Additional Description/Analysis
Issue Detail: The city owns the entire portion of Eleanor Avenue (an improved street) within Carl Johnston Park in fee, a portion of which is adjacent to a proposed development located at 245 Eleanor Avenue. There are no easements over Eleanor Avenue dedicating the land for public road purposes. In order to assure there is a record that the portion of Eleanor Avenue within Carl Johnston Park is city fee property used as a public street, staff recommends accepting the above street into the City Street System pursuant to California Streets and Highways Code Section 1806(b).
Policy Considerations: The City Council action recommended in this report is in compliance with California Streets and Highways Code, Section 1806(b) which allows the acceptance of any public or private street or road into the City Street System.
File ID: 2022-01970 12/6/2022 Consent Item 8.
Economic Impacts: None.
Environmental Considerations:
California Environmental Quality Act (CEQA): The Environmental Services Manager has determined that the proposed project is exempt from (CEQA) under Section 15301(c). Exemption 15301(c) consists of existing public right-of-way streetscape improvements involving negligible or no expansion of existing or former use.
Sustainability: Not applicable.
Commission/Committee Action: None.
Rationale for Recommendation: Eleanor Avenue is an existing paved roadway owned by the city that is currently being used by the general public, but it is not public right-of-way. California Streets and Highways Code Section 1806(b) provides that the City Council, by Resolution can accept this portion of Eleanor Avenue into the City Street System.
Financial Considerations: The costs to process this amendment are minimal and are covered within the Division’s operating budget.
Local Business Enterprise (LBE): Not applicable.
