards Grant Program (I17000700) by $336,000 (General Fund, Fund 1001); and 4) the City Manager or the City Manager’s designee to increase the expenditure budget in Citywide and Community Support by $52,600 in General Fund (Fund 1001).
Following adoption of Resolution No. 2021-0360, the City Manager signed City Agreement No. 2021-1392, which accepted $388,600 in funding from the County of Sacramento to support the operations of the Office of Arts and Culture.
The allocation of funds referenced in Resolution No. 2021-0360 was incorrect and omitted authorization to increase the expenditure budget in the Citywide Community and Support. To ensure that the prior actions and approvals remain in force and valid, including executed agreements, this report recommends amending Resolution No. 2021-0360 by repealing Sections 3 and 4 and adding sections to authorize the City Manager or the City Manager’s designee to increase the FY2021/22 revenue budget in Citywide and Community Support by $388,600 in General Funds (Fund 1001) to reflect the County’s FY2021/22 funding for the Sacramento Office of Arts and Culture. Except as otherwise amended as outlined in this staff report, all other provisions of Resolution No. 2021-0360 shall remain in full force and effect. .

Administrative Matter: Amend Resolution No. 2021-0360 for the Fiscal Year 2021/22 County Contribution to the Office of Arts & Culture
BACKGROUND
A. The City of Sacramento and the County of Sacramento provide joint operating support for the Office of Arts and Culture.
B. The County Board of Supervisors approved its allocation to the Office of Arts and Culture for Fiscal Year (FY) 2021/22, to be used by the City for programs, events, activities, and operational expenses of the Office of Arts and Culture (“OAC”).

E. Resolution No. 2021-0360 should have authorized the City Manager or the City Manager’s designee to increase the FY2021/22 revenue budget in Citywide and Community Support by $388,600 in General Funds (Fund 1001) to reflect the County’s FY2021/22 funding for the Sacramento Office of Arts and Culture.
F. Section 3 of Resolution No. 2021-0360 authorizing the City Manager or designee to increase the revenue and expenditure budgets in the Cultural Arts Award Grant Program by $336,000 and Section 4 authorizing an increase to the revenue and expenditure budgets in the Citywide and Community Support
Department by $52,600, are incorrect and need to be repealed and replaced with the correct budget authorization.
G. Due to the incorrect allocations, the City’s budget must now be increased to account for the County’s contribution of $336,000 to the Cultural Arts Awards (CAA) Grant Program and $52,600 to the Citywide and Community Support Department.
