Additional Description/Analysis
Issue Detail: This request is to vacate three areas of a five-foot wide public utility easement (PUE) as part of the development requirements for the Villa Jardine/Coral Gables affordable housing project at 41 Coral Gables Court. The vacation of these PUEs will help facilitate the development of an 82- unit affordable housing project as referenced in IR20-144 with the City’s Planning Division. The easements exist over vacant lots with no structures. The PUEs are part of the dedications filed with map “GuildAcres Unit No. 2”in 73 BM 28 with the Sacramento County Recorder’sOffice and are not

map “GuildAcres Unit No. 2”in 73 BM 28 with the Sacramento County Recorder’sOffice and are not needed or required for public use.
Policy Considerations: The action recommended in this report is consistent with the Sacramento 2035 General Plan and in compliance with the California Streets and Highways Code, Sections 8330- 8336, particularly Section 8333(c) in that the easement proposed to be vacated has been superseded by relocation, is an excess easement, and there are no public facilities located within the easement.
Economic Impacts: None.
Environmental Considerations: California Environmental Quality Act (CEQA): The Community Development Department, Environmental Planning Services Division has reviewed this vacation/abandonment of the public highway easements and determined that this is exempt from the provisions of the California Environmental Quality Act (CEQA) Section 15305, as a Minor Alteration in Land Use Limitation. The project consists of the minor alteration in land use limitations with an average slope of less than 20%, which does not result in any changes in land use or density.
Sustainability: Not applicable.
Commission/Committee Action: None.
Rationale for Recommendation: The Sacramento Housing and Redevelopment Agency (SHRA) is the applicant requesting the vacation of the PUEs as part of an 82-unit affordable housing project.
The current property owner Villa Jardin/Coral Gables L.P. is working with SHRA on the project. No utility services exist within the PUEs and there are no conditions associated with this vacation request.
Approval of this vacation request is consistent with the 2035 General Plan land use designation and the permissible densities and intensities of use for the project site. City staff support the vacation request.
Financial Considerations: The estimated cost to complete this vacation is approximately $5,000.
The applicant is responsible for all fees required to process this application at no cost to the City.
Local Business Enterprise (LBE): Not applicable.
