Description/Analysis

Issue Detail: Approval of Supplemental Agreement No. 4 with Geocon Consultants, Inc. is required so they can continue providing material testing and special inspection services for the completion of construction of the bleachers at the North Natomas Community Center and Aquatics Complex Project (the “Project”). Approval of Supplemental Agreement No. 3 with Tricorp Group is required so they can continue providing daily construction inspection services for the Project. Approval of Supplemental Agreement No. 3 with Tony Moayed Construction Services, Inc. is required so they can continue providing daily construction management services during the completion of construction of the Project.

Policy Considerations: City Council approval is required for supplemental agreements for professional services per City Code Section 3.64.040.

Economic Impacts: None

Environmental Considerations:

California Environmental Quality Act (CEQA): On June 7, 2018, the City Council adopted the Mitigated Negative Declaration and the Mitigation Monitoring Program for the North Natomas Regional and Community Park Master Plan Amendment and Community Center and Aquatics Complex Project (see City Council Resolution No. 2018-0215). No further environmental review is required.

Sustainability: Not Applicable

Commission/Committee Action: None

Rationale for Recommendation: The North Natomas Community Center and Aquatics Complex Project construction has gone beyond the original completion date of January 2021 due to primarily to design issues, the quality of subcontractor work, and the prior construction management company that had to be replaced. The supplemental agreements are needed to provide services to complete the project by Spring 2022. Geocon Consultants, Inc. is the Division of State Architect (DSA) special inspector of record for the Project. Because the pool complex will serve the students at the adjacent Inderkum High School and the Natomas Unified School District provided funding for the project, DSA approval was required.

Supplemental Agreement No. 4 is required so Geocon Consultants, Inc. can provide uninterrupted special inspection and material testing to finish the construction of the Project.

Tony Moayed Construction Services, Inc. is the construction manager for Project.

Supplemental Agreement No. 3 is required so Tony Moayed Construction Services, Inc. can continue the daily, on-site management for the completion of construction of the Project.

Tricorp Group is the DSA inspector of record for the Project. Supplemental Agreement No. 3 is required so Tricorp Group can provide uninterrupted inspection and coordination of material testing for the completion of the Project.

Financial Considerations: Sufficient funds are available in the North Natomas Community Center and Aquatic Complex Project (L19140410) to execute a Supplemental Agreement No. 4 with Geocon Consultants, Inc. for a not-to-exceed amount of $30,125, Supplemental Agreement No. 3 with Tricorp Group for a not-to-exceed amount of $102,503 and Supplemental Agreement No. 3 with Tony Moayed Construction Services, Inc. for a not-to- exceed amount of $96,972.

Local Business Enterprise (LBE): Geocon Consultants, Inc., Tricorp Group and Tony Moayed Construction Services, Inc. are LBEs.

GEOTECHNICAL TESTING AND OBSERVATION, MATERIALS TEST ING, AND

SPECIAL INSPECTION SERVICES

NORTH NATOMAS COMMUNITY CENTER AND AQUATICS COMPLEX
2601 NEW MARKET DRIVE

SACRAMENTO, CALIFORNIA
Ref
erence: 1. City of Sacramento Professional Services Agreement for Architects, Landscape Architects, Professional Engineers, and Professional Land Surveyors – Geotechnical Testing, Material Testing and Special Inspection for the NNCCAC (Contract #2019- 1494), dated September 30, 2019.

2. Supplemental Contract, North Natomas Community and Aquatic Center (Purchase Order #53179) dated October 27, 2021.

Mr.

Thompson:

In
accordance with our contract and supplemental contract (referenced above) , we are currently providing geotechnical testing and observation, materials testing, and special inspection services for the North Natomas Community Center and Aquatics Complex (NNCCAC) project located at 2601 New Market Drive in Sacramento, California.

We hav
e reviewed our current ly billed effort and compared this effort to our authorized cumulative project budget of $371,015. Our total fees as of the date of this letter are $ 386,886 which has exceeded our currently authorized budget. Based on the construction pr ogress of the project, additional services and budget beyond our current contract amount will be needed to complete the project. Based on our records and conversations with the project management team, we anticipate the remaining scope:
• Materials Testing and Special Inspection:
• Structural steel (shop/field) – material identification for steel associated with the project bleachers. • Structural steel (field) – structural steel inspection (welding) for the bleacher erection. • Laboratory testing for structural steel associated with the project bleachers.

Detai
ls of our estimated fees for additional servi ces are presented on th e att ached fee estimate worksheet. After discussions with our team and the project construction management team, we believe that an additional fee of $ 30,125 beyond our current contract amount will allow us to complete the project. The additional fee of $30,125 brings the total contract amount to $401,140.
