2- Supplemental Agreement
Description/Analysis
Issue Detail: GHD, Inc. (GHD) provides professional engineering and design services for the closure of the Cannon-Scollan Landfill and Encroachment properties. This supplemental agreement extends the agreement term through December 31, 2026 and adds $130,068 to increase the not-to-exceed amount of the agreement to $357,628 in order to support a revised cover design for Cannon-Scollan Landfill, engineering services during Union Pacific Railroad’s (UPRR) closure activities south of Cannon-Scollan Landfill, and removal of the previous flare system that is no longer in use.

Policy Considerations: The recommendations in this report are in accordance with Administrative Policy 4102 for Professional Services Agreements requiring Council approval of agreements which extend a term beyond five years and section 3.64.040(A)(1)(b) of the City Code which requires

council approval for a supplemental agreement that increases the agreement amount to $250,000 or more.

Economic Impacts: None.

Environmental Considerations:

California Environmental Quality Act (CEQA): The City of Sacramento's 28th Street Landfill was certified closed in 1998 and is complying with the post closure maintenance requirements of the State of California and federal government. The 28th Street Landfill is a closed landfill, with a methane gas collection system and two operating flares. A third flare at the site is inoperable and will be removed. The supplemental agreement would support a revised cover design for Cannon-Scollan Landfill, engineering services during Union Pacific Railroad’s (UPRR) closure activities south of Cannon-Scollan Landfill, and removal of the previous flare system that is no longer in use.

Execution of the contract for general engineering and design is an administrative activity of the City and is not a project under the California Environmental Quality Act (CEQA) and is therefore not subject to CEQA review. CEQA Guidelines section 15378(b)2); 15060(c)(3).

The flare removal is consistent with the operation of the closed 28th Street Landfill. The flare was installed in 1997 and has no historic significance. The City would prepare and complete a health and safety plan, work plan, and traffic plan related to the removal of the flare. Notice to users of the Sutter’s Landing Regional Park would be provided in connection with any interruption or disruption to access the park. Requirements of other regulatory agencies with an interest in the landfill would also be satisfied. With this planning in place, the removal of the flare would not result in any significant effect and would be exempt from CEQA pursuant to the commonsense exemption because the City can determine with certainty that no significant effect on the environment would occur. CEQA Guidelines section 15061(b)(3).

Sustainability: The project is consistent with the 2035 General Plan, Goal PHS 3.1 Reduce Exposure to Hazardous Materials. The engineering design and flare removal work by GHD provides the City with opportunities to maintain the safety of visitors at Sutter’s Landing Regional Park and reduce exposure to hazardous materials and waste.

Commission/Committee Action: None.

Rationale for Recommendation: The Cannon-Scollan properties owned by the City of Sacramento were used as refuse disposal sites in the late 1950s. Disposal sites that are no longer receiving waste must be closed in accordance with applicable statutes and regulations. The City is responsible for preparing these sites for post-closure maintenance by following an approved plan and

construction schedule. Hence, the need for an engineering consultant to carry out these services.

GHD is a global firm providing professional engineering work and was procured through RFQ No.

Q16014541001. GHD has prepared 100% drawings for the closure of Cannon-Scollan Landfill that have been under review by state and local agencies. The drawings, however, require revisions due to UPRR’s landfill closure project proceeding ahead of the City’s Cannon-Scollan project and comments from the Central Valley Regional Water Quality Control Board. Progress on the Cannon-Scollan project has taken longer than anticipated due to extended periods of regulatory review. City staff anticipates these extended periods of time to obtain final approval of closure designs from all regulatory agencies may continue. Due to the time it takes to obtain construction and permit approvals, and post construction monitoring, staff requests approval to extend the agreement to December 31, 2026.

Additionally, GHD has prepared a turnkey solution for removal of an old flare east of 28th Street. The old flare was built in the mid-1990s and became inoperable when the volume of methane gas decreased. Removing this flare will beautify the gateway of Sutter’s Landing Regional Park. As such, staff recommends the City Council approve Supplemental Agreement No. 4 with GHD to include the following tasks:
· Existing Task 2H. Project Management
· New Task 6. Revise Cover Design for the Cannon-Scollan Landfill · New Task 7. Engineering Services During UPRR Waste Capping Activities · New Task 8A. Old Flare - Site Preparation and Reporting · New Task 8B. Old Flare - Demolition
Financial Considerations: Supplemental Agreement No. 4 to City Agreement No. 2018-1186 will increase the agreement amount by $130,068 for a new not-to-exceed amount of $357,628. Cannon- Scollan (Y13000200) will be charged $69,920 and $60,148 will be charged to Landfill Closure (Y14000100) for flare removal. This Supplemental Agreement will extend the term of the agreement to December 31, 2026, from the previous expiration of August 9, 2023.

There are no General Funds planned or allocated for this project.

Local Business Enterprise (LBE): GHD is an LBE.

January 13, 2023 Project: 11180511 Ms. Sandy Saechao, Administrative Analyst Recycling and Solid Waste Division City of Sacramento, Department of Public Works 2812 Meadowview Road Sacramento, CA 95832 Supplemental Proposal for Engineering and Design Services Cannon-Scollan and Nearby Properties, Sacramento Dear Ms. Saechao, GHD Services Inc. (GHD) is pleased to submit this supplemental proposal for engineering and design services to the City of Sacramento Department of Public Works (City) at the Cannon-Scollan and nearby properties in Sacramento. This proposal supplements existing GHD scope (Tasks 2A through 5B) to close the Cannon-Scollan Landfill and Dellar encroachment. The following sections present the scope, assumptions, project team, schedule, budget and contracting. Scope This supplemental proposal requests authorization for additional funds for existing Task 2H and authorization for new scope of work Tasks 6, 7, 8A and 8B described below. Existing Task 2H Project Management GHD has proposed an additional $5,085 for existing Task 2H for the GHD Project Manager to attend meetings with the City and stakeholders in 2023. New Task 6. Revise Cover Design for the Cannon-Scollan Landfill In first quarter 2021, the City submitted the Final Disposal Site Remediation Work Plan, design drawing set, and specifications for a final cover of the Cannon-Scollan Landfill to the LEA and the Central Valley Regional Water Quality Control Board (RWQCB). Two events have occurred that require a revision to the existing cover design prepared by GHD. 1) In September 2022, Jacobs Engineering designed a cover for Union Pacific Railroad(UPRR) property to the south of the Cannon-Scollan property. The Jacobs design modifiedthe existing UPRR drainage swale and fence alignment that overlaps with the southernportion of the existing Cannon Scollan Landfill cover design. Under this task, GHD will revisethe existing Cannon-Scollan Landfill cover design such that surface water drainage on theCannon-Scollan property is coordinated with the new UPRR drainage swale.2) In December 2022, the RWQCB provided a comment letter that expressed concerns on theexisting Cannon Scollan Landfill cover design. GHD will revise the existing Cannon-ScollanLandfill cover design to address the following items. 11180511 | Proposal for Services at Cannon-Scollan and Nearby Properties 2 a) Prepare ROWD: The RWQCB has indicated they will prepare Waste Discharge Requirements (WDRs) under Title 27 California Code of Regulations (27 CCR) §20080(f) to permit the landfill closure. If required by the RWQCB, GHD will prepare a Report of Waste Discharge (ROWD) that includes information regarding the Cannon-Scollan Landfill required in 27 CCR §21750 Waste Management Unit (Unit) Characteristics and Attributes to be Described in the ROWD to support preparation of WDRs. One final version of the ROWD will be provided to the City. b) Cover Design: In 27 CCR §21090, the RWQCB requires a “prescriptive” cover design consisting of the following: a 2 ft foundation layer over waste; 1 ft low-permeability layer with hydraulic conductivity not more than 1 x 10-6 cm/sec; and 1 ft erosion resistant vegetative layer. An “alternative” cover design can be proposed but must be approved by the RWQCB. GHD will collaborate with RWQCB technical staff to agree upon an acceptable cover design that optimizes the reuse of the McKinley Park soil, previously stockpiled near the Cannon-Scollan property. The revised design may require import of additional soil (i.e., clay) that meets the hydraulic conductivity requirement. c) Stormwater Drainage Design: The RWQCB is concerned that the proposed lined stormwater detention pond may allow infiltration into underlying waste. In addition, the RWQCB requires any drainage swales to be lined if they are over the landfill cover to prevent infiltration into underlying waste. GHD will collaborate with RWQCB technical staff to agree upon an acceptable drainage design. One potential option is to collect stormwater form the Cannon-Scollan Landfill and convey it to the existing Blue Diamond retention pond using a combination of lined swales and pipe culverts. The revised cover drawing set and associated specifications will be provided to the City in draft and final versions. New Task 7. Engineering Services During UPRR Waste Capping Activities GHD will provide engineering services during UPRR waste capping activities to the south of the Cannon-Scollan property. The services may include observing construction work, responding to requests for information, and attending construction meetings. GHD has budgeted 10 hours for a licensed professional engineer and 20 hours for a project-level engineer. New Task 8A. Old Flare – Site Preparation and Reporting The old flare compound is located at the southwestern edge of the 28th Street Closed Landfill. Sutter’s Landing Dog Park and 28th Street are to the west of the Site, the landfill is to the north and east, and McKinley Village Way and electrical power lines are to the south. The northern portion of the compound features the active flare while the southern portion of the compound features the old flare and most components to be demolished. The compound is enclosed by a wrought iron fence and double gates on two sides facing the landfill and a concrete wall on two sides facing City streets to reduce visual impact. Truck access to the landfill is via double gates on McKinley Village Way near the stormwater detention pond. Dirt roads at the landfill perimeter lead to the compound. Prior to commencing demolition activities, GHD will prepare a Health and Safety Plan (HASP) and perform a radioactivity scan of the flare stack. The HASP will be provided to the City as a final document in electronic format only. Based on information provided by the City, there is a possibility that insulation within the flare stack could exhibit low levels of radioactivity. GHD will perform a radioactivity scan using a handheld, Geiger meter with sensitivity to low levels of alpha, beta, and gamma radiation such as a GAMMA Scout, Ranger Radiation Alert, or equivalent instrument. 11180511 | Proposal for Services at Cannon-Scollan and Nearby Properties 3 Background Scan: GHD will first perform a radioactivity scan in the vicinity of the flarecompound to establish background levels.External Scan of Flare Stack: GHD will next perform a radioactivity scan of the outside ofthe flare stack. Internal Scan of Flare Stack (Ground Level): Next, GHD assumes that City personnel willremove the vent cover located on the north side at ground level to allow access to the insideof the flare stack. GHD personnel will not enter the flare stack which is considered aconfined space; instead, GHD will use a pole to insert the Geiger meter inside the stack.GHD will provide the City with the results of the radioactivity scan in an email with an attached table of results. If radioactivity above background is detected, GHD will stop work on the project and consult with the City on how to proceed. A Work Plan and Completion Report are required to document demolition activities to CalRecycle and the County of Sacramento acting as the Title 27 solid waste regulations Local Enforcement Agency (LEA). GHD assumes that both documents are brief, letter-format deliverables in electronic format only (i.e., Adobe PDF). GHD will prepare a draft version of each document for the City for review. Upon receiving comments from the City, GHD will prepare a final version of each document for the City to deliver to regulatory agencies. New Task 8B. Old Flare – Demolition GHD The demolition scope is based on a site visit by GHD and the City on July 21, 2022, and the following documents provided by the City: “General Arrangement Layout” drawing marked up by the City to indicate items to bedemolished (“Scope Drawing”);Old flare drawings by John Zink circa 1997; andGas handling system drawings by PEI circa 2014.GHD will demolish the following items in the flare compound identified by the City on the Scope Drawing: old flare stack, condensate skid, control panel, compressor, and oil tank. In addition, the City specified new electrical work. Old Flare Stack: The old flare stack is in the southwestern portion of the flare compound. Alift plan will be prepared prior to lifting. The stack will be removed using two cranes to lift itoff the concrete pad and load it onto a flatbed truck. The primary crane will be a 110-tonhydraulic crane to perform the pick. The second crane will be a 45-ton boom truck tostabilize the bottom of the stack. The stack will be secured to the flatbed truck and hauledoff-site to a local metal scrap facility.Condensate Skid: The condensate skid is adjacent to and north of the old flare stack. Theskid and associated equipment will be removed from the concrete pad.Compressor: The compressor is located adjacent to and south of the active flare stack. Thecompressor will be removed from the concrete pad.Oil Tank: The oil tank is located south of the active flare equipment. During the site visit, thetank was observed to be fabricated of plastic, open at the top, and contained less than 55gallons of liquid with an oily sheen. The liquid will be pumped from the tank and containedin a drum or tote. The liquid will be disposed off-site at an industrial wastewater treatmentplant. The tank will be removed from the concrete secondary containment. 11180511 | Proposal for Services at Cannon-Scollan and Nearby Properties 4 Electrical Work: An electrician will perform lock-out/tag-out, as necessary, of existingelectrical service to the items described above prior to demolition.General Demolition Activities: Bolt threads exposed from removing the old flare stack andother equipment will be made flush with the concrete pad using a grinder. A fire watch willbe performed during any hot-work activities. Non-recyclable materials will be loaded into aroll-off bin for off-site disposal. Metal scrap will be loaded into a separate bin for off-siterecycling.Assumptions The following assumptions were used to prepare this proposal. The City will contract with a licensed surveyor to provide existing conditions and topographicsurvey of the area for the UPRR drainage swale. Note that JTS Engineering Consultants,Inc. surveyed the Cannon-Scollan property on September 11, 2020 which provided thebasis for drawing sheet C-101 Existing Conditions in GHD’s May 2021 drawing set. GHDhas not included budget in this proposal for surveying. No engineering plans, permits, or permit fees are required.Demolition scope of work is limited to the items identified in the Scope Drawing.Work areas will be clear of any equipment or materials. No other field work will be occurringon the landfill(s) when GHD is onsite.8-hour standard working days (Monday through Friday).HAZWOPER training is not required, and personal protective equipment (PPE) is limited toLevel D.Flare stack dimensions of 9’0” outer diameter and 40’1” height. No sectioning is requiredto load or haul the stack.Flare stack weight equal to 18,400 pounds. No crane mats are required; stable soil conditions are present to set up the cranes. No abatement of the stack is required prior to scrapping. No handling, transportation, or disposal of materials exhibiting radioactivity or radiation. No concrete demolition, soil excavation, or subsurface work are required. No conflicts with overhead high-voltage electrical lines. All overhead electrical is a safedistance from the flare stack during the lifting operations. No purchase or installation of flanges, valves, or other mechanical items to close off gas orliquid lines.Water is available free of charge for fire watch. All equipment and materials will be storedon-site daily/nightly in the secured flare compound.Metal scrap value of demolished equipment is estimated to be minimal and has beencredited to the City in the ICS bid.Delays beyond the control of GHD may result in additional charges.Prevailing wage requirements apply. 11180511 | Proposal for Services at Cannon-Scollan and Nearby Properties 5 Project TeamFor the flare demolition work, GHD will act as the prime contractor (License No. 855376) with Innovative Construction Services (ICS) as the demolition subcontractor. ICS will subcontract to Bigge Crane and Rigging Company for lifting services. The scope of work described in this proposal will be managed by GHD’s Business Group Leader for Waste Management, Guy Graening, who will also serve as the California licensed professional civil engineer. Field staff will be sourced from the GHD Roseville and Cameron Park offices. Schedule Currently, GHD’s efforts on the Cannon-Scollan landfill closure are in a hiatus while the RWQCB and other agencies review the 100% design package. GHD is prepared to begin immediately on new Task 6 and will provide a revised draft design within 6 weeks of notice to proceed. The new Task 7 will commence when UPRR begins its construction work. For new Task 8A, GHD can begin pre-field activities immediately upon acceptance of this proposal. GHD anticipates 10 days for pre-field activities (Task 8A), and 3 days for field activities (Task 8B).
