Description/Analysis
Issue Detail: Staff recommends Council approve an agreement with Wood Rodgers, Inc., for professional design and engineering services to support the City’s objective in meeting the interim water quality milestone to achieve at least 30% Full Capture System Equivalency (FCSE) by 2027 and 100% FCSE by 2030 through the implementation of State-certified Full Capture System (FCS) devices in high priority areas.

The State Water Resource Control Board adopted statewide Trash Provisions to address the impacts

of trash on the beneficial uses of surface waters. As a result, the Central Valley Regional Water Quality Control Board issued the Water Code Section 13383 Order to implement the Trash Provisions. The Trash Provisions required the City of Sacramento, as a Phase 1 Municipal Separate Storm Sewer System (MS4) permittee, to select a method of compliance to the trash prohibition for Priority Land Uses (PLUs).

The City of Sacramento (City) prepared a Track 2 Trash Implementation Plan to meet the requirements of the Order, which was submitted in November 2018 to the Central Valley Water Board. Per the Trash Provisions, the City must achieve FCSE by 2030. The City has elected to install State-certified FCS devices that capture trash down to 5 millimeters in size for 1-hour, 1-year storm events in areas where it was feasible for installation and maintenance and within drainage areas with the high trash loads identified through the baseline trash surveys. City Staff has reviewed the baseline trash survey results to determine which drainage areas with high potential for trash load reduction are suitable for the installation of State-certified FCS devices. Three preferred project locations were identified by City Staff as being feasible for siting of large capacity FCS devices that meet the City’s priorities.

Policy Considerations: City Council approval is required for professional service agreements of $250,000 or more per City Code 3.64.020.

Economic Impacts: None.

Environmental Considerations: This report concerns administrative activities that will not have a significant effect on the environment and does not constitute a “project” as defined by CEQA [CEQA Guidelines Sections 15378(b)(2 and 5)] and is therefore, not subject to CEQA [CEQA Guidelines Section 15060(c)(3)].

Sustainability: The proposed project is consistent with the 2035 General Plan Citywide Utility and Stormwater Drainage policies as it reduces impacts to environmentally sensitive lands and provides adequate drainage facilities by reducing the quantity of trash that reaches the Sacramento River and provide appropriately sized bypass facilities for the Trash FCS devices.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: On July 7, 2022, a Request for Proposals (RFP) (P23141311007) was advertised and issued on PlanetBids for design and engineering services for certified Full Capture Systems (FCS) that prevent trash greater than 5 mm from discharging to receiving waters.

On the due date of July 28, 2022, four proposals were received from the following firms:

1. CSG Consultants, Inc.

2. CWE

3. Schaaf & Wheeler

Page 2 of 3 ends

File ID: 2022-02033 12/6/2022 Consent Item 13.

4. Wood Rodgers, Inc.

A 3-member evaluation team that included staff from DOU, evaluated the proposals and interviewed 2 firms. Wood Rodgers, Inc. was the top-ranked firm.

Financial Considerations: The total estimated cost for the project is $600,000. To provide sufficient funding for this project, staff recommends transferring $200,000 from the NPDES Stormwater Program MYOP (I14010200, Fund 6011) and $400,000 from the Base CIP Contingency-Drainage Program to the Drainage Trash Capture Program (W14230100, Fund 6011).

There are no General Funds allocated or planned for this project.

Local Business Enterprise (LBE): Wood Rodgers, Inc. is an LBE.

Task 2 | Preliminary Design Report
Wood Rodgers will perform an evaluation of the City’s three proposed full trash capture projects to assist the City in meeting its goal of 30-percent full trash capture equivalency. Efforts under this task will include feasibility review, hydraulic modeling based on available trash capture system technologies, and reviewing specific aspects of each project site. Wood Rodgers will also investigate potential alternatives capable of achieving the City’s desired goals, and the State’s requirements for trash capture equivalency. Site visits will be conducted for the project locations to obtain an understanding of access, available space and property / right-of-way constraints, utility conflicts, environmental concerns, drainage, and other pertinent aspects. Considerations explored during design will include:
• Design and constructability
• Access for maintenance
• Frequency and extent of maintenance required
• Site security and resistance to vandalism
• Influence on upstream water levels during storm flow
A
s a part of this task, Wood Rodgers will coordinate with full trash capture system device representatives, evaluate alternative systems for suitability for each project site based on the above considerations, and provide recommendations tailored to the specifics of each site. Alternative trash capture options will also be explored and identified where more cost efficient, which may include certified multi-benefit systems or catchment-size certified full capture system devices.

Attachment 1 to Exhibit A

Proposal | Trash Full Capture System Design
Bid Transaction | #P2314311007

The City’s approved selection of the alternatives presented will be further developed into final design as described in Task 3 and Task 4 in this proposal.

Task 2.1 | Data Collection
Wood Rodgers will collect and review any available information such as: GIS storm drain network data, drainage areas, hydrologic and hydraulic models, as-builts, land use data, utility data, and geotechnical data. Wood Rodgers will document the collected data and request any missing data. Wood Rodgers will compile the collected data into a geodatabase.

Deliverables
• Updated Geodatabase
Task 2.2 | Desktop Utility Investigation
Wood Rodgers will perform a desktop utility investi gation to identify underground utilities present in the vicinity of the proposed sites and further refine the sites based on the findings of the investigation. Wood Rodgers will georeference the collected as-builts and utility GIS shape files to identify any utilities in the vicinity of the sites.

Preliminary pothole locations will be identified ar ound the vicinity of the proposed sites and will th en be further refined based on the findings of the field utility locating investigation in Task 3.3.

Deliverables
• Georeferenced utilities and preliminary pothole locations Task 2.3 | Preliminary Assessment + Site Refinement
Wood Rodgers will perform preliminary feasibility assessments of the three sites based on available information and data.

They include the utility information investigated in Task 2.2 , TMAs already developed by DOU, State-certified Full Capture System (FCS) device types, multi-benefit treatment opportunities, site constraints from Google Street views, maintenance considerations, and easements/rights-of-way from the City’s GIS database. These assessment are to determine high-level performance of the devices and potential impacts of the project.

Wood Rodgers will also develop a high-level hydrolo gic and hydraulic analysis for the existing storm d rain systems based on TMAs and existing storm drain geometries and pro perties. The findings of the analysis could be used to assess the capacity of the existing storm drain system and the potential impacts of the proposed FCS.

Wood Rodgers will then refine the proposed site locations based on the information above. If any of the preselected sites are deemed infeasible, Wood Rodgers will work close ly with the City to investigate other sites after r eviewing the model results and all other available collected data.

Task 2.4 | Site Visit
Wood Rodgers will perform site visits to determine potential issues and site constraints for the three FCS sites refined in Task 2.3 . Wood Rodgers will inspect the drainage facilities at the proposed sites to determine structural inte grity, sediment, potential backwater effects and other mai ntenance issues. The inspection data will be used t o determine the improvement extent when there are any other deficiencies found.

Deliverables
• Inspection photos, updated GIS database properties, and field forms summarizing visual findings from s ite field visits
Task 2.5 | Hydraulic Modeling
Wood Rodgers will develop existing condition hydrologic (catchment) and hydraulic (pipes + pumps) models (dynamic) to generate one-year, one-hour water quality flow for FCS device sizing. The dynamic models provide more realistic and accurate hydraulic performance of the facility than simplified hand calculations or the Rational Method by accounting for pipe storage, flow routing, backwater effects, and pipe diversion. This approach generally yields smaller water qualit y flows than the simplified Rational Method for large trash capture device sizing, which results in smal ler and less expensive devices. The Regional Board has accepted this method. The modeled one-year, one-hour flows and annual

Proposal | Trash Full Capture System Design

trash volumes provided by the City will be used to size FCS devices. Up to two different FCS devices will be recommended for each TMA location.

Wood Rodgers will perform hydraulic impact analyses using the models developed in this task to determi ne any adverse hydraulic inefficiencies of the proposed large FCS devices to the existing upstream storm drainage sys tem and to subsequently develop improvements to mitigate the i nefficiencies. Aside from meeting the NPDES permit a nd maintenance requirements, the hydraulic impact anal ysis will be the most instrumental factor in select ing the trash capture device and its system configuration.

Wood Rodgers will modify the hydraulic models to in clude the hydraulic features of large FCS devices a t the three TMAs.

Wood Rodgers will perform a comprehensive hydraulic analysis for the upstream storm drain systems to a ssess the system-wide impact of the large FCS devices on storm drain facilities based on the pre- and post-large FCS devices model results. Wood Rodgers will model and assess the performance of two different device types of large FCS devices to address any requirements and considerations from different stakeholders.

Wood Rodgers will develop a post-project hydraulic model and compare the hydraulic performances of the pre- and post- project conditions for 2-, 10-, and 100-year design storms. The FCS devices will be modeled with a deb ris clogging factor and reduced performance efficiency to simulate the worst-case scenario.

If significant adverse hydraulic impacts are found for the proposed FCS devices, Wood Rodgers will ide ntify and quantify the additional floodplain and the increased hydraul ic grade lines along the main storm drain system in the post-project conditions. We will then propose additional improve ments to mitigate adverse impacts in the post-proje ct condition.

Wood Rodgers will rerun the 2-, 10-, and 100-year p ost-project models with the additional improvements . Potential additional improvements include upstream/downstream pipe upsizing, diversion pipe systems, and underground storage structures.

Wood Rodgers will then recommend the optimal FCS de vice type, location, and additional improvements by considering the hydraulic impacts, ease of maintenance, and acc ess. Wood Rodgers will iterate and optimize the imp rovement configurations required to reduce the post- FCS water surface elevations to the pre-FCS conditions in the 2-, 10-, and 100- year design storms to maintain or minimize existing storm drain system capacity.

Deliverables
• Modeled one-year, one-hour flow; FCS sizes and models for three TMA locations • Pre- and Post-FCS hydraulic results for 2-, 10-, and 100-year design storms Task 2.6 | Life-Cycle Cost Analysis
Wood Rodgers will develop a life-cycle cost analysi s, which includes construction, and operation and m aintenance cost estimates. The construction elements will be devel oped and organized in units, lump sum costs and qua ntities as applicable for all work items. A manufacturer’s quo te will be included for the selected FCS devices. T he construction cost estimates will be developed based on the contractor bids for approximately 50 trash capture devices co nstructed in the City of San Jose and City of Oakland. Wood Rodgers will also develop operation and maintenance costs for a 20-year period of the FCS devices. Wood Rodgers will also develop operation and maintenance costs as well as vandalism and replacement costs for a 20-year period of the FCS d evices. Vandalism frequency will be provided by the City for this analysis.

Deliverables
• Construction, and operation and maintenance costs
Task 2.7 | Preliminary Design Report
A Preliminary Design Report will be prepared to sum marize the findings of the analyses, which include the study area descriptions, life cycle cost analysis, utility inv estigation, existing facility inspection, large FCS device facility sizing, hydraulic analysis, and will include plan layouts and alternative full trash capture systems explored, and recommendations for each. The Preliminary Design Report will inclu de discussions and comparisons of alternatives on m ultiple aspects,

Task 3.2 | Geotechnical Investigation
The proposed exploration program includes site reconnaissance, permitting, verification of utility clearances through USA, geotechnical exploration, field and laboratory test ing, and engineering analyses to allow formulation of geotechnical recommendations for design and construction of the project. The deliverables for this task are anticip ated to be a draft and final geotechnical investigation report.

Wood Rodgers has performed a review of documents pr ovided in the RFP and assumes the invert depth of t he trash capture systems to be a maximum of approximately 10 feet below the invert of the existing channels.

Geotechnical Investigation
Exploration will be performed by drilling six geote chnical borings up to a maximum depth of 35 feet be low the existing ground surface, with two borings at each of the pro posed trash capture system locations. A geotechnic al boring permit will be obtained from the Sacramento County Environ mental Management Department. Wood Rodgers assumes all locations will be on City of Sacramento owned prope rty and traffic control is not required. Wood Rodge rs assumes no other permits are required. On 2 ½-feet to 10-foot centers, samples will be obtained to aid in subsurface characterization.

Soils will be sampled with a two-inch OD split-spoo n sampler driven by a standard 140-pound drive hamm er with at 30- inch stroke. The number of blows to drive the samp ler one foot into undisturbed soil (Standard Penetr ation Test) is an indication of the density and shear strength of the material. Free water depth will be measured were encountered. Wood Rodgers geotechnical personnel will log material encountered during exploration. Representative samples will be returned to our Reno laboratory for testing. It is assumed with this proposal that access is available for exploration equipment and will be provided by the City of Sacramento staff. W ood Rodgers has assumed all three proposed trash ca pture locations will be accessible under one mobilization.

Upon completion of geotechnical exploration, borings will be backfilled with neat cement grout or bentonite in accordance with Sacramento County Environmental Management Dep artment and California Department of Water Resource s standards. Soil cuttings and fluid from drilling wi ll be contained in 55-gallon DOT-approved drums and off hauled by our drilling contractor for disposal. Wood Rodgers assu mes the geotechnical investigation will not encount er any hazardous or toxic substances. In the event that suspected ha zardous materials are encountered, visually or by o dor in any geotechnical test boring, we will immediately termi nate the exploration and make arrangements to backf ill the boring with cement grout. Added costs incurred as a result of suspected hazardous substances shall be invoice d on a time and expense basis and requires a properly executed Change Order.

In addition to advancing geotechnical borings, a sh ear wave velocity profile will be measured to a dep th of 100 feet; this information will allow for Site Class determination as required by the International Building Code (IBC) and can serve as a screening mechanism for liquefaction potential.

Geotechnical Laboratory Testing
Representative samples of significant soil types wi ll be tested in the laboratory for index properties , such as moisture content (ASTM D2216), grain size distribution (ASTM D6913) and plasticity (ASTM D4318). These index pr operties are indicative of mechanical behavior of the soils and aid in determining design parameters. Consolidation (ASTM D2435) and corrosion testing will also be performed to analyze settlement and to assess the environment regarding the potential for corrosivity, respectively.

Geotechnical Data Review, Engineering Analysis, and Reporting Upon completion of our exploration, laboratory, and office studies a geotechnical investigation report, consistent with the requirements of the 2019 California Building Code (CBC), will be completed for the project and will present the following:
• Description of the project site with the approximate locations of our explorations, shown on a Site Plan.

A proposal for a site-s pecific liquefaction assessment will be presented i f the site soil and groundwater conditions present a significant potential for liquefaction based on our initial screening. • Site preparation and grading recommendations. Settlement potential of existing and imported fill soils will be discussed. Subgrade stabilization and excavation co nsiderations due to high groundwater will be discus sed.

Overexcavation requirements due to adverse soil conditions will be addressed. Compaction requirements will be stipulated.
• Recommendations for shallow foundations, including allowable bearing capacity, anticipated settlement (static and short-term seismic loading), and lateral earth design values. • Recommendations for temporary shoring, bracing, and dewatering. • Concrete and concrete slab-on-grade support options.
• Drainage considerations that may affect foundation and concrete slab-on-grade performance. • Pavement design parameters will be formulated for access drives. • Recommendations for additional exploration as appropriate.

A draft geotechnical investigation report will be p rovided for review and comment before a final repor t is issued. One (1 hour) meeting with the City of Sacramento is assumed following submittal of the draft report.

Depending on the availability of the drill rig, fie ld exploration can typically begin within one to tw o weeks of receiving written authorization to proceed. A written draft report will be available within about four to six w eeks after the completion of all field exploration. Two wet-stamped copies and one electronic copy will be provided.

The Opinion of Probable Cost of Con struction will be revised and provided as a final Class 1 level estimate.

Deliverables
• 100-Percent Plans, Specifications, and Opinion of Probable Cost of Construction (electronic PDFs) Task 5 | Environmental Study (CEQA) + Environmental Permitting Wood Rodgers in-house environmental team has determ ined that an Initial Study with Mitigated Negative D eclaration (IS/MND) would be the appropriate level of documenta tion to satisfy the California Environmental Qualit y Act (CEQA) guidelines. This determination was made because the trash capture structures would include temporary a nd permanent effects to jurisdictional waters of the United Stat es, waters of the state of California, and Californ ia Department of Fish and Wildlife (CDFW) jurisdictional habitats. Though the project would cause potentially significant effects to these aquatic resources, Wood Rodgers is confident any project ef fects can be reduced to a less than significant lev el through the incorporation of suitable and cost-effective mitigation measures within the IS/MND.

In addition, Wood Rodgers’ environmental team of pe rmitting specialists understands these project effe cts to aquatic resources would require regulatory permitting with the U.S. Army Corps of Engineers (USACE), the Central Valley Regional Water Quality Control Board (RWQCB), and the CDFW. Wood Rodgers’ recognizes these permitting requireme nts can be time consuming; whereas, Wood Rodgers is confident project effects to Section 404 waters of the U.S would qualify for a USACE Nationwide Permit (NWP) 43 for “Stormwater Management Facilities”. The NWP process will help to expedite the permitting process with the USACE, rather than conducting a letter of permission individual permit. Additionally, the Wood Rodgers’ team is highly knowledgeable and successfu l in securing Section 401 water quality certificati ons within the last two years, in the wake of the new RWQCB waters of t he state discharge procedures. Further, Wood Rodger s environmental team has extensive working relationsh ips with the USACE, RWQCB, and CDFW, which provide clear and concise communications, proving to expedite the permitting process.

Wood Rodgers is highly qualified to complete the environmental clearance and permitting requirements of the proposed project The proposed scope of work will prepare all necessary technical analysis in support of the IS/MND and permitting requirements and complete all necessary tasks for e nvironmental clearance of the proposed project on a n effective schedule, proficiently, and within budget. The scope of work for this task may include:
• Cultural Resources Inventory Report and Native American Consultation • Biological Resources Report
• Draft and Final Initial Study with Proposed Mitigated Negative Declaration • Mitigation Monitoring and Reporting Program and Notice of Determination • Environmental Permits, including Section 401 and 404
Task 6 | Depth Gage Installation, Hydraulic Analysis and Documentation Wood Rodgers, Inc. (Wood Rodgers) is providing desi gn services for a large trash capture device. To as sess the performance of the storm drain system upstream of the proposed large trash capture device, Wood Rodgers proposes to purchase and install a depth gage, collect rain and the depth gage data, and perform a hydraulic analy sis. Wood Rodgers has developed the following scope of work.

Task 6.1 | Furnish and Install Depth Gage
Wood Rodgers will furnish and install a depth measuring gage (ADS Echo or equal) at a manhole/ bridge crossing upstream of the selected trash capture location. Figure 1 shows a typical installation of a depth gage mount ed to an adjustable tension bar within a manhole. The depth gage will i nclude a cellular antenna, sim card, modem and one- year AT&T communication plan for upload of depth data measure ments cloud-based software system as described in Task 6.2. The City will have to renew the AT&T communication plan upon the expiration and replace the battery for co ntinuing monitoring. One day of traffic control will be provided during the installation.

Removal of the depth measuring gage is not included in the scope and fee; however, Wood Rodgers can pr ovide this service upon request.

C.   If, in the performance of this Contract, any third persons are employed by CONTRACTOR, such persons will be entirely and exclusively under the direction, supervision, and control of CONTRACTOR.  Except as otherwise provided in this Contract, all terms of employment, including  hours,  wages,  working  conditions,  discipline,  hiring,  and  discharging,  or  any other  terms  of  employment  or  requirements  of  law,  shall  be  determined  by CONTRACTOR.  It is further understood and agreed that CONTRACTOR will issue W‐2 or 1099  Forms  for  income  and  employment  tax  purposes  for all  CONTRACTOR’s  assigned personnel and subcontractors.

In  addition,  CONTRACTOR  must  comply  with  all  CITY  policies  governing  the  use  of  the  CITY network and technology systems, as set forth in applicable provisions of the City of Sacramento Administrative Policy Instructions # 30.  A violation by CONTRACTOR of this section is a material violation of this Contract and shall justify legal and equitable relief.

8.  CONTRACTOR Information.

A.  CITY shall have full ownership and control, including ownership of any copyrights, of all information prepared, produced, or provided by CONTRACTOR under this Contract.   In this  Contract,  the  term  “information”  means  and  includes:  any  and  all  work  product, submittals, reports, plans, specifications, and other

C.  All  proprietary  and  other  information  received  from  CONTRACTOR  by  CITY,  whether received  in  connection  with  CONTRACTOR’s  proposal  to  CITY  or  in  connection  with Contractor’s performance, will be disclosed upon receipt of a request for disclosure, in accordance  with  the  California  Public  Records  Act;  provided,  however,  that,  if  any information is set apart and clearly marked “trade secret” when it is provided to CITY, CITY  shall  give  notice  to  CONTRACTOR  of  any  request  for  the  disclosure  of  such information.  The CONTRACTOR will then have five days from the date it receives notice to petition the court for a protective order to prevent the  disclosure of the information.

The CONTRACTOR shall have sole responsibility for defense of the actual “trade secret” designation of such information.

D.  The  parties  understand  and  agree  that  any  failure  by  CONTRACTOR  to  respond  to  the notice provided by CITY and seek a protective order, in accordance with the provisions of subsection  C,  above,  constitutes  a  complete  waiver  by  CONTRACTOR  of  any  rights regarding  the  information  designated  “trade  secret”  by  CONTRACTOR,  and  the

Form Approved by City Attorney 9‐1‐2020  Exhibit D ‐ Page 4 information will be disclosed by CITY in accordance with the Public Records Act.

11.  Performance or Different Terms and Conditions. The City's subsequent performance will not
be construed as either acceptance of  additional or different terms and conditions or a counteroffer by the Contractor, nor will  the City's subsequent performance be viewed as acceptance of any provision of the  Uniform Commercial Code, as adopted by any State, that is contrary to the terms and  conditions contained herein. Contractor's performance shall conform to the applicable  requirements of the Sacramento City Charter, Sacramento City Code, and all applicable  State and Federal laws, and all the requirements of this Contract. The California  Commercial Code will apply except as otherwise provided in the Contract.

RESOLUTION NO. 2022-

Adopted by the Sacramento City Council

December 13, 2022

Trash Full Capture System Design

BACKGROUND
A. The State Water Resource Control Board adopted statewide Trash Provisions to address the impacts of trash on the beneficial uses of surface waters. As a result, the Central Valley Regional Water Quality Control Board issued a Water Code Section 13383 Order to implement the Trash Provisions. The Trash Provisions required the City of Sacramento as a Phase 1 Municipal Separate Storm Sewer System (MS4) permittee to select a method of compliance to the trash prohibition for Priority Land Uses (PLUs).

The City of Sacramento (City) prepared a Track 2 Trash Implementation Plan to meet the requirements of the Order, which was submitted in November 2018 to the Central Valley Water Board. Per the Trash Provisions, the City must achieve Full Capture System Equivalency by 2030.

The City has elected to install State-certified Full Capture Systems (FCS) that capture trash down to 5 millimeters in size for 1-hour, 1-year storm events in areas where it was feasible for installation and maintenance and within drainage areas with the high trash loads identified through the baseline trash surveys.

B. To meet the requirements of the order, professional design and engineering services are required to site, design, model, permit, and develop construction plans for the three large capacity FCS devices. The City does not have the expertise and experience to develop FCS devices and adequately model the impacts to the City’s existing storm drainage conveyance systems.

C. City Council approval is required to authorize execution of agreements for professional services of $250,000 or more.

D. A budget augmentation of $600,000 is required to transfer $200,000 from the NPDES Stormwater Program MYOP (I14010200, Fund 6011) and $400,000 from the Base CIP Contingency-Drainage Program (W14000200, Fund 6011) for the Trash Full Capture System Design project.

@BCL@9C1BA199, Rev. 09/09/2020

BASED ON THE FACTS SET FORTH IN THE BACKGROUND, THE CITY COUNCIL RESOLVES AS FOLLOWS:

Section 1. The City Manager or the City Manager’s designee is authorized to execute a contract with Wood Rodgers, Inc. for Trash Full Capture System Design for an amount not–to-exceed $585,829.

Section 2.
