California Environmental Quality Act (CEQA): No environmental review is necessary because the recommendations in this report involve the purchase maintenance services and are not considered to be a project in accordance with Section 15378(b)(2) of the CEQA guidelines.
Sustainability: Ongoing maintenance and repairs of fueling infrastructure prevents environmental hazards.
Commission/Committee Action: None.
Rationale for Recommendation: On August 15, 2017, City Council passed a Motion No. 2017-0231 (Contract 2017-1028), awarding a five-year contract to Clean Energy for the purchase of LNG Fuel Site Tank Maintenance services. The Fleet Management Division has determined that, due to an extended process for the bid solicitation regarding prevailing wage provisions, the current contract will expire prior to completing a bid solicitation and finalizing a new contract. Fleet Management recommends approval of Contract Supplement No. 5 to avoid any disruption in service.
Financial Considerations: Sufficient funds are available in the Department of Public Works, Fleet Management Division’s Fiscal Year 2022/23 operating budget (Fleet Fund, Fund 6501) to purchase maintenance services through February 23, 2023.
Local Business Enterprise (LBE): Clean Energy is not an LBE. The minimum LBE participation requirement was waived by the Director of Public Works. Staff conducted an extensive search within the local area and found limited vendors that would meet the specifications required for the bid.
