Description/Analysis

Issue Detail: The owners of parcel 002-0172-024-000, Mansion Apartments Owner, LLC, have observed illegal acts such as drug use and illegal dumping in Government Alley between 15 th Street and 16th Street. Currently, a new apartment complex, Mansion Inn Apartments, is under construction on the above referenced parcel which abuts Government Alley to the south between 15
th Street and 16th Street. An application for temporary closure of the alley has been submitted and processed by Public Works to temporarily close the alley to through vehicular traffic. The applicant will install two sets of removable steel bollards closing the alley to vehicular traffic to create a safe environment for pedestrians that use the alley and to deter illegal acts in the alley. Police, Fire, and the Public Works Departments support this temporary closure.

Policy Considerations: The procedures for the temporary alley closure to vehicular traffic are set forth in the Vehicle Code Section 21101.4 and Sacramento City Code Chapter 12.16 allowing the temporary closure for the protection or preservation of the public peace, safety, health or welfare. The temporary closure will improve and expand public safety and enhance livability.

Economic Impacts: None.

Environmental Considerations:

California Environmental Quality Act (CEQA): The Environmental Planning Services section of the Community Development Department has reviewed the proposed temporary alley closure and determined that the activity is exempt from the provisions of the California Environmental Quality Act (CEQA) under Section 15301 of the CEQA Guidelines in that this temporary alley closure involves no expansion of use beyond what currently exists. Access to the alley will be given to appropriate departments and agencies.

Sustainability: Not applicable.

Commission/Committee Action: None.

Rationale for Recommendation: Temporary closure of the alley for 18 months will provide security for the property owners and pedestrians traversing the alley by reducing opportunities for individuals to commit illegal acts including illegal dumping within the public right of way. A majority of the property owners support this temporary closure request. The temporary alley closure can be extended an additional 18 months through future City Council approval.

Financial Considerations: The applicant is responsible for all fees required to process this application at no cost to the City. If approved, the applicant will also fund and install the steel bollards and related equipment to close the alley to vehicular traffic.

Local Business Enterprise (LBE): Not applicable.

SUBJECT: CLEARANCE FOR THE TEMPORARY CLOSURE OF GOVERNMENT ALLEY BETWEEN 15
TH, 16 TH, G AND H STREETS, LOCATED IN
COUNCIL DISTRICT 4

In reference to the requested temporary closure of the subject alley in Council District 4 , I have reviewed the material of the subject right -of-way. I find that the subject alley is under the City of Sacramento’s jurisdiction and the temporary closure of the subject area does not include a through highway or arterial street. It also appears that maintaining the temporary closure will allow adequate and safe traffic circulation on the adjacent streets. The Department of Public Works supports the temporary closure request of the subject alley, per the provided Exhibit Map and Details.

COMMENTS:

As shown, the bollards do not include the reflective elements (2” reflective tape, and yellow powder coat) called for on the City Standard Drawing T-231 for removeable bollards. Also, though the plan shows 3 bollards spaced 6’ apart, there is also a note on the utility plan saying the bollard must be 12’ from the underground waterline. So it’s possible the bollards will be located differently in the field. Please note that a minimum unobstructed clearance of 5’ between the bollards (face to face not center to center) is required. Preferably both openings would meet this requirement.
