Description/Analysis
Issue Detail: Approval of this professional services agreement with Apparatus Testing and Engineering, Inc. is recommended to provide electrical testing for 71 Department of Utilities facilities.

These services are necessary to help the City meet current National Fire Protection Agency (NFPA) 70B guidelines concerning the testing of low voltage and medium voltage circuit breakers. These guidelines require testing of low voltage and medium voltage circuit breakers be conducted every three to five years to ensure their safe operation. This testing will determine if the circuit breakers are able to operate per the manufacturer’s specifications. In addition, Apparatus Testing and Engineering, Inc. will test numerous relays to ensure their reliability. The contract is proposed for $171,090 per year for five years for a not to exceed amount of $855,450.

Policy Considerations: City Council approval is required for professional service agreements of $250,000 or more per City Code 3.64.020.

Economic Impacts: This project is expected to create 3.42 total jobs (1.97 direct jobs and 1.45 jobs through indirect and induced activities) and create $528,184.77 in total economic output ($332,918.90 of direct output and another $195,265.87 of output through indirect and induced activities).

The indicated economic impacts are estimates calculated using a calculation tool developed by the Center for Strategic Economic Research (CSER). CSER utilized the IMPLAN input-output model (2009 coefficients) to quantify the economic impacts of a hypothetical $1 million of spending in various construction categories within the City of Sacramento in an average one-year period. Actual impacts could differ significantly from the estimates and neither the City of Sacramento nor CSER shall be held responsible for consequences resulting from such differences.

Environmental Considerations:

California Environmental Quality Act (CEQA): Performing electrical testing is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15309 (Inspections). This section consists of activities limited entirely to inspections to check for performance of an operation, or quality, health, or safety of a project, including related activities. The action involves electrical testing of existing facilities to help the City meet current NFPA 70B requirements to improve electrical safety and maintenance.

Sustainability: The proposed project is consistent with the 2035 General Plan as it will improve infrastructure reliability by making sure that the electrical infrastructure is not prone to failure during normal operation of DOU facilities.

Rationale for Recommendation: A Request for Proposals (RFP) was advertised on April 28, 2022.

The City received proposals from Apparatus Testing and Engineering, Inc. and Vistam Inc. City staff reviewed these proposals and selected Apparatus Testing and Engineering, Inc. to provide the electrical testing services as they met the requirements of the proposal.

The proposal from Vistam Inc. was rejected as they didn’t list a qualified LBE.

Financial Considerations: The proposed professional services agreement is for a one-year term with up to four one-year renewal options for a not-to-exceed amount of $855,450. Sufficient funding exists in DOU’s Fiscal Year 2022/23 approved operating budget to fund the first year of this agreement, in the amount of $171,090. Funding for future fiscal years is subject to availability in the budget adopted for the applicable fiscal year.

There are no General Funds allocated or planned for this project.

Local Business Enterprise (LBE): Apparatus Testing and Engineering, Inc. is not an LBE but has partnered with the following LBE businesses, CD & Power, Independent Electric Supply, California Trailer, and Bliss Power Equipment, for this project to meet or exceed the minimum LBE participation requirements.
