Description/Analysis
Issue Detail: Staff recommends Council approve an agreement with Larry Walker Associates, Inc. (LWA) for stormwater monitoring services and regulatory support for Fiscal Year (FY) 2022/2023, which will include reporting activities through December 2023.

In accordance with the Central Valley Regional Water Quality Control Board Regional Municipal Separate Storm Sewer System (MS4) National Pollutant Discharge Elimination System (NPDES) Permit, the City and its partners in the Sacramento Stormwater Quality Partnership (Partnership) are required to conduct a monitoring program and implement stormwater pollution reduction programs.

Services provided by the consultant through this agreement include stormwater regulatory support services and required water quality monitoring for up to three years. Extension of the Agreement term beyond this initial one-year term will require future City Council approval.

Policy Considerations: City Council approval is required for professional service agreements of $250,000 or more per City Code 3.64.020.

Economic Impacts: None.

Environmental Considerations: This report concerns administrative activities that will not have a significant effect on the environment and does not constitute a “project” as defined by California Environmental Quality Act (CEQA) [CEQA Guidelines Sections 15378(b)(2 and 5)] and is therefore, not subject to CEQA [CEQA Guidelines Section 15060(c)(3)].

Sustainability: The proposed project is consistent with the 2035 General Plan by supporting the policy to “control sources of pollutants and improve and maintain urban runoff water quality through storm water protection measures consistent with the City’s NPDES Permit” (Goal ER1.1.3) as it will assist City in meeting the regulatory objectives in the NPDES Permit with a goal to improve and maintain urban runoff water quality.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: On May 9, 2022, a Request for Qualifications (RFQ) (Q23141311001) was advertised and issued on PlanetBids for technical expertise to meet the Central Valley Region-wide MS4 NPDES permit requirements, conduct stormwater monitoring, and develop pollutant strategies. On the due date of June 2, 2022, two Statements of Qualifications (SOQs) were received from the following firms:

1. Alisto Engineering Group

2. Larry Walker Associates, Inc.

A three-member evaluation team that included staff from DOU, one member from the County of Sacramento Department of Water Resources, and one member for the City of Rancho Cordova, evaluated the proposals. LWA was the top-ranked firm.

Financial Considerations: The proposed agreement is for an amount not-to-exceed $642,299.

The cost of this services agreement will be shared by the Partnership pursuant to the terms of a master Memorandum of Understanding (MOU), approved by the City Council at the July 31, 2012 council meeting (City Resolution No. 2012-279).

The proposed agreement includes SSQP cost-shared services in the amount of $573,768 and $68,531 for City only services. Sufficient funding exists in the NPDES Stormwater Program (I14010200), Storm Drainage Fund (6011) and NPDES Stormwater Program, Storm Drainage Fund Reimbursables (Fund 6211) to award the agreement.

Sacramento Office of Water Programs will provide stormwater management, tool development and policy and regional coordination. Wood Rodgers will provide technical expertise related to low impact development.

Heights, Elk Grove, Folsom, Galt, and Rancho Cordova (Permittees) regulating the discharge of stormwater into local water bodies. The permit requires implementation of programs to reduce the pollution conveyed by stormwater runoff into local water bodies and requires implementation of a stormwater monitoring program.

The City is administering the contract for these services on behalf of the Partnership and will receive reimbursement for the cost share of the other permittees. The costs for implementing some of these programs are shared by the Partnership, as described in a master MOU approved by the City Council in 2012 (City Agreement No. 2012-279). The MOU includes administrative procedures for sharing of work products and apportionment of program costs, including monitoring activities.

A significant portion of the stormwater program is accomplished through annual professional services agreements. These services include development of sampling plans, field sampling, equipment upgrades, technical assistance, laboratory analyses, and preparation of reports. The FY2022/2023 services agreement scope includes effectiveness assessment, water quality monitoring, assistance with permit implementation, support for implementing new development stormwater requirements, and technical expertise on stormwater policy and regulations. In addition, the scope of work includes technical and regulatory support tasks conducted solely for the City such as illegal discharge sampling and response, spill response and characterization, laboratory analyses and environmental compliance assistance.
