Issue Detail:

SALARY INCREASES
On November 15, 2022, during a duly noticed Closed Session, the City Council evaluated the performance of the City Attorney and City Clerk and conferred with the City’s negotiator.

The City Attorney’s last salary increase was effective March 27, 2021. As a result of the November

15, 2022, performance review, the City Attorney will receive a salary increase of seven and one-half percent (7.5%) effective March 26, 2022, to provide a salary of $168.773166 per hour. This increase includes both a cost-of-living component and a performance component. The City Attorney’s contract will also be amended to reflect the grant of thirty (30) days of sick leave, effective immediately. The City Attorney’s employment agreement has been amended to reflect these changes, has been executed by the City Attorney, and is included as Exhibit A to the Resolution.

The City Clerk’s last salary increase was July 31, 2021. As a result of the November 15, 2022, performance review, the City Clerk will receive a salary increase of ten percent (10%) effective July 30, 2022, to provide a salary of $113.785630 per hour. This increase includes both a cost-of-living component and a performance component. The City Clerk is also granted two hundred seventeen (217) hours of supplemental leave balances, which can be used as leave or cashed out at the Clerk’s discretion.

SALARY SCHEDULE
Since the new salary for the City Attorney exceeds the current salary range for that job classification, the published range must be adjusted to reflect this change.

Additionally, in order to maintain consistency with recent salary range adjustments for represented employees in the City Attorney’s Office the new salary maximums for the following unrepresented classifications are:

The California Code of Regulations requires that the City Council adopt the City’s salary schedules at a public meeting (2 CCR § 570.5). This obligation arises whenever salary ranges are changed, to ensure that salary rates are transparent and publicly available. These publicly adopted rates are used by California Public Employees’ Retirement System (CalPERS) to determine the appropriate compensation earnable for each City employee when calculating their pension benefit.

Additionally, Government Code 54953 requires that prior to taking final action, the legislative body must orally report a summary of the recommendation for final action on salaries, salary schedules, or compensation paid in the form of fringe benefits of a local agency executive during the open meeting in which the final action is to be taken. Local agency executives are defined in Government Code section 3511.1 (d) as “(d) Local agency executive means any person employed by a local agency who is not subject to the Meyers-Milias-Brown Act (Chapter 10 (commencing with Section 3500)).”

The City Attorney and City Clerk meet the local agency executive definition.

The specific changes to the City’s Salary Schedule are presented in two versions, a red-lined version showing only changes to the Salary Schedule as Attachment 2, and a clean copy of the City’s complete Salary Schedule is included as Exhibit B to the Resolution.

Policy Considerations: Approval of this action by the City Council is consistent with the City’s legal obligation under the CalPERS law.

Economic Impacts: None.

Environmental Considerations: This report concerns administrative activities that will not have a significant effect on the environment and that do not constitute a “project” as defined by the California Environmental Quality Act (CEQA) Guidelines Sections 15061(b)(3) and 15378(b)(2).

Rationale for Recommendation: Approval of this action will establish compliance with the California Code of Regulations §570.5 and Government Code 54953.

BACKGROUND

A. Following a performance evaluation, the City and City Attorney have agreed to amend the City’s Attorney’s contract as set out in Exhibit A.

B. The California Code of Regulations requires that the City Council adopt the City’s salary schedules at a public meeting (2 CCR § 570.5). This obligation arises whenever salary ranges are changed. Additionally, for a local agency executive, Government Code 54953 requires this to be a Discussion Item.

C. These publicly adopted rates are used by California Public Employees’ Retirement System (CalPERS) to determine the appropriate compensation earnable for each City employee when calculating their pension benefit.

D. The salary schedule attached to this Resolution as Exhibit B are posted to ensure that salary ranges are transparent and publicly available.

BASED ON THE FACTS SET FORTH IN THE BACKGROUND, THE CITY COUNCIL RESOLVES AS FOLLOWS:

Section 1. The amendment to the City Attorney’s employment agreement attached to this Resolution as Exhibit A is adopted.

Section 2. The salary for the City Clerk is set at $113.785630/hour. In addition, the City Clerk is granted 217 hours of supplemental leave which can be used as leave or cashed out at the Clerk’s discretion.

Section 3. The salary schedule attached to this Resolution as Exhibit B is adopted.

Section 4. The City Manager is authorized to make minor changes or adjustments to Exhibit B to correct omissions and errors.

Section 5. Exhibits A and B are part of this resolution.
