Description/Analysis

Issue Detail: On September 24, 2019, City Council approved the Professional Services Agreement with MIG, Inc. Since then, the parks master plan update process has had to redefine the public outreach program to incorporate online connections in response to COVID-19 and focus engagement on the youth demographic. The Parks Plan 2040 has had a robust public outreach and engagement program, which recently received the California Park and Recreation Society’s Award of Excellence. It is currently being drafted to reflect the community’s input in the update process and to incorporate the goals and policies of the General Plan 2040 and the Department’s 2018 Strategic Plan. The Parks Plan 2040 is also considered as one of the components of the 2040 General Plan that will receive environmental clearance from the adoption of the 2040 General Plan’s Master Environmental Impact Report (EIR).

The original contract with MIG, Inc. had been previously extended from the original period ending on June 30, 2021, to a revised contract period ending on September 30, 2022. Now, with the need to extend the consultant services to support the preparation of the Parks Plan 2040 until the adoption of the General Plan 2040 in Spring of 2023, staff recommends an extension of the contract period until December 2024.

The original contract with MIG, Inc. in an amount of $389,276 has been conservatively applied to the original tasks as outlined in the Contract Scope of Work. However, due to the additional time spent on project management and identification of additional project tasks by department staff, and the extended timeline for the General Plan 2040, the funds for the additional tasks and additional time spent on original tasks, MIG, Inc. is requesting an additional $75,740 to complete the project.

Policy Considerations: The Parks Plan 2040 is a component of the City’s General Plan 2040 and Master EIR, the Parks Plan 2040 ensures that the policies are aligned with the General Plan policies, level of service standards, implementation action programs, and is responsive to the current economic, social, and technological trends.

As required by City Code 3.64.040, for agreements originally awarded for a price of at least $250,000, but less than $1,000,000, council approval is required to issue supplemental agreements that increase the agreement amount, if the sum of all such supplemental agreements exceeds 10% of the original agreement price.

Economic Impacts: None

Environmental Considerations:

California Environmental Quality Act (CEQA): The approval of supplemental contracts is not considered a project as defined by Section 15378 of the California Environmental Quality Act (CEQA) guidelines. The recommended action involves no physical construction and has no potential to cause a significant impact to the environment.

Sustainability: The Parks Plan 2040 in conjunction with the General Plan 2040 will ensure that the relevant Sustainability goals, policies, and programs are in place to help reduce the city’s carbon footprint, adjust to changing climate, and quality of life.

Commission/Committee Action: Not Applicable

Rationale for Recommendation: Supplemental funds are required to continue with the update for the Parks Plan 2040 and consistency with the General Plan 2040.

Financial Considerations: There are adequate financial resources in the Parks Master Plan Project L19112500 to support the supplemental funds.

Local Business Enterprise (LBE): MIG, Inc. has satisfied the LBE requirement by contracting with a minimum of 5% of the contract.
