Additional Description/Analysis
Issue Detail: Staff recommends Council approve Supplemental Agreement No. 1 with Tidal Marine Construction, Inc., for continuing On-Call Underwater Diving and Remote Operated Vehicle (ROV) services to support DOU Drinking Water and Stormwater facilities. Additional authority under the existing contract is necessary to complete diving efforts needed during the 2022-23 winter time frame while the Sacramento River Water Treatment Plant is going through its maintenance period.
Policy Considerations: The proposed supplemental agreement exceeds the City Manager’s approval authority, requiring Council approval. This work is consistent with the criteria set forth in the
File ID: 2022-01847 11/1/2022 Consent Item 10.
Department of Utilities (DOU) Capital Improvement Project Programming Guide to rehabilitate, replace, and expand critical infrastructure to ensure reliability and safety.
Economic Impacts: None.
Environmental Considerations:
California Environmental Quality Act (CEQA): Per the California Environmental Quality Act (CEQA) Guidelines Section 15061(b)(3), approval of the proposed Supplemental Agreement is exempt from the CEQA, under the common sense exemption that CEQA only applies to actions with potential to significantly affect the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on an environmental resource, the activity is not subject to CEQA. Approval of these Supplemental Agreements will not affect the environment. Work to be conducted under the agreements has been determined to be exempt from CEQA pursuant to CEQA Guidelines Sections 15301 and 15309 (Existing Facilities and Inspections). The work consists of the operation, repair, maintenance and minor alteration of existing facilities and mechanical equipment and inspections to check for performance of an operation, or quality, health, or safety of a project.
Sustainability: The proposed project is consistent with the 2035 General Plan as it improves infrastructure reliability and sustainability by providing supporting services that help continue operations and improve operations of various DOU facility systems.
Commission/Committee Action: Not applicable.
Rationale for Recommendation: The Sacramento River Water Treatment Plant intake needs annual inspection and cleaning that require divers. Tidal Marine Construction, Inc. has developed an understanding of the equipment needed to conduct the specialized cleaning, has extensive knowledge of the site and constraints, and understands the coordination necessary to complete this work. For this reason, it is in the best interest of the City to approve the Supplemental Agreement in order to complete this year’s inspection and cleaning.
On February 19, 2020 Request for Qualifications (RFQ) Q20141311013 was issued for On-Call Underwater Diving and ROV Services for Drinking Water and Stormwater Facilities.
On the due date of Wednesday, March 18, 2020, proposals were received from the following 5 firms:
DRS Marine, Harbor Offshore, Hiuga Diving, Tidal Marine, and Underwater Resources. The proposals were evaluated and scored by a three-member evaluation team that included staff from DOU.
Scores were tabulated and totaled with the proposals from Tidal Marine Construction, Inc. and
File ID: 2022-01847 11/1/2022 Consent Item 10.
Underwater Resources, Inc. having the highest and second highest scores, respectively.
During the time frame of the existing contracts, several unexpected diving needs arose, including pipeline assessments, treatment system repairs, and specialized underwater cleanings that impacted the available contract authority to complete the fiscal year 2022-23 needs at the Sacramento River Water Treatment Plant.
Financial Considerations: The original not-to-exceed amount of the agreement was $500,000. The proposed Supplemental Agreement No. 1, in the amount of $175,000, would increase the agreement not-to-exceed amount to $675,000. Sufficient funds are available in the FY2022-23 Department of Utilities Operating Budget to execute the agreement.
There are no General Funds allocated or planned for this project.
Local Business Enterprise (LBE): Tidal Marine Construction, Inc. is not an LBE. The minimum LBE participation requirement was waived by the Director of Utilities based on a determination that waiver is in the City’s best interest due to the lack of qualified local vendor availability.
