Boulevard and Main Avenue.
The construction phase of this project has ended but has required extensive coordination between City staff, the consultant construction management team, and the contractor to resolve disputed costs, beyond the consultant’s approved scope of services.
Staff recommends the City Council approve Supplemental Agreement No. 10 with HDR Construction Controls Inc. for the City Agreement No. 2019-0336. The proposed Supplemental Agreement No. 10 provides compensation for additional correspondence, meetings, coordination, and claims hearings required to close the construction contract for this project. This supplement also provides compensation for consultant support during Caltrans project audits and preparation of federal closure paperwork as required by the projects federal funding sources.
Policy Considerations: This Change Order exceeds the City Manager’s approval authority and requires the City Council approval per City Code 3.60.210.
The Sacramento City Code Section 4.04.020 and Council Rules of Procedure (Chapter 7, Section E.2.d) mandate that unless waived by a 2/3 vote of the City Council, all labor agreements and all agreements greater than $1,000,000shall be made available to the public at least (10) days prior to council action. This item was published for 10-day review on January 12, 2023, in compliance with the City Code.
Economic Impacts: None.
Environmental Considerations:
California Environmental Quality Act and National Environmental Policy Act (CEQA/NEPA): The City adopted a Mitigated Negative Declaration (MND) in compliance with CEQA on October 29, 2013.
The project is funded by federal Highway Bridge Program funds. As a result, the proposed project is also subject to NEPA requirements. On November 21, 2013, Caltrans approved a Categorical Exclusion for the project pursuant to the requirements of NEPA.
Sustainability: This project is consistent with General Plan goals of improving the transportation system, expanding public safety, creating a well-connected transportation network, conserving energy resources, reducing greenhouse gas emissions and air pollution, and do so while continuing to accommodate auto mobility.
Commission/Committee Action: None.
File ID: 2022-02216 1/24/2023 Consent Item 6.
Rationale for Recommendation: Supplemental Agreement No. 10 is needed to provide funding for additional consultant support required for project audits, construction claims process, and project closure activities.
Financial Considerations: The total estimated cost of the Rio Linda Boulevard Bridge Replacement and Main Avenue Realignment Project (T15095200) is approximately $11.2 million. There is sufficient funding available in the project to execute Supplemental Agreement No. 10 to City Agreement No. 2019-0336 with HDR Construction Controls Inc., for an amount not-to-exceed $74,223 and cover the remaining staff time and project closure costs.
Due to project delays and additional tasks, the project required $150,000 from fund balance from the Major Street Construction Tax in order to make all necessary payments. In order to allow for potential future uses of fund balance, the authority needs to be reset.
There are no General Funds allocated or planned for this project.
Local Business Enterprise (LBE): The contract with HDR Construction Controls Inc. is a federally funded contract and as a result, Disadvantaged Business Enterprise (DBE) project participation requirements apply. LBE policy is held in abeyance. HDR Construction Controls Inc. has pledged
9.0% DBE project participation, meeting the 9.0% DBE goal set for this contract.
