bidding in favor of issuing Requests for Proposals (RFP) to further expand a Citywide Cleanup initiative.

After a review of seven proposals, Forensiclean was chosen by the RFP review team. Forensiclean LLC has proven to be a valuable partner that provides the expertise, community relationships, and cost effectiveness necessary to assist the City in addressing the effects of homeless encampments.

To continue DCR’s efforts to mitigate the impacts of homeless encampments in the City, DCR recommends awarding Forensiclean LLC $4,001,701 to provide cleanup services for one year, beginning April 1, 2023 through March 31, 2024. Forensiclean LLC provides encampment cleanup and litter abatement services dispatched via the City’s 311 service. Forensiclean teams will respond to 311 calls throughout the City 7-days a week, between 7:00 a.m. - 5:00 p.m.

Since July 2021, Forensiclean has responded to nearly 17,753 cases, collected over 79,373 cubic yards of trash and collected nearly 76,440 hypodermic needles.

Policy Considerations: Pursuant to Sacramento City Code section 3.56.090, any agreement for non-professional services that is for $250,000 or more requires City Council approval.

The Sacramento City Code Section 4.04.020 and Council Rules of Procedure (Chapter 7, Section E.2.d) mandate that unless waived by a 2/3 vote of the City Council, all labor agreements and all agreements greater than $1,000,000 shall be made available to the public at least ten (10) days prior to council action. This item was published for 10-day review on March 16, 2023, in compliance with the City Code.

Economic Impacts: None.

Environmental Considerations: This report concerns administrative activities and government fiscal activities that do not constitute a “project” and is not subject to the provisions of California Environmental Quality Act (CEQA) (CEQA Section 15378(b)(2)).

Sustainability: Homeless encampment cleanup services support the safe collection and disposal of waste to reduce impacts on public health and natural resources.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: Services provided under this agreement address the ongoing mitigation of the impacts that homelessness has had on the City.

Time is of the essence in addressing these needs as the current Citywide Cleanup Agreement expires on March 31, 2023.

Financial Considerations: Sufficient funding is available in the Homeless Mitigation MYOP (I15200200) and in the Homeless and Community Outreach MYOP (I23004000) to support the recommended budgetary transfers. Upon completion of the recommended budgetary transfers, sufficient funding will be available in the Community Response MYOP (I23000100) to execute the Agreement with Forensiclean LLC in an amount not-to-exceed $4,001,701.

Local Business Enterprise (LBE): Forensiclean LLC is a business local to the City of Sacramento and is a registered LBE.

Transfer Funding from Homeless and Community Outreach Multi-Year Operating Project (MYOP) (I23004000) and Public Works Homeless Mitigation MYOP (I15200200) to Community Response MYOP (I23000100)

BACKGROUND

A. In July 2021, DCR entered into it’s first Agreement with Forensiclean LLC to assist the City in mitigating the effect unsheltered homelessness has had on the City of Sacramento.

B. In January 2022, DCR entered into an Agreement with Forensiclean LLC to expand their scope of work in an effort to be more responsive to address the impacts of unsheltered homelessness.

C. In August 2022, the City adopted an ordinance amending Chapter 12.25 of the Sacramento City Code relating to Sidewalk obstructions.

D. As a result of the ordinance amendment, DCR sought Council approval to suspend competitive bidding in favor of issuing Requests for Proposals (RFP) to further expand a Citywide Cleanup initiative.

E. An RFP review team determined that due to Forensiclean’s expertise and cost effectiveness, they were the best choice to continue our ongoing partnership and continue to mitigate the impacts of unsheltered homelessness.

F. Funding will provide 12 months of service to all 8 Council Districts between the hours of 7am-5pm, 7 days/ week.
