Description/Analysis
Issue Detail: The renovation and expansion of the SAFE Credit Union Performing Arts Center has modernized and improved the facility and is currently being operated and hosts a variety of community events. The opening has contributed to the overall economic vitality of the reopening of the downtown area. The renovation of the SAFE Credit Union Performing Arts Center (PAC) has addressed issues with compliance of the Americans with Disabilities Act (ADA) and has improved the patron experience with better sound and acoustics, as well as improved operations and functionality.
Although the PAC opened and is being operated, the contractor has been working around the events to complete the project. Approval of this change order is necessary to complete the construction for the PAC.
Change Order No. 23 (Supplemental Contract No. 28) in the amount of $1,642,500 with Kitchell CEM, Inc. compensates the contractor for a settlement amount to cover construction costs, resolve all claims and to cover other fees associated with meeting the deadline to open for the first scheduled event in September 2021. This change order is a final lump sum amount to extend the schedule and finalize the building by August 2022.
Policy Considerations: The improvements to the PAC support the following goals and policies of the City’s General Plan:
· ERC 4.1.3 City-Owned Resources. The City shall enhance the quality of existing City-owned arts and cultural resources and facilities through reinvestment, communications, and marketing.
· ERC 4.1.5 The city shall support renovation and expansion of CC facilities and adjacent supportive infrastructure, including hotels, to attract top tier national and international events.
The renovation and expansion of the SAFE Credit Union Performing Arts Center will allow the facility to remain attractive and competitive in the future, providing a venue for the performing arts community. It is also anticipated to generate increased economic vitality for the downtown core.
The Sacramento City Code Section 4.04.020 and Council Rules of Procedure (Chapter 7, Section E.2.d) mandate that unless waived by a two-thirds vote of the City Council, all labor agreements, and all agreements greater than $1,000,000 shall be made available to the public at least ten (10) days prior to council action. This item was published for 10-day review on July 28, 2022, in compliance with the City Code.
Economic Impacts: The PAC construction contract requires compliance with the approved Community Workforce and Training Agreement (CWTA), which require local hiring and allow for City of Sacramento Page 2 of 4

targeted employment opportunities for Sacramento residents.
This new infrastructure of the SAFE Credit Union Convention and Performing Arts District is expected to create 16.80 total jobs (9.66 direct jobs and 7.14 jobs through indirect and induced actives) and create $2,593,227.00 in total economic output ($1,634,530.80 of direct output and another $958,696.20 of output through indirect and induced activities).
The indicated economic impacts are estimates calculated using a calculation tool developed by the Center for Strategic Economic Research (CSER). CSER utilized the IMPLAN input-output model (2009 coefficients) to quantify the economic impacts of a hypothetical $1 million of spending in various construction categories within the City of Sacramento in an average one-year period. Actual impacts could differ significantly from the estimates and neither the City of Sacramento nor CSER shall be held responsible for consequences resulting from such differences.
Environmental Considerations:
California Environmental Quality Act (CEQA): On April 27, 2010, City Council found the PAC Renovation Project to be exempt from CEQA, citing Section 15302, which provides that projects involving replacement or reconstruction of existing structures and facilities are exempt from CEQA. (Resolution No. 2010-0208).
Sustainability: The PAC project will be designed in accordance with City policy LU 8.1.5 and will meet the LEED Silver equivalent standards.
Commission/Committee Action: Not applicable.
Rationale for Recommendation: The PAC improvements will enable the facility to remain competitive with other performing and event venues in California. In addition, the project is expected to bring more jobs, spending, visitors, and hotel stays in Downtown Sacramento. Approval of Change Order No. 23 with Kitchell CEM Inc. for the PAC is necessary to complete the PAC project.
Financial Considerations: There is sufficient funding in the Convention Center Complex Renovation Project (M17100100) to execute Change Order No. 23 (Supplemental Agreement No. 28) to Contract No. 2017-0781 with Kitchell CEM, Inc. for a not-to-exceed amount of $1,642,500.
Approval of the budget adjustments is necessary to complete all remaining activities within the Convention Center Complex Renovation Project (M17100100). Sufficient funding is available in the available fund balances of the 2018 Tax-Exempt TOT Bond Fund (Fund 6330), the 2018 Taxable TOT Bond Fund (Fund 6331), and the STID Bond Fund (Fund 6332) to support the recommended budgetary adjustments. There is no impact to the General Fund.

RESOLUTION NO. 2022-
Adopted by the Sacramento City Council
Funding for Improvements to SAFE Credit Union Performing Arts Center
BACKGROUND
A. On October 18, 2016, City Council directed staff to proceed with the design of the SAFE Credit Union Performing Arts Center (PAC) Renovation Project.
B. On January 24, 2017, City Council approved Resolution No. 2017-0036, which allows for issuance of bonds for the SAFE Credit Union Convention Center, PAC and Memorial Auditorium projects to be used to cover design and other costs associated with this project.
C. On September 25, 2018, City Council authorized the issuance and sale of the 2018 Transient Occupancy Tax Revenue Bonds in an amount not exceeding $350 million to finance various capital improvement projects, including the PAC.
D. On October 30, 2018, the City Council established the Sacramento Tourism Infrastructure District No. 2018-04 (STID) for the purpose of levying a new assessment of lodging businesses within the City and certain unincorporated portions of Sacramento County. Assessment revenues were to be used primarily to pay debt service associated with the assessment revenue bonds the City issued in August 2019 to finance an additional ballroom in the SAFE Credit Union Convention Center.
E. The PAC renovation was needed to address compliance with Americans with Disabilities Act requirements, improve patron experience, including better sound and acoustics, and theater operations and functionality. These renovations addressed long-standing deficiencies and enables the building to host more events in the future.
