Description/Analysis
Issue Detail: The current Natomas interior levees certification is more than 10 years old and does not meet the criteria in 44 Code of Federal Regulations (CFR) 65.10. If the levees are not recertified, approximately 3,000 structures in the Natomas Basin within the City will be remapped by FEMA back into a floodplain, requiring residents who have federally backed mortgages to purchase flood insurance and imposing requirements on newly constructed or substantially improved structures. The goal of this project is to achieve 100-year certification for the Natomas interior levees before the USACE completes the external levee work around the Natomas Basin in 2025.
Staff recommends Council approve an agreement with KSN Inc for Phase 2 to close the data gaps and other certification items that were determined in Phase 1 of the certification effort.
This includes gathering and analyzing data from roughly ten linear miles of the West Drainage and Main Drainage canals and the C-1 Drain and the B Drain levees.
Phase 3 will include design, permitting, and any necessary construction identified during this phase 2 effort.
Policy Considerations: City Council approval is required for professional service agreements of $250,000 or more per City Code 3.64.020.
Economic Impacts: None.
Environmental Considerations: The current project has been determined to be exempt from the requirements of the California Environmental Quality Act (CEQA), under CEQA Guidelines Section 15306, Information Collection. The project consists of basic data collection, research and resource evaluation activities which do not result in a serious or major disturbance to an environmental resource.
Sustainability: The proposed project is consistent with the 2035 General Plan as it complies with goal Utilities, 4.1.2, by identifying facilities needed to prevent 100-year event structure flooding. It also complies with PHS 4.1.1 by addressing disasters such as flooding and levee failures.
Commission/Committee Action: Not applicable.
Rationale for Recommendation: Part of the scope of the initial contract was to identify data gaps that would need to be addressed in a second phase.

These data gaps have been identified and will be addressed with this supplemental agreement, which is the next step in completing the evaluation of the Natomas Interior Levees and prepare a submittal to FEMA.
Financial Considerations: The proposed Supplemental Agreement No.1 for City Agreement 2019-0226, in the amount of $899,673, would increase the agreement’s not-to-exceed amount to $1,369,483. To provide sufficient funding for this project, staff recommends a budget transfer from the Storm Drain Fund Balance (Fund 6011) to the Flood Control Planning MYOP (I14010100, Fund 6011) in the amount of $400,000.
There are no General Funds allocated or planned for this project.
Local Business Enterprise (LBE): KSN Inc. is not an LBE but has partnered with LBEs to exceed the minimum LBE participation requirement for the work in the Supplemental Agreement. H1 Drilling will meet the 5% LBE participation requirement.
Background: Currently, USACE is finishing levee work around the Natomas Basin and related facilities to protect the basin against flooding from external sources. The goal is to provide 200- year level of flood protection, with a planned for completion date in 2025. In addition to external flooding sources, the interior flooding of the Natomas Basin is also of concern.
The interior stormwater is drained through four major canals: North Drainage Canal, East Drainage Canal, West Drainage Canal, and Main Drainage Canal. External sources such as the “Sankey Gap” contribute to the interior stormwater during large storm events. The current Natomas interior levees certification does not meet the criteria in 44 Code of Federal Regulations (CFR) 65.10 and is greater than 10 years old.
These interior levees need to be certified prior to the U.S. Army Corps of Engineers (USACE) completion of the Natomas “Ring” Levee Project, which is the certification of exterior levees around the Natomas Basin scheduled for 2025. The goal of this project is to achieve that 100- year certification for the Natomas interior levees.
Supplemental Agreement No.1 to existing professional services agreement with Kjeldsen, Sinnock & Neudeck Inc. (KSN) will close the remaining data gaps on the West Drainage Canal, Main Drainage Canal, and the C-1 Drain and the B Drain levees.

RESOLUTION NO. 2022-
Adopted by the Sacramento City Council
April 5, 2022
SUPPLEMENTAL AGREEMENT WITH KJELDSEN, SINNOCK & NEUDECK INC. FOR
NATOMAS INTERIOR LEVEE EVALUATION AND CERTIFICATION
BACKGROUND
A. The United States Army Corp of Engineers (USACE) is completing levee work around the Natomas Basin and related facilities to protect the basin against flooding from external sources. The goal is to provide 200-year level of flood protection, with a planned for completion date in 2025. In addition to external flooding sources, the interior flooding of the Natomas Basin is also of concern.
B. The interior stormwater is drained through four major canals: North Drainage Canal, East Drainage Canal, West Drainage Canal, and Main Drainage Canal. External sources such as the “Sankey Gap” contribute to the interior stormwater during large storm events. The current Natomas interior levees certification is greater than 10 years old and does not meet the criteria in 44 Code of Federal Regulations (CFR) 65.10.
C. These interior levees need to be certified prior to the USACE completion of the Natomas “Ring” Levee Project, which is the certification of exterior levees around the Natomas Basin. If not recertified, approximately 3,000 structures in the Natomas Basin within the City will be mapped by FEMA back into a floodplain, requiring residents who have federally backed mortgages to purchase flood insurance and imposing requirements on newly constructed or substantially improved structures. The goal of this project is to achieve that 100-year certification for the Natomas interior levees before the USACE completes the external levee work around the Natomas Basin, in 2025.
D. In 2019, the City of Sacramento retained Kjeldsen, Sinnock & Neudeck Inc. (KSN) to identify and document data gaps for the Natomas Interior Levees and to begin data collection to resolve identified gaps. In 2019, KSN provided the City with the memorandum which documented the data gaps identified during the Phase I investigation. In coordination with the City, KSN determined that the 2019 contract had sufficient budget remaining to collect data sufficient to close the gaps identified for the East Drainage Canal Levees and the Elkhorn Boulevard Levee. There was not sufficient budget to close the data gaps on the West Drainage Canal, Main Drainage Canal, and the C-1 Drain and the B Drain levees.

E. A supplemental agreement is necessary to proceed with evaluation of the remaining data gaps of approximately 10 linear miles of B Drain, C-1 Drain, Main Drainage and West Drainage Canals identified during Phase 1 of the interior Natomas Levees project to achieve Federal Emergency Management Agency (FEMA) 100-year accreditation for the Natomas Interior Levees
F. A budget augmentation of $400,000 from the Storm Drain Fund Balance (Fund 6011) to the Flood Control Planning MYOP (I14010100, Fund 6011) is required to provide sufficient funds to complete the project.
BASED ON THE FACTS SET FORTH IN THE BACKGROUND, THE CITY COUNCIL RESOLVES AS FOLLOWS:
Section 1. The City Manager or the City Manager’s designee is authorized to execute Supplemental Agreement 2019-0226-01 with KSN for the evaluation of the remaining data gaps of approximately ten linear miles for B Drain, C-1 Drain, Main Drainage and West Drainage Canals for an amount not–to-exceed $899,673, bringing the total not-to-exceed amount of the contract to $1,369,483.
Section 2. The following budget transfer is approved:
Project No. Fund Project Name Amount
6011 Storm Drainage Available Fund Balance ($400,000)
I14010100 6011 Flood Control Planning MYOP $400,000
