The units were obtained through a cooperative contract offered by Omnia Partners, number 4400003732. This cooperative contract expired on June 30, 2022.

Policy Considerations: The recommendations in this report are in accordance with the provisions of Section 3.56 of the Sacramento City Code regarding contracts for the purchase of supplies.

Economic Impacts: None.

Environmental Considerations:

California Environmental Quality Act (CEQA): This report concerns administrative activities and governmental fiscal activities that do not constitute a “project” as defined by the CEQA Guidelines Sections 15378(b)(2) and 15378(b)(4) and are not subject to the provisions of CEQA (CEQA Guidelines Section 15060(c)(3)).

EXECUTIVE SUMMARY

PRC002057 Citywide Contract for Wide Format Plotters

The City has a fleet of about a dozen Wide Format Plotters (“plotters”) used by various City departments to print architectural drawings and schematics. There has not previously been a Citywide agreement for this equipment; plotters have been obtained from various vendors. Nine machines are currently being rented from Buckmaster Office Solutions. The units were obtained through a cooperative contract offered by Omnia Partners, number 4400003732. This cooperative contract expired on June 30, 2022.

Buckmaster is offering the City two models of wide format plotters through a University of California contract offered through Omnia Partners. The UC contract is number 2021002788. It was awarded last year through a competitive solicitation, UC RFP #00811-FEB2020.

Rational for recommending City issue a contract to Buckmaster:

Buckmaster offers the City better pricing than the Omnia Cooperative contract. This will save the City money during the 48-month lease period for the plotters. A table comparing the monthly rates, and the savings per plotter over a 48-month lease period, is below:

MODEL CITY PRICE CO-OP PRICE TOTAL SAVINGS
Ricoh MPW6700 $228.00/month $340.43/month $5,396.64
Ricoh MPCW2201 $188.00/month $224.59/month $1,756.32

Procurement compared these rates to a plotter that was recently obtained by a City department from another vendor. The payment terms were $19,000 down and $142.50 per month over a 60-month period. This is a total cost of $27,550. This is about twice what a comparable unit would have cost through Buckmaster. Leasing through Buckmaster allows the City take advantage of lower rates and to upgrade equipment at the end of the term. Buckmaster is a local company that has contracted with the City for many years for copiers and similar equipment. Its technicians know the location of the plotters and can be onsite in a matter of hours if there is a service issue.

To take advantage of these price rates, Procurement will seek approval from the City Council to issue a Citywide agreement to Buckmaster Office Solutions for Wide Format Plotters. Contract number PRC002057 will have an NTE of $175,000. The City contract will expire on January 25, 2026, which is the date that the UC / Omnia contract will expire. -- Gary O’Neill, Contract and Compliance Specialist

19. Entire Agreement. This Contract, including all Exhibits and documents referenced herein, contains the entire agreement between the parties and supersedes whatever oral or written understanding they may have had before the execution of this Contract. No alteration to the terms of this Contract shall be valid unless approved in writing by Contractor, and by City, in accordance with applicable provisions of the Sacramento City Code.20. Severability. If a court with jurisdiction rules that any portion of this Contract or its application to any person or circumstance is invalid or unenforceable, the remainder of this Contract will not be affected thereby and will remain valid and enforceable as written, to the greatest extent permitted by law.22. Waiver.Neither the City’s acceptance of, or payment for, any Goods or Services, nor any waiver by either party of any default, breach or condition precedent, will be construed as a waiver of any provision of this Contract, nor as a waiver of any other default, breach or condition precedent or any other right hereunder. No waiver will be effective unless it is in writing and signed by the waiving party.23. Governing Law. This Contract shall be governed, construed and enforced in accordance with the laws of the State of California, except that the rule of interpretation in California Civil Code section 1654 will not apply. 27. Debarment CertificationA. Pursuant to 2 CFR, Part 200, and applicable Executive Orders, the City is restricted in its ability to contract with certain parties that are debarred, suspended, or otherwise excluded or ineligible for participating in Federal assistance programs or activities. By signing this Agreement, CONTRACTOR warrants and certifies under penalty of perjury under the laws of the State of California that Contractor, including any owner, partner, director, officer, or principal of the CONTRACTOR, or any person in a position with management responsibility or responsibility for the administration of federal funds: (1) Is not presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from covered transactions by any federal or state department/agency; (2) Has not within a three-year period preceding this certification been convicted of or had a civil judgment rendered against it for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public transaction or contract (federal, state, or local); violation of federal or state antitrust statutes; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, receiving stolen property, or other criminal felony; (3) Is not presently indicted for or otherwise criminally or civilly charged by a governmental entity (federal, state, or local) with commission of any of the offenses enumerated in paragraph (b) above; or (4) Has not, within a three-year period preceding this certification, had one or more public contracts (federal, state, or local) or transactions terminated for cause or default. (5) Has not been notified, within a three-year period preceding this certification, been notified of any delinquent Federal taxes in an amount that exceeds $3,500 for which the liability remains unsatisfied. Federal taxes are considered delinquent if the tax liability has been finally determined and the taxpayer is delinquent in making payment, as defined in Section 52.209-5 of the Federal Acquisition Regulations. B. CONTRACTOR further warrants and certifies that it shall not knowingly enter into any transaction with any subcontractor, material supplier, or vendor who is debarred, suspended, declared ineligible, or voluntarily excluded from covered transactions by any federal or state department/agency. Any exceptions to the warranties and certifications in this Section must be disclosed to the City.C. Exceptions will not necessarily result in denial of recommendation for award, but will be considered in determining Contractor’s responsibility. Disclosures must indicate to whom exceptions apply, the initiating agency, and dates of action.D. City will review the Federal Government’s System for Award Management Exclusions maintained by the General Services Administration for eligibility, prior to the execution of this Agreement. The CONTRACTOR shall provide immediate written notice to the City if, at any time prior to execution, the CONTRACTOR learns this certification is erroneous or has become erroneous by reason of changed circumstances. If it is later determined that the Contractor’s warranties and certification in this Section were erroneous, the City may terminate this Agreement for default.
