Description/Analysis
Issue Detail: The City was awarded federal funds to rehabilitate the corridor and improve the pedestrian and bicycle connectivity along Bell Avenue. The Bell Avenue Complete Streets Rehabilitation Project includes pavement rehabilitation, streetlighting, and pedestrian and bicycle improvements. The Project Plans and Specifications for the Bell Avenue Complete Streets Rehabilitation Project have been completed and advertised for construction. See Attachments for project plans and contracts.
The removal of three City-owned trees is needed to accommodate the installation of sidewalk and additional pavement width along Bell Avenue. All requirements of the City tree ordinance have been met.
Policy Considerations: The actions requested herein are consistent with the City’s goals of improving and expanding public safety and enhancing livability. Specific goals the project addresses are as follows:
M1.2.1 - The City shall develop an integrated, multimodal transportation system that improves the attractiveness of walking, bicycling, and riding transit over time to increase travel choices and aid in achieving a more balanced transportation system and reducing air pollution and greenhouse gas emissions.
These improvements will accommodate cyclists and will improve pedestrian safety.
The Sacramento City Code Section 4.04.020 and the City Council Rules of Procedure (Chapter 7, Section E.2.d) mandate that unless waived by a 2/3 vote of the City Council, all labor agreements and all agreements greater than $1,000,000 shall be made available to the public at least ten (10) days prior to City Council action. This item was published for 10-day review on July 14, 2022, in compliance with the City Code.
Sacramento City Code Ordinance No. 12.56.040 requires the City Council Approval for the removal of City Trees.
City of Sacramento Page 2 of 5
File ID: 2022-01253 7/26/2022 Consent Item 5.
Economic Impacts: This new infrastructure is expected to create 17.96 total jobs (10.33 direct jobs and 7.63 jobs through indirect and induced actives) and create $2,772,163 in total economic output ($1,747,316 of direct output and another $1,024,847 of output through indirect and induced activities).
The indicated economic impacts are estimates calculated using a calculation tool developed by the Center for Strategic Economic Research (CSER). CSER utilized the IMPLAN input-output model (2009 coefficients) to quantify the economic impacts of a hypothetical $1 million of spending in various construction categories within the City of Sacramento in an average one-year period. Actual impacts could differ significantly from the estimates and neither the City of Sacramento nor CSER shall be held responsible for consequences resulting from such differences.
Environmental Considerations:
California Environmental Quality Act (CEQA): The City of Sacramento Environmental Planning Services has reviewed the proposed project and determined that it is exempt from the provisions of CEQA under the Categorical Exemption for the operation, repair or minor alteration of existing public facilities involving negligible or no expansion of use and for new construction or conversion of small facilities, including street improvements, set forth in CEQA Guidelines Sections 15301(c) and 15303(d)(e) respectively.
National Environment Policy Act (NEPA): The California Department of Transportation (Caltrans) is the lead agency for NEPA, as assigned by the Federal Highway Administration for these federal grant funds. Caltrans senior environmental planning staff reviewed the project and determined a finding of categorical exclusion under 23 CFR 771 activity (c) (3 and 15).
Sustainability: This project advances active modes of transportation by designing a pedestrian- and bicycle-friendly corridor that provides improved accessibility to a wide range of users. A vibrant, multi-modal transportation system reduces vehicle miles traveled, helping the City to achieve reductions of greenhouse gas emissions. Transportation accounts for 56% of community-wide greenhouse gas emissions, the largest single sector in the community. This project implements strategies in the City’s Climate Action Plan to reduce vehicle trips and greenhouse gas emissions.
Commission/Committee Action: None.
Rationale for Recommendation: In order to deliver the Bell Avenue Complete Streets Rehabilitation Project, budgetary adjustments and contract award is necessary.
A request for proposals (RFP) was advertised on January 14, 2022, for professional services to support City staff with construction management and inspection. The City received proposals from three teams: 4 Leaf, Inc, UNICO Engineering, Inc, and 3D Built. Based upon the merits of the City of Sacramento Page 3 of 5
File ID: 2022-01253 7/26/2022 Consent Item 5.
written proposals and interviews of the consultant teams, a panel representing staff from the Department of Public Works reviewed and recommended UNICO Engineering, Inc. as the top-ranked consultant team. Approval by the City Council is needed to execute the agreement with UNICO Engineering, Inc. for an amount not to exceed $321,686.
The Bell Avenue Complete Streets Rehabilitation Project was advertised for construction, and a total of two bids were received on May 4, 2022. The results of the bids are summarized below:
Contractor Bid DBE (20%
Goal)
McGuire and Hester $4,489,806 3.2%
Martin Brothers Construction $4,758,237 11.4%
The engineer’s estimate was $4,163,870.
Both bidders met all required bid conditions. Staff recommends that the construction contract be awarded to the lowest responsive and responsible bidder, McGuire and Hester.
Construction is anticipated to begin August 2022 and to be completed December 2022.
Financial Considerations: The estimated total cost to complete design, right-of-way, and construction activities for the Bell Avenue Complete Streets Rehabilitation Project (T15145600) is approximately $6.8 million. With the budget approval of $4,845,024 (Federal Capital Grants, Fund 3703) and transfer of $265,000 (Major Street Construction, Fund 2007) and $225,000 (Road Maintenance and Rehabilitation, Fund 2036) from the State and Federal Grant Match Program (T15007200), there will be sufficient funding to award the construction contract to McGuire and Hester for an amount not to exceed $4,489,806; to execute the Professional Services Agreement with UNICO Engineering, Inc. for an amount not to exceed $321,686 for construction management services; and to cover all other remaining project related costs.
There is sufficient funding within the State and Federal Grant Match Program (T15007200) to support the transfer to the Bell Avenue Complete Streets Rehabilitation Project (T15145600).
There are no General funds planned or allocated for this project.
Local Business Enterprise (LBE): The contract with UNICO Engineering, Inc. is a federally funded contract and as a result Disadvantaged Business Enterprise (DBE) project participation requirements apply. LBE rules are held in abeyance. The contract award will comply with all federal DBE participation requirements. UNICO Engineering Services, Inc. has pledged 80.56% DBE project participation, exceeding the 12% DBE goal set for this contract. The construction contract with City of Sacramento Page 4 of 5
File ID: 2022-01253 7/26/2022 Consent Item 5.
McGuire and Hester is also subject to DBE participation requirements with a goal of 20%. McGuire and Hester did not meet the goal by pledging 3.2%; however, they did fulfill the DBE Good Faith Effort requirement in lieu of the goal.
