Description/Analysis
Issue Detail: Property owners representing more than 50 percent of the proposed assessments within the Broadway commercial corridor have proposed to renew the Greater Broadway Property and Business Improvement District (PBID) for a ten-year term. The previous renewal was approved by City Council on July 19, 2012, for a ten-year term running from January 1, 2013 through December 31, 2022. The PBID will continue to provide a higher level of security, maintenance services, marketing, and economic development activities to promote the area as a desirable place to live, work, and do business.
The total PBID assessment budget for the first year of this renewal will be approximately $451,101. The service area includes approximately 419 assessed parcels. The City owns three parcels within the PBID that have been assessed since formation of the PBID and have benefitted from the PBID services. City staff is thus recommending that the City- owned parcels continue to be included as assessed parcels in the renewed PBID. To support renewal of the PBID, staff recommends that City Council delegate to the City Manager or City Manager’s designee the authority to sign the property owner’s petition and assessment ballot on behalf of the City property that is located within the PBID.
Policy Considerations: The proceedings under which the PBID is proposed to be renewed are set forth in California Streets and Highways Code section 36600 et seq., referred to as the “Property and Business Improvement District Law of 1994.”
Economic Impacts: None.
Environmental Considerations: California Environmental Quality Act (CEQA):
This report concerns administrative activities and governmental fiscal activities that do not constitute a “project” under CEQA Guidelines Section 15378(b)(2) and Section 15378(b)(5). The proposed action in this report is therefore not a “project” subject to the provisions of CEQA (CEQA Guidelines Section 15060(c)(3)).
Sustainability: Not applicable.
Commission/Committee Action: None.
Rationale for Recommendation: The recommended action authorizes the City Manager or the City Manager’s designee to sign the property owner’s petition and assessment ballot in the affirmative on behalf of the City property that is located within the PBID.
Financial Considerations: If the PBID is renewed, the City will continue to participate as a property owner. With this renewal, assessment rates will increase from $0.0385 to $0.0516 per parcel square foot. The three City-owned parcels will have a total assessment of approximately $81,094 for the first year of this renewal. The City’s assessment is budgeted for and paid from the General Fund. Future assessment rates may be subject to an increase of no more than five percent (5%) annually.
Local Business Enterprise (LBE): Not applicable.
RESOLUTION NO.
Adopted by the Sacramento City Council
DESIGNATING THE CITY MANAGER OR THE CITY MANAGER’S
DESIGNEE AS THE SIGNATURE AUTHORITY FOR CITY-OWNED
PROPERTY IN THE RENEWED GREATER BROADWAY
PROPERTY AND BUSINESS IMPROVEMENT DISTRICT NO. 2022-01
BACKGROUND:
A. The Greater Broadway Property and Business Improvement District (Greater Broadway PBID) was initially established in 2007 under the PBID Law of 1994 (California Streets and Highways Code section 36600 et seq.) with a five-year term. On July 19, 2012, the Greater Broadway PBID was renewed for a ten-year term from January 1, 2013, to December 31, 2022.
B. Property owners representing more than 50 percent of the proposed assessments have now proposed renewal of the Greater Broadway PBID for another ten-year term from January 1, 2023 through December 31, 2032.
C. The City owns three parcels within the Greater Broadway PBID. The City-owned parcels have been assessed under the PBID since its formation. The City-owned parcels will have a total annual assessment of approximately $81,094 for the first year of the renewal term. Future assessment rates may be subject to an increase of no more than five (5%) annually.
D. City staff recommends that the City-owned parcels be included as assessed parcels in the renewed Greater Broadway PBID because the City properties have thus far benefitted from the Greater Broadway PBID’s services. Staff is thus seeking City Council authorization for the City Manager or the City Manager’s designee to sign the property owner’s petition and assessment ballot for the City- owned parcels in favor of renewal for the Greater Broadway PBID.
BASED ON THE FACTS SET FORTH IN THE BACKGROUND, THE CITY COUNCIL RESOLVES AS FOLLOWS:
Section 1. The City Manager or the City Manager’s designee is authorized to vote for the following City-owned properties to be included in the renewal of the Greater Broadway Property and Business Improvement District:
APN 009-0030-001-0000
APN 009-0030-030-0000
APN 009-0252-002-0000
