Additional Description/Analysis
Issue Detail: The City of Sacramento Department of Utilities is requesting the vacation of the 10-foot -wide easement for sewer purposes located at 1924 T Street. The 6 inch sewer line that exists within the 10-foot-wide easement is now private and the easement for sewer purposes is no longer needed for public use.
Policy Considerations: The action recommended in this report is consistent with the Sacramento 2035 General Plan and in compliance with the California Streets and Highways Code, Sections 8330- 8336, particularly Section 8333(c) in that the easement proposed to be vacated has been superseded by relocation, is an excess easement, and there are no public facilities located within the easement.
Economic Impacts: None.
File ID: 2022-02015 12/6/2022 Consent Item 9.
Environmental Considerations:
California Environmental Quality Act (CEQA): The Community Development Department, Environmental Planning Services Division has reviewed this vacation/abandonment of the public highway easements and determined that this is exempt from the provisions of the California Environmental Quality Act (CEQA) Section 15305, as a Minor Alteration in Land Use Limitation.
The project consists of the minor alteration in land use limitations with an average slope of less than 20%, which does not result in any changes in land use or density.
Sustainability: Not applicable.
Commission/Committee Action: None.
Rationale for Recommendation: The City is requesting the vacation of a 10-foot-wide easement for sewer line purposes located at 1924 T Street. The 10-foot-wide easement for sewer line purposes is no longer needed for city purposes. Currently, a commercial building is located over the sewer easement. The property owner plans on demolishing the existing building and will relocate its private facilities as needed to comply with future development requirements. Currently, there are no applications for entitlements or building plans filed with the City and there are no conditions associated with this vacation request.
Approval of this vacation request is consistent with the 2035 General Plan land use designation and the permissible densities and intensities of use for the project site. City staff, support the vacation request.
Financial Considerations: The estimate cost to complete this vacation is $5,000. The City’s Department of Utilities is responsible for all fees required to process this application.
Local Business Enterprise (LBE): Not applicable.
