Additional Description/Analysis
Issue Detail: Pursuant to the California Surplus Land Act (California Government Code § 54220 et seq.), the City Council must declare property as either “surplus land” or “exempt surplus land” before the City can dispose of it or participate in negotiations to dispose. “Surplus land” is real property owned in fee simple that is not necessary for the City’s use.
The purpose of the Resolution is to formally declare the following properties to be surplus land in compliance with the Surplus Land Act:
1. 3630 Larchwood Drive (portion south of Patio Avenue) - portion of APN 250-0390-036
File ID: 2022-01900 11/15/2022 Consent Item 23.
2. 2260 Glen Ellen Circle - APN 035-0131-053
3. Portion of 2264 Glen Ellen Circle - portion of 035-0131-054
4. Northeast corner of Fair Oaks Boulevard and Howe Avenue - APN 294-0110-012 3630 Larchwood Drive was acquired by the City via a land dedication in 1998. The portion located south of Patio Avenue is currently vacant and approximately 3.66 net acres. The majority of the parcel is zoned R-3 (Multi-family residential), with a small portion zoned SC-PUD (Shopping center- Planned unit development).
2260 and 2264 Glen Ellen Circle were purchased by the City in 1997. 2260 Glen Ellen Circle is improved with a vacant 2-story residential building in fair condition on an approximately 13,575 square foot lot. The property had previously been converted and used as general office space by the Department of Utilities. A small portion of the south end of 2264 Glen Ellen Circle is included in order to allow for sufficient set-back from the existing structure on 2260 Glen Ellen Circle. This small portion is improved with concrete pavement and is approximately 1,900 square feet in area. Both parcels are zoned R-1 EA-4 (Single family residential, Executive Airport overlay zone 4). The Department of Utilities has vacated 2260 Glen Ellen Circle though and has no future need to use the building.
The northeast corner of Fair Oaks Boulevard and Howe Avenue was purchased by the City in 1976.
This is a vacant parcel approximately 41,885 square feet (net) in area. Zoning is A-PUD (Agriculture - Planned unit development). Easements for existing utilities and right of way on the property will be reserved.
Staff have consulted with the various City departments and determined that the above-described properties are not necessary for City’s use and are not designated for any current or future City projects.
Policy Considerations: The recommendations in this report are in accordance with the provisions of the Surplus Land Act.
Economic Impacts: None.
Environmental Considerations:
California Environmental Quality Act (CEQA): The City Council declaration that a parcel is surplus land is in compliance with a statutory requirement and is not part of a project that has been identified, designed, or funded. No physical change in the environment would occur. The action is an administrative activity that would not result in direct or indirect physical changes in the environment and is not a project as defined in CEQA. (CEQA Guidelines section 15378(b) (2); 15060(c)(3)).

Sustainability: Not applicable.
Commission/Committee Action: None.
Rationale for Recommendation: The Surplus Land Act requires the City Council to declare property as “surplus land” supported by written findings before any action can be taken to dispose of the property. Adoption of the Resolution by the City Council will allow for possible sale of the subject properties in accordance with the requirements of the Surplus Land Act. Before disposing of the surplus properties or participating in negotiations to dispose of the surplus properties, the City will send a written notice of availability to certain designated entities and complete all other actions required under the Surplus Land Act.
Financial Considerations: Not applicable.
