Description/Analysis
Issue Detail: As provided in Sacramento City Code Chapter 12.16 and California Vehicle Code Section 21101.4 and pursuant to City Council Resolutions 2021-0084, 2021-0100, 2021-0151, 2022- 0073, and 2022-0095, the subject alleys/streets were temporarily closed to through vehicular and pedestrian traffic for an 18 month period due to serious and continual criminal activity. The City Council may extend temporary closures for up to eight additional periods of up to 18 months if the extension would assist in preventing the occurrence or reoccurrence of serious and continual criminal activity. This request for 18 month extensions is the first of potentially eight authorized extensions.

once the closure extensions for these subject alleys have been approved by the City Council. The adjacent property owners overwhelmingly support the temporary closure status of the subject alleys/streets in order to prevent the occurrence or reoccurrence of serious and continual criminal activity. The Police Department, Fire Department, and Transportation Division support and recommend the 18-month time extension of the existing temporary closures of the subject alleys and streets as listed in Exhibit A and Exhibit B of the attached Resolution.
Policy Considerations: The procedures under which the closure to vehicular and pedestrian traffic is initiated are set forth in Vehicle Code Section 21101.4 and Sacramento City Code Chapter 12.16.
These codes allow the temporary closures of alleys and streets to through vehicular and pedestrian traffic for the protection or preservation of the public peace, safety, health or welfare. The temporary closures are consistent with the Public Work’s Strategic Plan vision statement, “The Department of Public Works strives to preserve and enhance quality of life”.
Economic Impacts: None.
Environmental Considerations:
California Environmental Quality Act (CEQA): Temporary closures of streets and alleys constitutes a minor alteration of a public facility, with no increase in use and no additional automobile lanes. The action is categorically exempt from CEQA review pursuant to CEQA Guidelines section 15301(c).
Sustainability: Not applicable.
Commission/Committee Action: None.
Rationale for Recommendation: Adoption of the attached Resolution will provide the continued security of the properties’ owners by eliminating the opportunity for individuals to commit illegal acts and illegal dumping within these subject alleys and streets.
Financial Considerations: The estimated cost of the temporary closure of the subject alleys and streets is approximately $13,000 and is included as part of the ongoing program maintenance and inspection. There is sufficient funding in the Alley Abatement Program (T15100900) to support the subject street closures.
Local Business Enterprise (LBE): Not applicable.
Background: The subject alleys/streets are public rights-of-way that were once unrestricted to through vehicular and pedestrian traffic. Due to the continued illegal activity such as burglary, vandalism, and illegal dumping the City Council approved the temporary closures of the subject 108 alleys/streets. The temporary closure of these alleys/streets are valid for 18 months from the time that they were initially approved. To extend the temporary closure status of these alleys/streets for an additional 18 months requires City Council approval. The temporary closures were processed City of Sacramento Page 2 of 3

pursuant to California Vehicle Code Section 21101.4 and City Code Chapter 12.16 and were authorized to be closed to through vehicular and pedestrian traffic for an initial 18 month period. The alley/street locations are included as Exhibits A and B.
Extension of a temporary closure of streets requires that certain criteria be met:
1. Continuation of the temporary closure will assist in preventing the occurrence or reoccurrence of the serious and continual criminal activity found to exist when the immediately preceding temporary closure was authorized. This finding shall be based upon the recommendation of the police department.
2. The street has not been designated as a through highway or arterial street.
3. Vehicular or pedestrian traffic on the street contributes to the criminal activity.
Support for the temporary closure extensions in addition to meeting the criteria for this action is provided as Attachments 2, 3, and 4 by the Police Department, Fire Department, and Public Work’s Department Transportation Division, respectively.
The approval of the temporary closure extensions requires that the already required security devices, wrought iron gates, locking mechanisms, electric gates, bollards and non-standard gates be maintained by the responsible parties as described in the initial temporary closure.
The temporary closure extensions of the subject alleys/streets listed are not to exceed eighteen 18 months unless the closures are extended pursuant to the procedures set forth in Sacramento City Code Chapter 12.16. Pursuant to Sacramento City Code Chapter 12.16, once approved, the closures may be extended up to an additional eight consecutive periods of not more than 18 months each.
Noticing to the public regarding the temporary street closures has been completed prior to this City Council meeting in accordance with City Code Section 12.16.220. Approval of the extensions will create updated expiration dates for the following Resolutions with dates of expiration; 2021-0084_4/11/2024, 2021-0100_4-11-2024, 2021-0151_

FROM: Department of Public Works, Transportation Division
SUBJECT: CLEARANCE FOR THE TEMPORARY CLOSURE, TIME EXTENSION OF 108 ALLEYS/STREETS LOCATED IN COUNCIL DISTRICTS 2, 3, 4, 5 & 6
In reference to the requested T emporary Closure time extension of the subject alleys/streets in Council Districts 2, 3, 4, 5 & 6, I have reviewed the material of the subject rights-of-way. I find that the subject alleys/streets are under the City of Sacramento’s jurisdiction and the temporary closures of the subject areas do not include through highways or arterial streets. It also appears that maintaining the temporary closures will allow adequate and safe traffic circulation on the adjacent streets. The Department of Public Works supports the temporary closure time extension request of the subject alleys/streets, per Exhibit A and Exhibit B.

Proceeding No. TSC22-0001
BACKGROUND
A. The City previously approved the Temporary Closure of the 108 subject alleys/streets in Council Districts 2,3,4,5 and 6. This request is for an 18 month time extension of the 108 active Temporary Closures that were approved by Resolutions 2021-0084, 2021-0100, 2021-0151, 2022-0073 and 2022-0095.
B. In accordance with Section 21101.4 of the Vehicle Code of the State of California and with Chapter 12.16 of the Sacramento City Code, the City Council hereby considers approval of the extensions of the temporary street closures to through vehicular and pedestrian traffic of the subject alleys/streets identified in Exhibit A of this resolution to help prevent occurrences of crime-related activities.
BASED ON THE FACTS SET FORTH IN THE RECITALS, THE CITY COUNCIL RESOLVES AS FOLLOWS:
Section 1. Based upon substantial evidence present in the record of the proceedings regarding this matter, City Council hereby makes the following findings:
a) The extensions of the closures of the 108 subject alleys/streets to vehicular and pedestrian traffic will assist in preventing the occurrence or reoccurrence of the serious and continual criminal activity that was found to exist when the 108 alleys/streets were initially closed.
b) The alleys/streets recommended for closure are under the City's jurisdiction and have not been designated as a through highway or arterial street.
c) Vehicle or pedestrian traffic in the alleys/streets recommended for closure contributes to the criminal activities that are occurring there.
d) The alleys/streets closures will not adversely affect traffic flow, safety on the adjacent streets or in the surrounding neighborhoods, the operation of
emergency vehicles, the performance of municipal of public utility services, or the delivery of freight by commercial vehicles in the vicinity of the alleys/streets recommended for closure.
Section 2. The extensions of the temporary closures of the subject alleys/streets identified in Exhibit A of this resolution to through vehicular and pedestrian traffic are necessary for the protection or preservation of the public peace, safety, and health or welfare of the neighborhoods.
Section 3. Under Vehicle Code Section 21101.4 of the California Vehicle Code, all temporary closures are valid for 18 months except for when this period has been extended for an additional 18 months of not more than eight additional consecutive periods by resolution.
Section 4. The City Council approves the extensions of the temporary closures of the subject alleys/streets identified in Exhibit A to through vehicular and pedestrian traffic for up to an additional 18 months from their current expiration dates as provided below with the following conditions.
a. A locking security device approved by the Sacramento Fire Department will be installed on each gate.
b. City departments and utility companies will have twenty-four-hour access to their facilities within the alleys/streets.
c. Adjacent property owners may be granted access to the alleys/streets through the security device that has been approved the City’s Department of Public Works.
d. In the event that the traffic control device(s) requires construction by a private entity for improvements in the public rights-of-way, a revocable encroachment permit must be obtained from the Department of Public Works. The revocable encroachment permit may be issued subsequent to this Resolution but must be obtained prior to the construction of improvements in the alleys/streets.
The expiration date(s) with extensions for Resolutions:
2021-0084 is 4/11/2024, 2021-0100 is 4/11/2024, 2021-0151 is 4/11/2024, 2022-0073 is 3/8/2025 and 2022-0095 is 4/5/2025
