Description/Analysis
Issue Detail: The applicant is requesting to construct a 160,526-square-foot Costco Warehouse retail store on approximately 19.31 acres in the Shopping Center (SC-PUD) zone within Quadrant C of the Natomas Crossing Area 3 Planned Unit Development. The proposed hours of operation for the Costco store are from 9am to 8:30pm, Monday through Friday, and 9am to 7pm on Saturday and Sunday.
The requested entitlements include: 1) Conditional Use Permit for a Retail Store over 60,000 square feet in size; and 2) Site Plan and Design Review for the construction of a 160,526-square-foot warehouse retail store. This project requires a Planning and Design Commission-level Conditional Use Permit (CUP).
Third Party Appeal
: On October 13, 2022, the Planning and Design Commission unanimously approved the Costco Warehouse Natomas project. Within the 10-day appeal period, an appeal of the Commission’s decision to approve the project was submitted to the City. The appellant asserts that the Environmental Impact Report (EIR) addendum prepared for this project is inappropriate under the requirements of the California Environmental Quality Act (CEQA) and that a supplemental EIR is required. The Appeal cites changed conditions and the nature of the proposed project as reasons requiring a supplemental EIR. The appeal lists an example of changed conditions as the adoption of the October 2020 Transportation Analysis Guidelines (“TAG”) by Sacramento County in furtherance of the shift of traffic analysis to vehicle miles travelled (“VMT”) and the claim that the Final EIR does not contain any such analysis. The appeal also states the proposed Costco would create new traffic patterns surrounding the site, would increase new vehicle-intensive uses, and that this analysis was not included in the 2009 Final EIR. Lastly, the appeal asserts that the Sacramento Metropolitan Air Quality Management District (SMAQMD) revised regulations and guidelines in 2018, and that the accelerating pace of climate change and changes in local conditions, were not analyzed or factored into the analysis in the 2009 FEIR. The appeal submitted to the City can be found in Attachment 7.
Environmental Planning Services has reviewed the appellant’s claim and concludes that the Addendum was prepared pursuant to CEQA Guidelines sections 15162-15164. The Addendum includes a full discussion supporting the conclusion that the proposed project would not result in any of the circumstances set forth in CEQA Guidelines section 15162. Public Resources Code section 21166, and CEQA Guidelines section 15162, prescribe that no subsequent or supplemental environmental impact report shall be required by a lead agency (the City here) or responsible agency unless one or more of the following events occurs:
1. Substantial changes are proposed in the project that will require major revisions of the environmental document.
2. Substantial changes occur in the circumstances under which the is being undertaken that will require major revisions in the environmental document.
3. New information of substantial importance to the project that was not known and could not have been known at the time the environmental document was certified or adopted as complete becomes available.
The Addendum includes a detailed review of the proposed project, including discussion of technical areas of air quality, greenhouse gas emissions, and transportation and circulation. Discussions of
File ID: 2022-01916 11/15/2022 Public Hearing Item 34.
potential impacts are related to the original Natomas Crossing EIR. The Addendum also includes a discussion of the surrounding development in the project vicinity, concluding that the area has developed consistent with the projections that were assumed in the original EIR.
The Addendum relies on the environmental impact analysis of the Natomas Crossing EIR, confirming the analysis applied to the present project, the project evaluated in the Natomas Crossing EIR, and the required elements of the review required by CEQA Guidelines section 15162. Environmental staff have reviewed the comments and have determined that no additional analysis is required. The Addendum is the appropriate document for CEQA purposes and is supported by substantial evidence. Staff notes that new legal enactments such as the adoption of regulations or guidelines do not constitute new information if the information about the underlying issue was known (or should have been known) at the time the original EIR was certified. (See, e.g., Concerned Dublin Citizens v City of Dublin (2013) 214 Cal.App.4th 1301, 1320 (adoption of new BAAQMD thresholds for establishing significant environmental impacts from GHG emissions [which were set aside in another case] was not significant new information requiring further CEQA review); Fort Mojave Indian Tribe v Department of Health Servs. (1995) 38 Cal.App.4th 1574, 1605 (new regulation designating critical habitat for an endangered species was not significant new information requiring further CEQA review).
Public/Neighborhood Outreach and Comments
: As part of the application review process, the
proposal was routed to Preservation Sacramento, Civic Thread (formerly WALKSacramento), Sacramento Area Bicycle Advocates, Region Builders, Jibe, Environmental Council of Sacramento (ECOS), Natomas Community Association, Natomas Chamber of Commerce, Witter Ranch Community Alliance, North Natomas Community Association, and North Natomas Community Coalition.
Staff received comments from Jibe (North Natomas Transportation Management Association), the North Natomas Community Coalition (NNCC), and a member of the community (also the third-party appellant) requesting that City staff prepare a supplemental EIR (SEIR).
Jibe’s comments emphasized the need for strong pedestrian and bicycle connections on the site.
Given the adjacency of a Class I Multi-Use trail, pedestrian and bicycle connections should be prioritize multi-modal forms of transportation. Jibe’s comments further requested that bicycle parking is close to the store entrance, and that the operator provide employees with the opportunity and infrastructure to bike to work.
The comments made by Jibe echo many of the requirements of the PUD as well as the comments made by Planning staff. The applicant worked closely with staff to ensure that strong and safe pedestrian connections are provided and that connections to the bike trail and present and in appropriate locations.
The NNCC letter expressed support for the project but expressed a number of concerns with the project design and overall appearance; pedestrian and bicycle infrastructure; trees; and solar panel shade structures.
Staff mailed early notices and hearing notices to all property owners and residents within 500 feet of the project site and posted the site prior to the public hearing. At the time of writing this report, staff has not received any comments on the project in response to the hearing notice.
Policy Considerations: The 2035 General Plan designation for the subject site is Regional
File ID: 2022-01916 11/15/2022 Public Hearing Item 34.
Policy Considerations: The 2035 General Plan designation for the subject site is Regional Commercial Center. These centers represent a significant opportunity for transformation and enhancement in the form of increased residential and other employment-generating uses.
Staff finds that the project is consistent with the following General Plan goals and policies:
Goal LU 2.7 City Form and Structure. Require excellence in the design of the city’s form and structure through development standards and clear design direction.
Policy LU 2.7.5 Development along Freeways. The City shall promote high-quality development character of buildings along freeway corridors and protect the public from the adverse effects of vehicle-generated air emissions, noise, and vibration, using such techniques as:
■ Requiring extensive landscaping and trees along the freeway fronting elevation ■Establish a consistent building line, articulating and modulating building elevations and heights to create visual interest
■ Include design elements that reduce noise and provide for proper filtering, ventilation, and exhaust of vehicle air emissions.
Staff thinks that a predominately auto-oriented development, such as a Costco Warehouse, is appropriate at this location because of its close proximity to Interstate 5 and the on- and off-ramp access to the freeway from Arena Boulevard. Other auto-related uses have been approved within this shopping center and include a new Chevron gas station, two drive-through restaurants--Chipotle and Wendy’s, as well as a drive-through Starbucks. Staff also feels the convenient freeway access at this location fits a Costco well as their consumer base is often generated on a regional level, in which this location provides quick and convenient access from Interstate 5, just north of Interstate 80.
To help soften the appearance of a large warehouse building, the project provides extensive landscaping and trees along the freeway fronting elevations and throughout the site. Additionally, the project architect has worked closely with staff to provide enhanced design elements on the building façade that provides visual interest from all angles of the shopping center, including those travelling along Interstate 5. Additional details about the proposed architecture and landscaping can be found in the Background section of this report under the Site Plan and Design Review entitlement discussion.
Goal LU 5.1 Centers. Promote the development throughout the city of distinct, well-designed mixed- use centers that are efficiently served by transit, provide higher-density, urban housing opportunities and serve as centers of civic, cultural, and economic life for Sacramento’s neighborhoods and the region.
Policy LU 5.1.1 Diverse Centers. The City shall encourage development of local, citywide, and regional mixed-use centers that address different community needs and market sectors and complement and are well integrated with the surrounding neighborhoods.
Goal LU 5.4 Regional Commercial Centers. Establish major mixed-use activity centers through development and reinvestment in existing regional commercial centers that are vibrant, regionally accessible destinations where people live, work, shop, and congregate in a mix of retail, employment,

entertainment, and residential uses.
Policy LU 5.4.1 Incorporating Housing and Employment Uses. The City shall promote the introduction of housing and employment uses in the city’s existing regional commercial centers as a means of enhancing retail viability, establishing pedestrian-oriented shopping districts, creating more attractive buildings and public spaces, supporting transit viability, and reducing vehicle trips.
Policy LU 5.4.3 Connectivity to Regional Centers. The City shall require greater pedestrian and bicycle connections between mixed-use regional commercial centers and surrounding neighborhoods.
The Shopping Center (SC) zone allows for a wide variety of commercial, retail, office, and other employment generating uses. There are various existing, in progress, and planned residential office uses and existing, near the project site, in which this project will play a supporting role in the provision of goods to the nearby residents and employees.
To the north of the project site is the Centene development, which includes 1.25 million square feet of office, as well as a hotel, office, and medical office buildings. The area to the south of the site includes a 472-unit apartment complex currently under construction; the apartment complex is immediately south of the project site and shares internal access points (Private Drive A) with the proposed Costco. Further to the south in Quadrant D of the PUD is medical office with schematic approval, and a residential subdivision with 211 units (138 single-units and 73 accessory dwelling units) currently under construction.
The applicant worked closely with staff to ensure that strong and safe pedestrian connections are provided and that connections to the bike trail and present and in appropriate locations.
North Natomas Community Plan
The subject property is located within the North Natomas Community Plan Area of the General Plan.
The General Plan identifies the Community Plan Area as having an urban form that includes a well- integrated mixture of residential, employment, commercial, and civic uses, interdependent on quality transit service and a radial network of connections linking activity centers with streets, transit routes, and linear parkways with pedestrian/bike trails.
Policy NN.LU 1.26 Warehouse Retail. The City shall allow, subject to a conditional use permit, warehouse retail uses to be located in North Natomas if they meet the following criteria: close freeway access, but not necessarily adjacent to the freeway; access to an arterial with sufficient capacity to accommodate the traffic generated by this use; not adjacent to residential uses; and generally acceptable in light industrial areas.
Staff finds that the project is consistent with the vision stated in the General Plan and the North Natomas Community Plan goals and policies related to the integration and balance of support retail uses with employment generating uses such as retail, office, and hotel uses and the adjacent residential uses. The proposed project is located adjacent to Interstate 5 at the Arena Boulevard (a large arterial road) exit providing convenient access to the proposed project site. The site is not immediately adjacent to residential uses and will be separated from a 472-unit apartment complex under construction to the south by a large parking area. Operational activities which could be a nuisance to sensitive uses (such as residential), such as truck deliveries or trash pick-up, are located
File ID: 2022-01916 11/15/2022 Public Hearing Item 34.
nuisance to sensitive uses (such as residential), such as truck deliveries or trash pick-up, are located at the north of the building opposite the residential uses. Lastly, the project has been analyzed by the Department of Public Works to ensure that expected traffic volumes are able to be handled by the proposed project and the shopping center at large without impacting internal operations or the public right-of-way, including Arena Boulevard, E Commerce Way, and the Interstate 5 on and off-ramps.
Economic Impacts: Not applicable.
Environmental Consideration: On August 11, 2009, the City certified the Environmental Impact Report, adopted the Findings of Fact and a Mitigation Monitoring Plan for the Natomas Crossing Project EIR (City project number P04-264; City Council Resolution No. 2009-531), which evaluated a proposed amendment to the PUD Schematic Plan and rezone of Quad C from C-1 (3.8 acres), EC- 40 (14.2 acres), and EC-50 (34.9 acres) to SC (42.6 acres) and EC-50 (10.3 acres) to allow for the anticipated development of 404,580 square feet of regional retail uses and 200,000 square feet of office uses. The General Plan land use designation for Quad C was also changed from Planned Development to Regional Commercial.
The Natomas Crossing EIR evaluated development of Quad C.
The Costco Warehouse Natomas Project (Current Project) (P22-019) is requesting entitlements to construct a 160,525-square-foot retail store on approximately 19.31 acres in the Shopping Center zone and the Natomas Crossing Area 3 Planned Unit Development (SC-PUD).
Environmental Planning Services determined that environmental review for the project would require only minor technical changes to the previous environmental documents, and that none of the circumstances set forth in CEQA Guidelines section 15162 were present. There are no substantial changes proposed in the project or the circumstances under which the project is undertaken involving new significant environmental effects or a substantial increase in the severity of previously identified significant effects and there is no new information of substantial importance which was not known or could not have been known at the time the Natomas Crossing EIR was complete. An Addendum to the previously certified EIR was prepared pursuant to CEQA Guidelines section 15164.
The Addendum also demonstrates that the project is consistent with the development density established by the existing zoning as adopted by Ordinance 2009-037, for which the Natomas Crossing EIR was certified, and therefore, pursuant to Public Resources Code section 21083.3 and CEQA Guidelines section 15183, no additional environmental review is necessary because the project would not result in any new or more severe significant impacts than those identified in the Natomas Crossing EIR, nor are there any impacts that would be peculiar to the parcel or to the Project.
The Addendum, certified EIR and the Resolution No. 2009-051 with the adopted Mitigation Monitoring Program (MMP) have been posted and are available on the Community Development Department web site for environmental documents at:
The EIR can be found at:

200-Year Flood Protection: State Law (SB 5) and Planning and Development Code chapter 17.810 require that the City must make specific findings prior to approving certain entitlements for projects
File ID: 2022-01916 11/15/2022 Public Hearing Item 34.
require that the City must make specific findings prior to approving certain entitlements for projects within a flood hazard zone. The purpose is to ensure that new development will have protection from a 200-year flood event or will achieve that protection by 2025. The project site is within a flood hazard zone and is an area covered by SAFCA’s Improvements to the State Plan of Flood Control System, and specific findings related to the level of protection have been incorporated as part of this project.
Even though the project site is within a flood hazard zone, the local flood management agency, SAFCA, has made adequate progress on the construction of a flood protection system that will ensure protection from a 200-year flood event or will achieve that protection by 2025. This is based on the SAFCA Urban level of flood protection plan, adequate progress baseline report, and adequate progress toward an urban level of flood protection engineer’s report that were accepted by City Council Resolution No. 2016-0226 on June 21, 2016, and the SAFCA 2022 Adequate Progress Annual Report accepted by City Council Resolution No. 2022-0313 on October 11, 2022.
Sustainability: The project will be required to comply with the California Energy Code which includes the installation of the physical EV charging stations in addition to sustainable building practices with increased energy efficiency. The project complies with the City’s 50-percent tree shading requirement of parking areas to ensure passive cooling is achieved to help mitigate urban heat island effects.
Commission/Committee Action: On October 13, 2022, the Planning and Design Commission unanimously approved the Costco Warehouse Natomas project.
Rationale for Recommendation: Staff recommends the Council deny the appeal and approve the requested entitlements. The proposal complies with the goals and policies of the 2035 General Plan and the North Natomas Community Plan in that this commercial development develops a vacant parcel with a warehouse retail use that will play a supporting role to the other uses existing and planned for the area, which include office, medical office, other retail and commercial activities, and single- and multi-unit residential projects. The proposed building is adjacent to Interstate 5 and separated by abundant landscaping along the property lines abutting the interstate. Undesirable operational activities, such as trash pickup and deliveries are handled at the north of the site, away from residential uses. Additionally, two publicly accessible connections to the existing Class I multi- use trail immediately west of the site (between the Interstate and the project site) are provided, expanding the number of connections existing and planned for the trail from the adjacent community running through the larger development site. Lastly, the project has been evaluated for potential impacts on the existing road network and the residential areas in the vicinity and will serve the community through the convenient provision of goods and services.
Financial Considerations: Not Applicable
Local Business Enterprise (LBE): No goods or services are being purchased under this report.

Land Use Context
There are vacant parcels and parcels under construction to the east of the subject site that all belong to the larger development area known as Quadrant C (Quad C) of the Natomas Crossing Planned Unit Development Area 3. This larger development area is bound by Arena Boulevard to the north, Interstate 5 to the west, East Commerce Way on the east, and San Juan Road to the south . Three drive-through restaurants (P21-037, P21-007, P20-032) and a gas station and restaurant (P19-069) have previously been approved at the parcels to the east of the project site near Arena Boulevard and East Commerce Way . Some of these approvals are under construction, while others have
submitted for building permits. To the south of the site is a 472-unit apartment complex (P19-075) that is currently under construction. To the north, across Arena Boulevard, is the Centene project in Quadrant B (1.2 million square feet of office). Across East Commerce Way to the east, there is an existing 2.1 -acre commercial development and attached and detached single-unit residences that are part of a the Natomas Field PUD.
See Figure 1 above for further land use context.
Project Specifics
This project will construct a 160,526-square-foot Costco Warehouse retail store. The proposed hours of operation for the Costco store are from 9 :00 am to 8:30pm, Monday through Friday, and 9 :00 am to 7:00 pm on Saturday and Sunday. The Costco will also include a Tire Center w hich has typical hours of operations from 10:00 am to 8:30pm, Monday through Friday, and 9:30 am to 7:00 pm on Saturdays and 10:00 am to 6:00pm on Sundays. The Tire Center is considered an ancillary use to the overall retail store classification. A Costco gas station is not proposed with this application.
Entitlement Review
Conditional Use Permit
The subject site is located in the Shopping Center (SC -PUD) zone. The approval of a Conditional Use Permit (CUP) is required for all retail stores larger than 60,000 square feet in the Shopping Center (SC) zone (SCC 17.216.510.A).
The CUP process is designed to evaluate a project’s potential impact on a site and the surrounding area. In evaluating the project, staff found the potential impacts generated by the project to be minimal beyond what was anticipated, as it is surrounded by similar commercial uses to the east, office uses to the north, and is not immediately adjacent to residential uses. With the City Council’s approval in 2009 (P04-264), this site is intended to accommodate a large regional commercial shopping center.
Retail store over 60,000 square feet
Retail stores in the Shopping Center (SC) zone that exceed 60,000 gross square feet require approval of a Conditional Use Permit by the Planning and Design Commission.
Staff found the potential impacts generated by the warehouse retail facility to be minimal as the proposed project is located in an area with many approved auto -oriented uses, and is adjacent to Interstate 5 , Arena Boulevard and E Commerce Way (both arteri al roads). T he building is set back from ingress and egress points to avoid spillage of vehicles into the adjacent properties and rights-of-way and the internal circulation has been evaluated to consider adjoining businesses and traffic flows to prevent ve hicles (e.g., customer, and delivery) from impacting operations.
Additionally, the building and its trash pick -up and delivery docks are located away from residential uses at the north of the building with more proximity to Arena Boulevard.
In addition to the analyses covered above, a number of conditions have been imposed on the project in order to ensure a harmonious relationship with businesses, and residents in the area. These conditions include:
Daily removal of litter from the site.
Signage with information that includes a 24-hour emergency contact. No loitering signage.
Prohibition of truck idling.
Prohibition of amplified sound.
Site Plan and Design Review
Site Plan and Design Review is required for the project to ensure compliance with applicable development standards and design guidelines. The project is in the Shopping Center (SC -PUD) zone and within the Natomas Crossing Area 3 Planned Unit Development. The project is requesting no deviations to the applicable building development standards. A deviation to the required materials for solid walls adjacent to residential development is requested along the southern property line that abuts a multi - unit dwelling residential complex.
Table 2: Applicable Development Standards
Standard Required Provided Deviation?
Height PUD: 35’ 31’ N
Front Setback SC zone: Min. 20’ 210’ N
Interior Setback SC zone: None 243’ N
Rear-Yard Setback SC zone: None 65.5’ N
Wall Deviation
Per City Code section 17.620, non-residential developments are required to construct a minimum 6-foot-tall solid wall when adjacent to a residential use. Because of the proximity of the multi-use trail and the bike/ped path at the south of the pr operty that connects to the multi -use trail , the six -foot-tall solid wall is proposed to be constructed as a combination of solid wall (3-feet bottom) and wrought iron open fencing (3-feet top). This combination requires a deviation to the full solid wall standard but is preferred to provide for increased visibility from the apartments onto the multi -use path and bike/ped path, while still providing privacy to ground floor units.
Access, Circulation, and Parking
The proposed project is consistent with the N eighborhood Commercial Corridor Design Principles in that balanced circulation routes for both pedestrians and vehicles have been provided. The site is located off Arena Boulevard, with access via an internal north-south driveway (Private Drive A), which is a right-in-only driveway, which allows access to all Quad C developments. This is expected to be the primary ingress for vehicles exiting off Interstate 5. Two additional ingress and egress vehicle access points will be provided along East Commerce Way, which lead to Private Drive A. Both driveways along East Commerce Way will accommodate right -ins and right -outs. A full movement signalized intersection will be provided at Amelia Earhart Avenue and East Commerce Way, which will facilitate traffic to the north to get back to Arena Boulevard and Interstate 5.
There is an planned Class 1 bicycle and pedestrian trail facility directly on the west side of the site that runs parallel with Interstate 5. Two connection points to the north and south of the Costco building are provided to facilitate access into the Quad C shopping center.
These connection points tie into the larger internal circulation network of the shopping center so the path of travel for pedestrians and cyclists is clearly delineated and separate from vehicle movements and conflicts.
The Natomas Crossing Planned Unit Development (PUD) specifies that development in Area 3 shall utilize the vehicle and bicycle parking requirements of the City Code. The subject site is located in the Suburban Parking District. The parking standards for a retail store is listed in Tables 3 and 4 below.

Landscaping
The provided landscape plan has been reviewed by the Urban Forestry unit of the Department of Public Works to confirm compliance with the City’s parking lot shading requirements, which requires after 15 years, 50% of the parking lot, where vehicles will maneuver, is shaded by tree canopy. This project provides 52% tree shading and has therefore been determined to be in compliance with this requirement. The landscape plan also shows abundant landscaping along the private drive and Interstate 5 frontages, as well as at the property line shared with the apartment complex to the south.
Architectural Analysis
The Natomas Crossing PUD states that with commercial architecture the individuality of each building is less important than the collective contribution it makes to the holistic architecture of the community. The standards in the PUD are meant to create an active and dynamic street life so that the various land uses can mix together to create a vibrant pedestrian environment. These standards can be summarized as follows:
1) Finished building materials at all façades which include trash enclosures in addition to the buildings;
2) Façades shall be articulated with variations in form, materials, and texture and to avoid blank façades;
3) Harmonious colors and materials;
4) No highly reflective materials for major façades, their use should be minimal; 5) Screen undesirable elements;
6) Incorporate energy efficiency; and
7) Façades shall have a minimum of 65% transparency at the first floor through glass, open air structures, courtyards, etc.
The proposed building design (see Figures 3 and 4) meets the purpose and intent of the design guidelines for this PUD in that it is well articulated by providing variation in height and rooflines , as well as the use of different materials such as plaster, metal panels, trellises, tower elements, and other material and color changes . A prominent tower element with a large canopy overhang has been provided to enhance the entrance area.
The materials at the tower element wrap around the corner of the building further emphasizing the entrance location. The tower elements themselves provi de different materials than the façade surrounding it, which serves to emphasize the importance of the entrance as well as the importance of the building as housing one of the anchor tenants for the overall retail development. The architect has worked with the staff to ensure that the company’s corporate brand is maintained through design elements such as a red band which encircles the building, while also providing unique elements that provide visual interest along the interstate. Service entrances and trash enclosures facing Arena Boulevard are screened through the use of walls and landscaping.

A. On August 11, 2009, pursuant to the California Environmental Quality Act (Public Resources Code §21000 et seq. (“CEQA”), the CEQA Guidelines (14 California Code of Regulations §1 5000 et seq.), and the City of Sacramento environmental guidelines, the City Council certified an Environmental Impact Report (EIR) and adopted Findings of Fact and a Mitigation Monitoring Plan (Resolution No.2009 -531) and approved the Natomas Crossing Project (P04-264) (Original Project).
B. The Costco Warehouse Natomas Project (Current Project) (P22 -019) is requesting entitlements to construct a 160,525 -square-foot retail store on approximately 19.31 acres in the Shopping Center zone and the Natomas Crossing Area 3 Planned Unit Development (SC-PUD).
C. Based on its review and evaluation of the Costco Warehouse Natomas Project, staff determined that the proposed changes to the original Project did not require the preparation of a subsequent EIR. An addendum to the previously certified EIR was then prepared to address the modification.
Section 2. The City Council has reviewed and considered the information contained in the previously certified EIR for the Original Project, and all oral and documentary evidence received during the hearing on the Current Project.
The City Council has determined that the previously certified EIR, CEQA findings of fact and statement of overriding considerations constitute an adequate, accurate, objective, and complete review of the pr oposed Current Project and finds that no additional environmental review is required based on the reasons set forth below:
A. No substantial changes are proposed by the Current Project that will require major revisions of the previously certified EIR due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects.
B. No substantial changes have occurred with respect to the circumstances under which the Current Project will be undertaken which will require major revisions to the previously certified EIR due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects.
C. No new information of subst antial importance has been found that shows any of the following:
1. The Current Project will have one or more significant effects not discussed in the previously certified EIR.
2. Significant effects previously examined will be substantially more severe than shown in the previously certified EIR.
3. Mitigation measures previously found to be infeasible would in fact be feasible and would substantially reduce one or more significant effects of the Current Project; or
4. Mitigation measures which are considerably diff erent from those analyzed in the previously certified EIR would substantially reduce one or more significant effects on the environment.
D. The Current project is consistent with the development density established by the existing zoning as adopted by Ordinance 2009 -037, for which the Natomas Crossing EIR was certified, and therefore, pursuant to Public Resources Code section 21083.3 and CEQA Guidelines section 15183, no additional environmental review is necessary because the project would not result in any new or more severe significant impacts than those identified in the Natomas Crossing EIR, nor are there any impacts that would be peculiar to the parcel or to the Project.
Section 3. The mitigation monitoring plan for the Project remains in effect and applies to the Current Project. The mitigation monitoring p lan meets the requirements of CEQA section 21081.6 and CEQA Guidelines section 15091.
Section 4. Upon approval of the Current Project, the City Manager shall file or cause to be filed a Notice of Determination in compliance with current State guidelines at the time and, if the project requires a discretionary approval from any state agency, with the State Office of Planning and Research, pursuant to section 21152(a) of the Public Resources Code and the State EIR Guidelines adopted pursuant thereto.
Section 5. Pursuant to Guidelines section 15091(e), the documents and other materials that constitut e the record of proceedings upon which the City Council has based its decision, including the previously certified EIR, are located in and may be obtained from, the Office of the City Clerk at 915 I Street, Sacramento, California. The City Clerk is the cus todian of records for all matters before the City Council.

Section 1. Based on the verbal and documentary evidence received at the hearing on the Project, the City Council approves the Project entitlements based on the findings of fact and subject to the conditions of approval as set forth below.
Section 2. The City Council approves the Project entitlements based on the following Findings of Fact:
FINDINGS OF FACT
B. Conditional Use Permit for a Retail Store over 60,000 square feet in size is approved based on the following Findings of Fact:
1. The proposed use and its operating characteristics are consistent with the general plan in that the Regional Commercial Center designation which represents a significant opportunity for transformation and enhancement in the form of employment-generating uses. This designation envisions major mixed- use activity centers that include a mix of employment, entertainment, and residential uses. The proposed use is predominately auto oriented, and its location is appropriate as it has convenient freeway access (Int erstate 5) and bounded by two arterial roads (Arena Boulevard and East Commerce Way).
Furthermore, there are other approved auto -oriented uses (e.g., gas station, drive-through restaurants) in the larger development. Additionally, the building has been sited to be adjacent to the freeway, away from residential uses to the south of the site and across East Commerce Way further to the east and buffered from the freeway with a generous amount of landscaping. Potential nuisances related to the operations, such as trash pickup and deliveries are located adjacent to the freeway as well. There is no applicable specific plan or transit village plan;
2. The proposed use and its operating characteristics are consistent with the applicable standards, requirements, and re gulations of the zoning district in which it is located, and of all other provisions of this title and this code in that this use is allowed with a conditional use permit in the shopping center zone and the operating characteristics have been evaluated by staff through a traffic operational analysis and in relation to adjacent residential and commercial uses, in which the recommendations from those analyses were incorporated into the site design to minimize conflicts . The deviation requested for a solid wall is consistent with the purpose and intent of the Planning and Development Code in that the bottom 3 feet of the wall will be solid which provides privacy to ground floor units in terms of sound attenuation from passing cars and shielding of headlights of vehicles driving through the parking area;
3. The proposed use is situated on a parcel that is physically suitable in terms of location, size, topography, and access, and that is adequately served by public services and utilities; and
4. The proposed use and its operating characteristics are not detrimental to the public health, safety, convenience, or welfare of persons residing, working, visiting, or recreating in the surrounding neighborhood and will not result in the creation of a nuisance in that the project has been conditioned with a number of conditions that will ensure harmonious relationships with the adjacent community including truck idling restrictions, requirements to remove litter from the site, and posting information of emergency contacts in plain sight.
C. Site Plan and Design Review for the construction of a 160,526-square-foot warehouse retail store with a deviation to wall design requirements in the Shopping Center zone (SC-PUD) within the Natomas Crossing Area 3 Planned Unit Development is approved based on the following Findings of Fact:
1. The design, layout, and physical characteristics of the proposed development are consistent with the general plan designation of regional commercial center in that the proposed building is comparable in form to adjacent commercial development and provides connectivity from the existing neighborhoods into the shopping center, as well as the Class I multi-use trail immediately west of the site. There is no applicable specific plan or transit village plan;
2. The design, layout, and physical characteristics of proposed development are consistent with all applicable design guidelines and with all applicable development standards in that loading areas are located away from residential areas and the designers the prominent location of the building along Interstate 5. The deviation requested for a solid wall is consistent with the purpose and intent of the Planning and Development Code in that the bottom 3 feet of the wall will be solid which provides privacy to ground floor units in terms of sound attenuation from passing cars and shielding of headlights of vehicles driving through the parking area;
3. All streets and other public access ways and facilities, parking facilities, and utility infrastructure are adequate to serve the proposed development and comply with all applicable design guidelines and development standards. The project has been analyzed by City departments and it is determined that all streets and public accessways and facilities, parking facilities, and utility structure are adequate to serve the proposed development and comply with all applicable design guidelines and design standards;
4. The design, layout, and physical characteristics of the proposed development are visually and functionally compatible with the surrounding neighborhood in that the building is setback away from residential uses and is located in an area with a mix of commercial and residential uses;
5. The design, layout, and physical characteristics of the proposed development ensure energy consumption is minimized and use of renewable energy sources is encouraged as the proposed landscape plan exceeds the minimum 50% tree shading requirements for parking lots and will be required to comply with the California Energy Code;
6. The design, layout, and physical characteristics of the proposed development are not detrimental to the public health, safety, convenience, or welfare of persons residing, working, visiting, or recreating in the surrounding neighborhood and will not result in the creation of a nuisance as the project has been conditioned to provide those in the immediate area with contact information should problems arise; staff has evaluated the use to ensure traffic issues do not result from the operation of the retail store; and additional goods and services will be provided in the area.
D. 200-Year Flood Protection

If the required clearances cannot be maintained, the Applicant shall be responsible for the cost of relocation.
C84. Structural setbacks less than 14-feet shall require the Applicant to conduct a pre- engineering meeting with all utilities to ensure property clearances are maintained.
C85. Any necessary future SMUD facilities located on the Applicant’s property shall require a dedicated SMUD easement. This will be determined prior to SMUD performing work on the Applicant’s property.
C86. In the event the Applicant requires the relocation or removal of existing SMUD facilities on or adjacent to the subject property, the Applicant shall coordinate with SMUD. The Applicant shall be responsible for the cost of relocation or removal.
C87. SMUD reserves the right to use any portion of its easements on or adjacent to the subject property that it reasonably needs and shall not be responsible for any damages to the developed property within said easement that unreasonably interferes with those needs.
C88. The Applicant shall not place any building foundations within 5-feet of any SMUD trench to maintain adequate trench integrity. The Applicant shall verify specific clearance requirements for other utilities (e.g., Gas, Telephone, etc.).
C89. The Applicant shall comply with SMUD siting requirements (e.g., panel size/location, clearances from SMUD equipment, transformer location, service conductors). Information regarding SMUD siting requirements can be found at:
https://www.smud.org/en/Business-Solutions-and-Rebates/Design-and- Construction-Services.
C90. The Applicant shall locate, verify, and provide a drawing to SMUD identifying all electrical utility infrastructure for the existing structures. If necessary, any existing onsite electrical infrastructure that serves existing structures shall be relocated to the satisfaction of SMUD.
C91. The Applicant shall provide all-weather vehicular access for service vehicles that are up to 26,000 pounds. At a minimum: (a) the drivable surface shall be 20-feet wide; and (b) all SMUD underground equipment and appurtenances shall be within 15-feet from the drivable surface.
SACRAMENTO AREA SEWER DISTRICT (SASD): Yadira Lewis (916) 876-6278 C92. Prior to the APPROVAL OF IMPROVEMENT PLANS: To obtain sewer service, construction of SASD sewer infrastructure will be required. Current SASD Standards and Specifications apply to any offsite or onsite public sewer construction or modification. These improvements must be shown on the plans.
Field modifications to new or existing precast manhole bases are not allowed.
C93. Prior to the APPROVAL OF IMPROVEMENT PLANS: SASD requires each building on each lot with a sewage source to have a separate connection to SASD’s sewer system. If there is more than one building in any single parcel and the parcel is not proposed for split, then each building on that parcel must have a separate connection to a private onsite sewer line or a separate connection to the SASD public sewer line. These improvements must be shown on the plans.
C94. Prior to the APPROVAL OF IMPROVEMENT PLANS: Sewer easements are required to service this parcel. All public sewer easements will be dedicated to SASD in a form approved by the District Engineer. All public sewer easements will be at least 20 feet in width and will require continuous access for installation and maintenance. SASD will only provide maintenance in public rights-of-way and SASD dedicated sewer easements. No awning or overhang may encroach on the easement area. At minimum, an all-weather access road must be provided to all manholes.
C95. Prior to RECORDATION OF THE FINAL MAP/ APPROVAL OF IMPROVEMENT PLANS: Permanent structures, walls, signs and footings will not be permitted within the existing SASD easement area unless express written permission is obtained from SASD.
C96. Prior to the APPROVAL OF IMPROVEMENT PLANS: All manholes not within public right of way must be accessible with an all-weather access roads.
C97. Prior to the APPROVAL OF IMPROVEMENT PLANS: Alignment of all main lines and structures must provide a minimum of 1 foot vertical clearance and 5 feet horizontal clearance from all other utilities and improvements. Sewer is to be located a minimum of 10 feet (measured horizontally) from any structure or footing. Show public sanitary sewer and water supply facilities in accordance with the Health and Safety Code.
C98. Prior to the ISSUANCE OF A BUILDING PERMIT: The owner must contact Permit Services Unit at [email protected] or by phone at (916) 876-6100 to determine if sewer impact fees are due. Fees are to be paid prior to the issuance of building permits.
REGIONAL SANITATION (REGIONAL SAN): Robb Armstrong (916) 876-6104 C99. Prior to the ISSUANCE OF A BUILDING PERMIT: The owner must contact the Regional San Permit Services Unit at [email protected] or by phone at (916) 876-6100 to determine if sewer impact fees are due. Fees are to be paid prior to the issuance of building permits.

COSTCO NATOMAS
PROJECT NARRATIVE
April 1st, 2022
Costco Wholesale is pleased to submit this application requesting approval to develop a 160,526 square foot Costco warehouse retail center, on-site circulation and landscaping improvements on the property located at 3881 E. Commerce Way (APNs 225-2300-030, 225-2300-031, and 225-2300-032) in the North Natomas community in the City of Sacramento (“Project”). The Project is proposed to be located within Quadrant C of Development Area 3 within the 2009 Natomas Crossing Planned Unit Development (PUD).
This area has a zoning designation of SC (Shopping Center) and is designated for Regional Commercial uses in the PUD. The site consists of Natomas Crossing Quadrant C parcels 12-14, which combined have an area of approximately 19.31 acres.
This application is requesting the following entitlement approvals:
• Site Plan and Design Review for the proposed Costco warehouse retail center, on-site circulation and landscaping improvements.
• A conditional use permit (CUP) to permit a retail store that exceeds 60,000 gross square feet.
Sacramento City Code Section 17.216.510 requires that retail uses in excess of 60,000 gross square feet obtain Planning and Design Commission (PDC) approval.
The project is consistent with the permitted uses and intensity of development established within PUD.
The proposed Project will facilitate development of a Costco warehouse retail center while remaining in conformance with and advancing the intent of the existing PUD.
PROPOSED PROJECT OVERVIEW
The proposed Project includes a new 160,526 square-foot Costco warehouse retail center and various on-site circulation, surface parking, and landscaping improvements. The following commercial activities are proposed, without limitation:
• Warehouse retail center
• Tire sales and installation
• Optical exams and optical sales
• Hearing aid testing and sales
• Food service preparation and sales
• Meat preparation and sales
• Bakery and sales of baked goods
• Alcohol sales
• Propane refueling and sales
• Pharmacy services
Temporary outdoor sales may occur within the parking field adjacent to the warehouse retail center for seasonal sales, such as Christmas trees. Lastly, a promotional vehicle may be on display near the entry to the building. This vehicle will be used to promote online or offsite vehicle sales; no vehicles are proposed to be sold on site.
The Costco warehouse retail center and proposed Project improvements will be developed on approximately 16.3 acres of the site; a lot line adjustment will be used to move an existing lot line to Costco Natomas Updated: March 30, 2022

define a parcel which is reserved for future commercial uses not determined at this time. This area is identified as “Future Pad” on the plan materials submitted as part of this application, and other than the lot line adjustment, no modifications or improvements are currently proposed on this portion of the site. The lot line adjustment action will be considered as a separate process through the Public Works department.
PROPOSED PROJECT DETAILS
Building Design & Architecture
The primary customer entrance is located at grade in the southeast corner of the warehouse retail center. The large open-air entrance vestibule entrance will be enhanced with pedestrian scale design elements to create a pedestrian-only area in front of the warehouse retail center. The large entrance creates a highly visible access to the warehouse retail center, which minimizes traffic conflicts and makes it easier for members to access the warehouse retail center from within the parking field.
The proposed architectural design fits within the PUD Design Guidelines and incorporates similar materials and design elements to reinforce a consistent design aesthetic with the proposed adjacent uses. The Project will use a combination of different colored metal panels and masonry fields to visually break up the massing of the building and avoid large areas of blank wall massing. The inclusion of pedestrian scale elements and trellises at key locations around the warehouse retail center also help to meet the design intent within the PUD guidelines.
Parking and Site Access
The Project proposes 950 parking stalls, including 19 accessible stalls and 931 typical 10’ wide stalls. All of the parking stalls would be at-grade surface parking, with the majority of spaces located east and south of the proposed warehouse retail center.
Costco will have five vehicle access points along the private access drive that runs along the east of the site. The private access road connects to the City of Sacramento right of way at three locations: two points of access connect the east of the site to East Commerce Way; one point of access connects north of the site to Arena Boulevard.
There is an existing bike path along the western edge of the site that is to remain in place.
Loading and Deliveries
Costco anticipates an average of about 10 trucks delivering goods on a typical weekday. The trucks range in size from 26 feet long for single-axle trailers to 70 feet long for double-axle trailers. Receiving time is from 2:00 a.m. to 1:00 p.m., averaging two to three trucks per hour, with most of the deliveries completed before the warehouse retail center opens. The receiving and loading docks for the Costco warehouse retail center are located at the southeast corner of the building and will access the site off the private access drive that runs along the east of the site.
The tire center, located on the east side of the building typically will receive shipments of tires one to two times per week in single or double-trailer trucks of up to 70 feet in length. The same delivery trucks pick up old tires for recycling. Deliveries to and pickups from the tire center will be scheduled for pre- opening hours, typically around 6:00 a.m.
Costco Natomas Updated: March 30, 2022
Project Narrative
3 | P a g e
The loading dock is located on the northeast side of the warehouse retail center. The bay doors will be equipped with sealed gaskets to limit noise impacts. A transformer and two trash compactors will also be located along the north edge of the warehouse retail center.
Costco Operations
General elements of Costco’s operations are listed below. • Approximately 250 to 275 employees.
• Customers are members, as Costco is a member-only retail/wholesale business. • Hours are anticipated to be Monday through Friday from 9:00 am to 8:30 pm, and Saturday and Sunday from 9:00 am to 7:00 pm.
Signage
Proposed signage includes four (4) main building ‘Costco Wholesale’ signs, one (1) entry ‘Costco Wholesale’ sign, and one (1) ‘Tire Center’ sign. The warehouse retail center signage is scaled appropriately to the mass of the building elevations to not overwhelm, but rather to reinforce the brand that Costco has established. The proposed signage is consistent with the requirements within the PUD.
Additionally, the development has proposed a pylon sign in an easement on the Costco property which is noted on the plan sets submitted as part of this application. This is not a Costco sign.
Landscaping
The proposed landscape design features a dynamic, bold and visually engaging planting layout consisting of colorful accent trees, diverse shade tree species and sweeping drifts (massing) of understory plant species at vehicular and pedestrian entryways, parking lot islands, and street frontages. The overall intent is to create a unifying and impactful landscape appearance to the site, as well as achieving a supportive relationship between the proposed building and landscape. In addition, the proposed landscape design will emphasize an aesthetically pleasing experience, not only for Costco customers and community at large. The proposed plant material for the Project complies with the City’s approved plant list.
Selective plant material will enhance pedestrian wayfinding and scale, while trees and understory plant selections feature year-long interest and seasonal color. Plant material with neutral and vivid bloom colors, and various leaf textures and patterns provide harmony and a cohesive appearance throughout the site. Large canopied deciduous and broadleaf evergreen trees are integrated into parking lots, pedestrian walkways and along the street frontages. These trees will, in time, provide much needed shade and reduce ambient heat during times of the year when solar exposure is intense. Selected plant species provide reliable screening at above grade utility locations.
The planting design consists predominately of drought-tolerant species adapted to both local and regional climate conditions. Once established, the majority of selected plant species will require low water and landscape maintenance. In addition, understory plant materials are spaced to allow plants to grow and pleat together naturally, minimizing the need for extensive pruning maintenance such as shearing and hedging, thus reducing long-term landscape waste.

T
he site irrigation design will consist of an efficient low flow, point of source system designed to provide adequate watering to support plant growth and ensure deeply rooted plant material while avoiding excess water application. The system will be programmable, allowing operation during late night and/or early morning hours, with multiple start times and cycles.
Lighting
The site’s parking lot will be illuminated with standard downward LED fixtures affixed to a 36’-6” light pole. The lighting fixtures are of a “shoe-box” style. The use of LED lamps can provide a higher level of perceived brightness with less energy than other lamps and are designed to provide even light distribution for vehicle and pedestrian safety. The parking lot lights will be timer controlled to limit lighting after the warehouse retail center has closed and most employees have left. Parking lot lighting will only remain on to provide security and emergency lighting only along the main driveways. Lighting fixtures will also be located on the building approximately every 40 feet around the exterior of the building to provide safety and security. Parking and site lighting will incorporate the use of cutoff lenses to keep light from overflowing beyond the Costco site boundaries.
Utility Infrastructure
Costco will connect into existing private infrastructure located within the private access drive east of the project site. Water and sewer services will be provided by the Sacramento Public Utilities via existing facilities.
Storm Drainage
The project will comply with City, State, and Federal stormwater runoff mandates will comply with the Master Drainage Study for Natomas Crossing Development Area 3, dated 2002. The standards outlined in the City of Sacramento Design and Procedures Method – Storm Drainage Design Standards (Section 11) will be used to determine onsite storm water requirement. The project site is located within the Natomas Crossing Development Area 3 project site which is located within the North Natomas Drainage Basins 5 & 6.

While CEQA does not mention an EIR addendum, section 15164 of the CEQA Guidelines provides: “The lead agency or a responsible agency shall prepare an addendum to a previously certified EIR if some changes or additions are necessary but none of the conditions described in [guidelines] Section 15162 calling for preparation of a subsequent EIR have occurred.” (§ 15164, subd. (a).) Addenda are understandably attractive for cities because “[a]n addendum need not be circulated for public review … .” (Id., subd. (c).)” When there are changes in a project after the certification of a Final EIR, the agency can prepare an Addendum to the Report if the changes do not substantially modify the analysis in the original Report. The Addendum is acceptable, rather than a new or Supplemental EIR, only when changes or additions to the EIR are required but the conditions in section 15612 that trigger the preparation of a supplemental or subsequent EIR have not been satisfied. (Friends of the College of San Mateo Gardens v. San Mateo County Community College District (2016) 1 Cal.5th 937, 436; Ventura Foothill Neighbors v. County. of Ventura (2014) 232 Cal. App. 4th 429, 435.). CEQA’s requirement to prepare a supplemental EIR applies when he Final EIR prepared for a project does not cover new information or a subsequent project exceeds the scope or details of the original analysis. CEQA requires additional environmental review where (1) substantial changes are proposed in the project that will require major revisions to the EIR; (2) substantial changes occur with respect to the circumstances under which the project is being undertaken that will require major revisions to the EIR; or (3) new information, which was not known and could not have been known when the EIR was certified, becomes available. (Pub. Resources Code, § 21166; CEQA Guidelines, § 15162; see Martis Camp Community Association v. County of Placer (2020) 53 Cal. App. 5th 569, 603-04.). Substantial changes to circumstances requires the preparation of an supplemental or subsequent EIR. The original Final EIR was certified and adopted in 2009. In the 13 intervening years, there have been substantial changes to the planning and environmental climate in Sacramento and the surrounding area. These include changes to the traffic impacts and the analysis and thresholds used by the city, county and state to determine propriety of vehicle impacts resulting from development. As one example, in October of 2020, to stay in compliance with SB 743’s directive to shift traffic impact analysis to vehicle miles traveled (“VMT”), Sacramento County adopted Transportation Analysis Guidelines (“TAG”). The 2009 Final EIR does not contain any such ATTACHMENT TO APPEAL 2
analysis. For vehicle-dependent commercial developments, like the proposed Project, this is of particular concern because the VMT analysis could differ substantially from that found in the FEIR. Decision makers and the public need to be informed of the VMT impacts of this proposed project in order to make an informed decision, particularly since, as the project narrative states, the Project abuts properties slated for future commercial development. The proposed Costco would also create new traffic patterns surrounding the site, and would increase new vehicle-intensive uses, as a large-format warehouse-style grocery and consumer goods facility. It is necessary to include this particular analysis, which did not exist and was not required at the time of the certification of the 2009 FEIR, to properly comply with CEQA. Additionally, the Sacramento Metropolitan Air Quality Management District (SMAQMD) revised its regulations and guidelines in 2018. This is of concern to decision makers and the public because of the accelerating change in the local and regional climate. Just over the last month, the City of Sacramento has set all-time single-day heat records. Heat islands resulting from asphalt are one element of this increasing heat, but contributions to local ambient greenhouse gas emissions from new commercial development are a major contributor to this phenomenon. The accelerating pace of climate change and the changes in local conditions were not analyzed or factored into the analysis in the 2009 FEIR. It is critical that the City consider the best practices and guidelines promulgated by the SMAQMD since 2018 prior to approving development of the Project. Appellant reserves the right to raise additional matters regarding the City’s CEQA compliance with CEQA as appellant conducts further investigation.
MEMORANDUM

From: Scott Johnson, Senior Planner
Subject: CEQA Response to Comment – Costco at Natomas Crossing (P22-019)
The City received a written comment regarding the project on Tuesday, October 11, 2022. The written comment is included here and is part of the project’s administrative record. The comment is focused on the adequacy of the City’s environmental review.
The project is subject to review pursuant to the California Environmental Quality Act (CEQA). The staff report includes a discussion of the review under Environmental Considerations.
As noted in the staff report, the City is relying on an Addendum, which requires no circulation for public comment. The Addendum is posted on the City’s CEQA web page at https://www.cityofsacramento.org/Community-Development/Planning/Environmental/Impact- Reports along with the original CEQA document, the Natomas Crossing EIR (P04-264).
The Addendum provides that it was prepared pursuant to CEQA Guidelines sections 15162-15164.
The Addendum includes a full discussion of environmental staff’s conclusion that the proposed project would not result in any of the circumstances set forth in CEQA Guidelines section 15162.
Public Resources Code section 21166, and CEQA Guidelines section 15162, prescribe that no subsequent or supplemental environmental impact report shall be required by a lead agency (the City here) or responsible agency unless one or more of the following events occurs: 1. Substantial changes are proposed in the project that will require major revisions of the environmental document. 2. Substantial changes occur in the circumstances under which the project is being undertaken that will require major revisions in the environmental document. 3. New information of substantial importance to the project that was not known and could not have been known at the time the environmental document was certified or adopted as complete becomes available.
The essence of the comments is that the circumstances under which the project would be developed have changed substantially since the Draft EIR was prepared in 2009. The comment
points to the change in measuring traffic impacts from level of service (LOS) to vehicle miles traveled (VMT), new traffic patterns. Increases in vehicle-intensive uses, and changes to the air district regulations.
The Addendum includes a detailed review of the proposed project, including discussion of the specific technical areas of air quality, greenhouse gas emissions, and transportation and circulation. Discussions of potential impacts are related to the original Natomas Crossing EIR. The Addendum also includes a discussion of the surrounding development in the project vicinity, concluding that the area has developed consistent with the projections that were assumed in the original EIR.
The comment raises concerns regarding traffic, pointing to the metric of VMT, new traffic patterns, and an increase in vehicle-intensive uses that would result from project approval. The Addendum discusses each of these concerns. See pages 32-33. The Addendum concluded that the project would not result in increased vehicle trips.
The Addendum relies on the environmental impact analysis of the Natomas Crossing EIR, confirming the present project, the project evaluated in the Natomas Crossing EIR, and the required elements of the review required by CEQA Guidelines section 15162. Environmental staff have reviewed the comments and have determined that no additional analysis is required. The Addendum is the appropriate document for CEQA purposes. No changes in the staff report, findings, or Addendum are required. Staff notes that new legal enactments such as the adoption of regulations or guidelines do not constitute new information if the information about the underlying issue was known (or should have been known) at the time the original EIR was certified. RE: Natomas Crossing/Costco Warehouse EIR Addendum to 2009 EIR
This letter is submitted in regards to the proposed EIR Addendum for the proposed Costco Warehouse development at Natomas Crossing. The City of Sacramento’s determination that an addendum was appropriate for this development was erroneous. Instead, given the changed conditions and nature of the project as proposed, the City was required to prepare a subsequent or supplemental environmental impact report (“EIR”) for the proposed project (“the Project”).
CEQA statutes do not mention an EIR addendum, but section 15164 of the CEQA guidelines (Cal. Code Regs., tit. 14, § 15000 et seq.) provides: “The lead agency or a responsible agency shall prepare an addendum to a previously certified EIR if some changes or additions are necessary but none of the conditions described in [guidelines] Section 15162 calling for preparation of a subsequent EIR have occurred.” (§ 15164, subd. The Addendum is acceptable, rather than a new or Supplemental EIR, only “when there are only minor technical changes or additions which do not raise important new issues about the significant effects on the environment.” (9 Miller & Starr, Cal. Real Estate (3d ed. 2011 supp.) § 25A:19, p. 25A-107, fn. omitted.) See e.g., Ventura Foothill Neighbors v. Cty. of Ventura , 232 Cal. App. 4th 429,
435, 181 Cal. Rptr. 3d 421, 426 (2014).
CEQA’s statutory requirement to prepare a supplemental EIR kicks in where the Final EIR (“FEIR”) prepared for a project does not cover new information or a subsequent project exceeds the scope or details of the original analysis. Section 21166 of CEQA instructs for additional environmental review where (1) substantial changes are proposed in the project that will require major revisions to the EIR; (2) substantial changes occur with respect to the circumstances under which the project is being undertaken that will require major revisions to the EIR; or (3) new information, which was not known and could not have been known when the EIR was certified, becomes available. (§ 21166; CEQA Guidelines, § 15162.). See Martis Camp Cmty. Ass'n v. Cty. of Placer, 53 Cal. App. 5th 569, 603-04, 267 Cal. Rptr. 3d 729, 759 (2020).
Substantial Changes to Circumstances
The original FEIR was certified and adopted in 2009. In the thirteen intervening years, there have been substantial changes to the planning and environmental climate in Sacramento and the surrounding area.
The 2009 FEIR does not contain any such analysis.
The proposed Costco would create new traffic patterns surrounding the site, and would increase new vehicle-intensive uses, as a large-format warehouse-style grocery and consumer goods facility.
Just over the last month, the City of Sacramento has set all time single-day heat records.
Conclusion
For the foregoing reasons, I respectfully request that the City direct the applicant and the City staff to prepare a supplemental environmental impact report (SEIR).

NNCC Comment Letter for Costco P22-019
10/11/22
The North Natomas Community Coalition (NNCC) is a community-based group consisting of residents from many HOAs and Community Associations in the North Natomas Area. Our goal is to analyze any new projects in our area and determine how they may or may not benefit our area. We received presentations on this Costco project (P22-019) at East Commerce Way and Arena Blvd. on 2/9/22 and on 7/13/22. We have, as a group, discussed this project on several occasions. The NNCC membership is supportive of a new 160,000 sq ft Costco at this location, but we also have some serious concerns we would like to relay.
Appearance of the Exterior from Hwy 5 and Arena Blvd:
For the Hwy 5 (west) and Arena Blvd. (north) sides of the building large screening trees, such as Valley Oak trees, are desirous to soften the somewhat monolithic size and starkness of the building, which has the appearance of a typical large warehouse. Your “Arena Blvd. Render” (P43 of the 10/13/22 Planning and Design Commission Report) shows only about 1/3 of the north side of the building covered by trees. This is the side with compactors, transformers, loading dock, and possibly the outdoor employee break area.
We feel that visual blocking of the building’s sides is perhaps the most important element mitigating the appearance of the building with the possible exception of the pedestrian entryway to the building interior.
Overall Appearance:
The Arena Blvd. offramp from Hwy 5 is acknowledged by all to be a significant “gateway” for North Natomas. The significant properties off of Arena Blvd. and East Commerce Way include the Centene complex and the pending Northstate University hospital with its medical center and medical/pharmacology schools. These are upscale, aesthetically pleasing, and modern designs.
The Costco property at this intersection is not located in a separate industrial/commercial area such as at Woodland or Cal Expo, but rather within residential neighborhoods. We need something better for North Natomas – namely an upscale exterior – a grander design – something that is congruous with the other projects around Arena Blvd. at East Commerce Way.
The Pedestrian Entrance:
We believe that the original design of the pedestrian entrance was essentially flat and that it was later modified by adding supports which would allow for a larger canopy. We appreciate this aesthetic improvement, which adds visual depth and which also improves wayfinding.
The columns on either side of the entryway add depth and focus as well, however they are constructed of the same flat neutral colored material (construction brick?) as the rest of the exterior. A stone/rock covering of the columns which border the Costco signage, as seen in other Costco stores such as Folsom, would add a contrasting accent and go a long way toward decreasing the visual mass and the industrial appearance of the front, focal point, of the store. Note that the entryway is higher than the roofline and as such calls for an attractive and different appearance.
Traffic Flow:
Entry off Arena Blvd.:
We are concerned that customer traffic not back up at the entrance to the shopping center from E/B Arena Blvd., which is an essentially an extension of the N/B Hwy 5 offramp. Vehicles taking this “free right” entry may have to negotiate pedestrians on the south sidewalk of Arena Blvd. Vehicles entering will have a Wendy’s and a Chipotle restaurant on their left. It is not clear what will be to their right. There may be foot traffic from the fast food restaurants at this choke point that may also slow and back up incoming traffic. There does not appear to be a stop sign, which is good since it could further back-up traffic onto Arena Blvd. It does not appear that there will be an exit at this location
Exit onto East Commerce Way:
The exit driveway from the Costco lot will be between a Chevron gas station and an unknown business. The intersection it feeds, at Amelia Earhart Ave. and East Commerce Way, was said by presenters to be a “truck sized intersection.” It appears that there will be at least 7 other businesses using this exit. Most vehicles will likely continue N/B East Commerce Way then W/B Arena Blvd. to the N/B and S/B onramps to Hwy 5 as well as to the extensive neighborhoods on the westside of Hwy 5. Given the future generation of vehicle traffic associated with CA Northstate University hospital and Costco, along with traffic associated with Centene, the traffic load at this intersection will be great. Our hope is that this will be taken into consideration by city traffic planners.
Our hope is that a traffic pattern study will objectively assess whether there is a likelihood of traffic lock-up and a resulting inability to leave the property, such as occurred 10 or 15 years ago at the Regal Natomas Marketplace on Truxel Blvd., necessitating a major redesign of the entry/exit.
Security Cameras & Lighting:
Our hope is that lighting and security camera coverage is particularly good at bicycle corrals and where bicycles and pedestrians route through the parking lot.
Loading Zone:
There was no information available to us as to whether there would be a loading area for shuttle busses, Ubers, taxis, paratransit, senior vans, etc. to drop-off and pick-up passengers in front of the building. This would facilitate non-car use and aid with North Natomas’ well known transportation paucity.
Bicycle Issues:
Given North Natomas’ lack of public transit, customers are forced into cars to get around. Use of bicycles by customers and employees must be encouraged if environmental and bike-ability goals are to be met.
Bicycle routing: Bike-ability and walk-ability are fundamental components of modern design. The pedestrian and bike routing through the parking lot, to and from the front entrance, should be well marked for wayfinding purposes. We suggest that there be striped pavement markings where bike and pedestrian paths cross aisles in the parking lot. Remember that, unlike with other Costco locations, it will be possible to bike and walk to this Costco, which is something we like about it.
Bike parking locations: Bicycle parking for employees should be secure and within the building. This will encourage employee use of bicycles. Consider installing hardware that accommodates vertical bike storage for employees.
We were told that somewhere around the exterior of the building there would be 33 short-term slots in bike racks for bicycle parking. We were also told that there will be 14 slots in long-term bike cabinets. It is unknown whether these bike cabinets are intended for employee bikes.
Bike corrals: Bike corrals should be well lit, have excellent surveillance video coverage, and should be observable from the front of the store. Eyes on bicycle parking areas is essential, whether it be by security, employees, or customers. Bike corrals must also be able to accommodate long cargo bikes, which allow shoppers to carry away purchased items on their bikes. One member suggests a weather/shade cover over a bike corral. The member feels that it would be the kind of construction choice that would bring accolades to Costco. Remember that bike riders would be exiting the store with a cart, as do vehicle drivers, and so there should be a cart coral near the bike corral.
Parking Lot Trees:
We appreciate the density of trees in the parking lot as shown on the plans. This will help to blunt the harsh Sacramento sun on parked vehicles and persons.
Solar/Electrical Considerations:
We would encourage the use of free-standing solar panels to create additional shade. The local distributed production of electricity in California is becoming critically essential as the state will no longer build power stations given the cost and liability/pollution by same. The increase in need for electrical production is related to more electric vehicles, more population, hotter summers, etc. Solar panels should be required for the roof of the warehouse or if not feasible as stand-alone structures in the parking lot. At the very least conduit/wiring should be preplaced to cover the later placement of solar panels and the inevitable increase in need for EV charging stations. Given that no new internal combustion engined vehicles will be sold after 2035, and that there will be significant need for charging stations prior to then, this pre-wiring is essential. No information was available to us about the number of EV charging stations that are planned for this project however we presume that CALGreen and city requirements will be met.
The NNCC looks forward to a modern and attractive Costco facility for North Natomas.
Thank you.
