Description/Analysis

Issue Detail: The California Joint Committee on Rules, is requesting the vacation of 12th Street between L Street and N Street to accommodate the New Capitol Annex Building (NCAB). The applicant is proposing a portion of the area to be vacated be incorporated into the project site. There are no known public utility facilities within the area proposed for vacation. The State of California is requesting that the City of Sacramento execute a quitclaim once the Resolution is recorded.

Policy Considerations: The City Council action recommended in this report is consistent with the Sacramento 2035 General Plan and in compliance with the California Streets and Highways Code, Sections 8300-8325.

Economic Impacts: None.

Environmental Considerations:

California Environmental Quality Act (CEQA): Consistent with the California Environmental Quality Act (CEQA), on July 30
th, 2021, the State of California,
Department of General Services (the State), as the lead agency, certified an environmental impact report (EIR) for the Capitol Annex Project. The Capitol Annex Project consists of the demolition and reconstruction of the existing Capitol Annex, construction of a new underground visitor welcome center, and construction of a new underground parking garage. The City was listed as a responsible agency for this project. Consistent with Public Resources Code section 21002.1(d), the Community Development Department, Environmental Planning Services Division (EPS), has reviewed and considered the Capitol Annex Project EIR with respect to the project currently before the City: the proposed vacation of 12 th Street between L Street and N
street. EPS has concluded none of the circumstances set forth in CEQA Guidelines sections 15162 or 15163 exist and the preparation of a subsequent or supplemental EIR is unnecessary. (See CEQA Guidelines section 15096(f).) Further, as the State has “required” the City to vacate 12th Street and all other “streets and alleys running through [Capitol Park],” the decision to vacate 12th Street is a ministerial decision and therefore exempt from CEQA. (Cal. Stats. 1871-1872, chptr. 600, pp. 887-889; Pub. Res. Code section 21080(b)(1).)

Sustainability: Not applicable.

Commission/Committee Action: None.

Rationale for Recommendation: The approval of this vacation/abandonment request will allow the State of California the ability to move forward with the New Capitol Annex Building (NCAB) project which consists of the restoration, rehabilitation, and reconstruction of the State Capitol Annex. Clearance has been given by affected City agencies and utility companies supporting the vacation of this public right of way and staff finds that this request for vacation is in conformance with the Streets and Highways Code (S&HC) Section 8300-8325.

Financial Considerations: The applicant is responsible for all fees required to process this application at no cost to the City.

Local Business Enterprise (LBE): Not applicable.
