Description/Analysis
Issue Detail:
City Council Resolution No. 2021-0234 was adopted on July 20, 2021, authorizing the Recycling and Solid Waste Division to submit an application for the CalRecycle Oil Payment (OPP12) Grant Program, authorizing the City Manager or the City Manager’s designee to execute all necessary documents to implement and secure payment, and, if awarded, accept an award not to exceed $200,000 for the Used Oil Payment Program.
Following adoption of Resolution No. 2021-0234, the Recycling and Solid Waste Division applied for the Oil Payment Grant Program and was awarded a grant for a not to exceed amount of $200,000. Recycling and Solid Waste began the process of executing appropriate documents to secure the payment and complete the transfer of funds. While doing this, it was discovered Resolution No. 2021-0234 inadvertently stated the incorrect Grant Program number.
Resolution No. 2021-0234 included the incorrect Grant Project number of G15003100 (OPP12).
The resolution should have stated the number is G15003020 (OPP12). To ensure that the prior approvals and actions remain in force and valid, this report recommends amending Resolution No. 2021-0234 to provide that the City Manager or City Manager’s designee is authorized to correct the grant project number to G15003020 (OPP12). Except as otherwise amended, all other provisions of Resolution No. 2021-0234 shall remain in full force and effect.

Rationale for Recommendation: City Council Resolution No. 2021-0234 was adopted on July 20, 2021, authorizing the Recycling and Solid Waste Division to apply to CalRecycle for an award not to exceed $200,000 for the Used Oil Payment Program, execute all necessary documents to implement and secure the payments, and, if awarded, accept funds for the program.
While establishing the Used Oil Payment Program in order to accept the award, the Recycling and Solid Waste Division discovered that the incorrect Grant Project number was included in the resolution adopted on July 20, 2021. Resolution No. 2021-0234 needs to be amended to reflect the correct grant project number before the fund transfer can be completed.
Financial Considerations: The resolution contained in this staff report amends Resolution No. 2021-2034 with the incorrect program number and reflect the authority to establish project G15003020 (OPP12) in order to permit the transfer of funds from CalRecycle for this program.
Local Business Enterprise (LBE): Not applicable.
