2-Terminix Contract Supplement No. 3
Description/Analysis
Issue Detail: The City receives Integrated Pest Management services (IPM) at over 125 City buildings. The current contract with Terminix expires on February 28, 2023. A new bid and new contract(s) are anticipated to be awarded in late February 2023.The new contractors will need several weeks to ramp up to provide service to the sites. Increasing the not to exceed amount of the current contract will allow the City to continue necessary services during the transition time.
Policy Considerations: The recommendation in this report is in accordance with the provisions of City Code 3.56 and Administrative Policy AP-4101 for the purchase of nonprofessional services.
Economic Impacts: None.
Environmental Considerations: California Environmental Quality Act (CEQA): This report concerns

administrative activities and governmental fiscal activities that do not constitute a “project” as defined by the CEQA Guidelines Sections 15378(b)(2) and 15378(b)(4) and are not subject to the provisions of CEQA (CEQA Guidelines Section 15060(c)(3)).
Sustainability: The contract requires that the contractor be certified by EcoWise or GreenPro for best environmentally friendly practices to control pests.
Commission/Committee Action: None.
Rationale for Recommendation: Extending the contract with Terminix by an additional two months will allow time to transition to new contractors for IPM service. Increasing the not to exceed amount of the contract will allow the City to pay for the additional two months of service.
Financial Considerations: Funding for these contracts is included in Fiscal Year 2022/23 operating budgets and/or capital improvement program budgets of the departments that require these services.
Funding for subsequent years is subject to Council approval.
Local Business Enterprise (LBE): Terminix is not an LBE.
Background: The need for pest control service in the City has increased as there were over 160 311 Work Orders submitted in fiscal year 2022/23 for pest control service. The frequency of service at many buildings needs to be increased. In addition, buildings have been added to this Citywide agreement that were previously serviced by various contractors under various department contracts.
The City issued Request for Information (RFI) No. I23061521003 to informally gather comments and suggestions from potential contractors and end users in the City. These comments and suggestions were incorporated into the subsequent solicitations. The RFI was published on October 24, 2022, and comment period closed on November 21, 2022.
The City issued Request for Qualifications (RFQual) No. Q23061521004 on December 12, 2022.
This RFQual was to gather Statement of Qualifications from potential contractors who need to meet minimum qualifications for IPM service. The period to submit a Statement of Qualifications ended on January 5, 2023.
The City issued By-Invitation-Only Request for Bids (RFB) No. B23061521005 on January 18, 2023, with a closing date of January 31, 2023. The bid was only sent to those potential contractors who met the qualifications stated in the RFQual. The bids will be evaluated and a final recommendation for award of contracts will be present to the City Council in early March 2023.
