Description/Analysis

Issue Detail: The Fruitridge Road Improvements Project will improve safety and connectivity for bicyclists and pedestrians, as well as a rehabilitated pavement surface for drivers, on Fruitridge Road between 65th Street Expressway and Power Inn Road. It will also improve accessibility by providing accessibility-compliant curb ramps and sidewalk.

The City received a federal grant for a complete streets rehabilitation project several years ago. Due to the existing conditions on Fruitridge Road, it is not possible to improve pedestrian and bicycle travel within the existing right of way while maintaining the current lane configurations; therefore, additional analysis of different options, including a road diet, is needed to determine the improvements to be constructed along this segment of Fruitridge Road.

The budgetary adjustments are necessary to complete work on the environmental documentation and final design of the Fruitridge Road Improvements Project. Local funds for match and non-participating expenses will be transferred from the State and Federal Grant Match Project.

In summer of 2021, a solicitation for professional services was advertised to competitively select a consulting firm to manage the delivery of the preliminary engineering. The panel was comprised of Public Works staff and included qualified Construction Inspection and Surveying, Transportation Planning, and Funding and Project Development staff who reviewed and ranked the proposals. Mark Thomas & Company, Inc. was determined as the highest-ranked consulting firm to perform the required services. Staff recommends executing a professional services agreement for preliminary engineering and environmental clearance with Mark Thomas & Company, Inc. in an amount not to exceed $702,500. The procurement process allows Mark Thomas & Company, Inc. to perform both the initial preliminary engineering/environmental clearance phase (PA/ED), and for the subsequent plans, specifications, and estimates (PS&E).

Policy Considerations: The actions requested herein are consistent with the City’s goals of improving and expanding public safety, creating walkable communities, and enhancing overall livability. Specific goals the project addresses are as follows:

M 1.2.1 – Multimodal Choices: The City shall develop an integrated, multimodal transportation system that improves the attractiveness of walking, bicycling, and riding transit over time to increase travel choices and aid in achieving a more balanced transportation system and reducing air pollution and greenhouse gas emissions.

M 5.1.14 – Encourage Bicycle Use: The City shall encourage bicycle use in all neighborhoods, especially where short trips are common.

These improvements will accommodate cyclists of varying experience levels and abilities and increase overall ridership.

The actions requested are also consistent with City Council’s adopted guidelines for transportation funding, meeting the following criteria: safety; maintaining a state of good repair; promoting reductions in vehicle-miles-traveled and greenhouse gas reductions; mobility solutions for youth; and equity.

Economic Impacts: None.

Environmental Considerations:

California Environmental Quality Act (CEQA): The requested action would approve budgeting and a professional services agreement for the preliminary engineering and environmental clearance work for the Fruitridge Road Improvements Project. The subject action is not a project pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15378(b)(5). The action is an administrative activity that would not result in a direct or indirect significant effect on the environment and is not subject to CEQA. [CEQA Guidelines section 15060(c)(3)]. Prior to final action to undertake the project, appropriate environmental review will be completed pursuant to the requirements of CEQA.

National Environmental Policy Act (NEPA): The project has been awarded federal funding, and accordingly, appropriate NEPA clearance will take place as part of project development. The California Department of Transportation is the lead agency for NEPA approvals.

Sustainability: The recommended action supports City Council’s sustainability priorities. The transportation sector accounts for over 50% of community-wide greenhouse gas emissions.

The City’s Climate Action Plan includes several implementation measures to reduce vehicle trips and increase transit and active modes. The project under development would implement the Climate Action Plan by providing enhanced pedestrian and bicycle connections.

Commission/Committee Action: None.

Rationale for Recommendation: Fruitridge Road Improvements will promote mobility for all travel modes including bicyclists, pedestrians, and transit users.

On July 28, 2021, the Department of Public Works advertised a Request for Proposals for the competitive selection of a consultant firm. The scope of services included project management, preliminary engineering, environmental documentation, public outreach, geotechnical investigation, utility coordination, PS&E, permitting, and bidding and construction assistance. Two firms responded:

• Mark Thomas & Company, Inc.
• Wood Rodgers, Inc.

A panel of City staff from the Department of Public Works reviewed and evaluated the consultant teams’ written proposals based upon experience, qualifications, project understanding, and work plan among other factors. Two teams were asked to interview:

Mark Thomas & Company, Inc. and Wood Rodgers, Inc. Based on the interview and proposal, Mark Thomas & Company, Inc. was recommended as the top ranked firm.

City Council action is required to approve the budgetary adjustments and to execute a Professional Services Agreement with Mark Thomas & Company, Inc.

Financial Considerations: The estimated project cost to complete the preliminary engineering phase for the Fruitridge Road Improvements Project (T15036300) is approximately one million. With the approval of the transfer of $250,000 (Major Street Construction, Fund 2007) from the State and Federal Grant Match Project (T15007200), there will be sufficient funding to award the professional services agreement for environmental clearance and final design to Mark Thomas & Company, Inc. for a not-to-exceed amount of $702,500 and cover the management and administrative time required to deliver the project.

There is sufficient funding within the State and Federal Grant Match Project (T15007200) to support the transfer to the Fruitridge Road Improvements Project (T15036300) in the amount of $250,000 (Major Street Construction, Fund 2007).

There are no General Funds planned or allocated for this project.

Local Business Enterprise (LBE): This is a federally funded project, therefore the City’s LBE policy is held in abeyance. Disadvantaged Business Enterprise (DBE) federal policy applies.

Mark Thomas & Company, Inc. pledged to meet or exceed the 13% DBE goal for this project.

RESOLUTION NO.
