Description/Analysis
Issue Detail: Staff recommends Council approve an agreement with Carollo Engineers, Inc. and Brown & Caldwell for on-call specialty inspection services for various utility infrastructure improvement projects. Many Department of Utilities (DOU) projects require specialized inspection expertise on project components such as structural, mechanical, electrical, and drinking water systems that could include, but are not limited to, improvements at treatment plant facilities, storage tanks, pump stations, groundwater wells and associated infrastructure, electrical control systems, steel/concrete repairs, and water transmission mains.

Each year, DOU performs millions of dollars in construction projects which include repairing/replacing existing infrastructure, modifying existing systems, and the construction of new systems to support City of Sacramento Page 1 of 3

the utilities. Much of the construction is supported by in-house City inspectors; however, many DOU projects include more specialized construction that require special inspection to ensure the improvements are completed correctly and in a timely manner. Specialized inspectors are also needed to enter confined spaces, witness equipment testing, and confirm complex regulations are being met.

Policy Considerations: City Council approval is required for professional service agreements of $250,000 or more per City Code 3.64.020.

The Sacramento City Code Section 4.04.020 and Council Rules of Procedure (Chapter 7, Section E.2.d) mandate that unless waived by a 2/3 vote of the City Council, all labor agreements and all agreements greater than $1,000,000 shall be made available to the public at least ten (10) days prior to council action. This item was published for 10-day review on September 29, 2022, in compliance with the City Code.

Economic Impacts: None
Environmental Considerations:

California Environmental Quality Act (CEQA): The proposed agreements for on-call inspection for utility infrastructure have been determined to be exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of the CEQA Guidelines.

Section 15061(b)(3) consists of activities covered by the common sense exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on an environmental resource, the activity is not subject to CEQA. The activity would also be exempt pursuant to CEQA Guidelines Section 15309 (Inspections), which consists of activities limited to inspections, to check for performance of an operation, or quality, health, or safety of a project.

Sustainability: The proposed project is consistent with the 2035 General Plan by improving infrastructure reliability, which will prolong the useful life of existing utility infrastructure and ensure that utility systems will remain at a high level of service.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: On May 25, 2022, a Request for Qualifications (RFQ) (Q23141311004) was advertised and issued on for On-Call Specialty Inspection Services. On the due date of June 23, 2023, five (5) Statements of Qualifications (SOQs) were received from the following firms:

1. Brown & Caldwell

2. Carollo Engineers, Inc.

3. JLR Environmental Consultants, LLC

4. Matriscope Engineering Laboratories, Inc.

5. Unico Engineering
A three-member evaluation team that included staff from DOU evaluated the proposals. On August 2, 3, and 4, 2022, e-meeting interviews were conducted with Brown & Caldwell, Carollo Engineers Inc., and Unico Engineering. JLR Environmental Consultants, MatriScope Engineering Laboratories, and Unico Engineering were deemed not to have the experience needed to meet the scope of services and thus Brown & Caldwell and Carollo Engineers Inc. were deemed to be the only qualified firms for the needed services.

Financial Considerations: The proposed on-call agreements have an initial three-year term, with a maximum of two one-year renewals. Brown & Caldwell and Carollo Engineers, Inc. may have multiple assignments within a year; however, the total three-year not-to-exceed amount is $1,000,000 per contract. Services under these agreements are intended to be used to fill needs when demand warrants. Purchase orders encumbering funds under these agreements will not be created until projects and funding are identified. Funding of this agreement in future fiscal years will be subject to availability of sufficient funds in the budget adopted for the applicable fiscal year.

There are no General Funds allocated or planned for this project.

Local Business Enterprise (LBE): Brown & Caldwell and Carollo Engineers, Inc. are LBE’s.
